Got RFE after waiting for 4 months. Aba time chaina, out of status yo December ko mid ma bhaincha. Tesaile upgrade garnu paryo premium ma bhaneko ta attorney upgrade garnu hudaina bhancha. Upgrade to premium processing depends on the nature of RFE, regarding your case I wouldn't recommend you bhancha.
k upgrade to premium processing after RFE is risky in some case?

Please suggest!!!

what kind of RFE did you get. your attorney probably be right. ask the reason why premium is not recommended for such RFE.

According to him, it's related with my employer. He will address and handle it. Nothing should be done by me except waiting.
I have never heard that upgrading to premium may be risky. So, asking for suggestion from the xperienced one.

My attorney is not ready to tell the reason for RFE.
He is kind of very rude one. That's the problem.

Premium garyo bhane 99% reject huncha re. Yedi talai status ko problem cha bhane, petition nai withdraw garidinchu re.
Is it legal for any of the attornies hired by the employer to threat like  I can withdraw your petition and so on.

Very 1st time.
So called attornies of my employer threaten to withdraw the petition. That has made me gone mad.
My employer is not co-operating as well, that's the bad part.
I would have already quit and avoided but status is what is compelling me to stay quiet.

you need to understand what exactly the RFE is about and discuss the issue on trackitt.com? is the lawyer an employee of your company or a third party. if the lawyer is not being professional then mostly likely he/she is part of the company and will not disclose information. find out from his email.

is your company a desi consulting company ?

Yes the attorney is the part of tmy consuting company.
I wish my employer to be desi company. @ least i would not have to gone through the burden.
My,  so called employer is one of the reputed consulting company, in the business since last two decades.

any one can ask for premium processing at any point of time, i dont think the premium processing will increase the possibility of getting rejected. Like i said in the previous thread created by you, one of my buddy applied without the premium processing got RFE and then applied for premium processing. He got the answer after 3 weeks, the only down side of it was he got the h1 for only 1 year. Hope this helps you and Good Luck.
P.S. ask the attorney how much it costs for premium processing and if you can afford it pay it out of your pocket.

i m ready to pay from my pocket for upgrading to pp. However, the attorney is a stubborn sh**. He only answered.
"I don't want to repeat the same thing. If you do premium, 99% chance of rejction. Why to waste money? Don't waste my time else I will withdraw your petition"
I talked with my employer, they replied, he knows what to do. why are you being oversmart?

Yes you can do premium processing at any time. I got RFE while applying for the first time regarding employer employee relationship and I did premium processing once I replied the RFE and got accepted for H1b. USCIS just need all the documents that's all.

My dear friend,
When you get RFE (Request For Evidence) for H1B , then USCIS is asking for more documents and unless you provide exactly or similar to what is being requested for verification, prepium processing or normal processing does not matter really. If the documents are not complete and USCIS think that they still need more proof, they will still send second RFE and if they think is not valid, they may reject  the H1B.

So while sending RFE, they have mentioned why you got RFE and what documents to provide within the mentioned deadline. Thats important. Prepare documents and submit before the deadline, just premium processing without proper documents is not going to work at all. I hope you got my point clearly. All the best.

just to be clear i was implying that you do the premium processing after you provide the document.
Sadly there is nothing you can do right now other than what the lawyer tells you to do but if i were you i would have a backup plan if anything goes wrong like CPT and joining other consultancy.

I don't mind being rejected. But these things are making me crazy.
 
- the crap*y attorny threaten to withdraw the petition,
- is not allowing for premium processing though I want to pay myself
- is not responding my email, neither receiving my call
- my, so called employer(consultancy) is also brainwashed by that attorney, so only listen to the attorney.
 
All my h1b petition decision is on hand of that attorney not of USCIS. That is really bothersome.
 
 
 
- I am doing a master's degree in computer science. Almost done.
- Working as a software developer on CPT at the same client with the same consultant since last 2 years
- My consultant is in business since last more than two decades and it's not Desi Consultancy.
 
Still got RFE. I doubt, the attorney intentionally didn't submit all the documents from the employer side to verify employee-employer relationship.
 
Question - why would he do that? 
Answer - coz he is a Je*K. There was a kind of argument between him and me on phone bcoz, tyo kori le phone gari thulo thulo swar ma gali garna khoji
rako thiyo.as i send two times email to him. k-k document chainca bhanera 1 choti email pathaye. reply diyena ani feri email pathaye, 
Then phone garera gali garna khojyo which was insane, not professional. Neither he is my employer nor my boss and neither I am
tesko bau ko nokar. So I had to answer and I did but professionally. Galti gare neurera mafi pani maginca. Bina galti yo seer kasaiko agadi jhukaidaina.
tehi padeko thiye nepali ma sano bela. Aile practically implement gardai chu. -J-
 
 
Anyways, Thank you all for your time and suggestion.
I wish I can communicate with USCIS regarding it. I wish I can sue that attorney for mishandling my case and not doing his duty.
