 IT Consultant--Permanent hire offer--dilemma

 Hello All,
I'm working in a reputed US firm as an IT consultant.
I entered as a consultant through a desi consultancy----->prime vendor---->client.
I have worked for almost a year now and the client I'm working with doesn't keep someone as a consultant for more than 1 year.
They are going to offer me a proposal for direct hire. I have a GC so immigration status is not a problem here.

My Problem/ confusion are:

1) Desi consultancy has made me sign a paper that says that I wont work for the same vendor or same client directly.
-----------Does it matter if I break this promise? They are no saint either.

2) How likely it is that the Client I'm working with will conduct a background check?
----I mean I have worked with them for a year already. Will they conduct any bg check? Will HR or my project manager know what I have put down in my bg check form and will they tally it against my resume? Because if they do not know then I can put forward my real background.

3) If they tally my bg with my resume, what is the worst that will possibly happen? 

Any input from experienced Sajhaites would highly be appreciated.

Here is my 2 cents on the matter -
1. This is kind a new. Usually there is a clause between the client and prime vendor that the same person cannot work for client through differnt prime vendor before ceratin time expires, and they cannot turn the same employee full time before reaching certain time frame. Mine was 6 months.
Usaully consultancy makes you sign that you have to work for them for a year. But this is new. But then I think u made a mistake by signing such stupid clause in your agreement. I don't know what will happen if you break ur contract. and how far your consultancy will go to file lawsuit aganist you. But If I were you, I would read that contract again very carefully and see if there are loopholes in it.
Also talk to your employer and prime vendor if there is any clause between them as well.
Either ask help from consultancy or lie them about it. Tell them you are going back to country becuase of emergency and will not be able to continue work. Do not write in email or paper, that will lead to trail of proof if they decide to go aganist you.

2. After 1 year, they are hiring you becuase of your work, not resume. There is no proper way to verify each and every thing in the resume. When they do background check it is more for any criminal records. Also some companies verfies graduate info. Mine did. Some will even pull Credit history. But as far as resume stuff, they might call your previous supervisor and managers.
Mine was verified by Vendor. But this hsould be no issue from where I see. you can give names of two professionals as a reference.
I dont see this an issue.

3. Don't know. But in worst case scenerio u might just loose the oppourtunity. Since you r no longer allowed to work as an consultant, loosing that is not in your plate. But Employee finding about your previous resume and work experience is very minimal.
Just relaize that they are hiring you becuase they like your work.not resume.

1.) Well let's make a deal :) because it is a loose/loose situation for you. Let's make a win/win situation for you :). Find a project(doesn't matter big or small) and once you get a project then ask your employer that current client wants to hire you. They will say "NO" first . Then tell them that you can give them some money like $1000 and let you join the client otherwise tell them that you have to join another project and other project is already in your hand and you have to switch the employer. Well they can't say No to free $1000 :). This is just my 2 cents and it worked for me. You are a GC holder man try to use it on your behalf. Sky is your limit
2.) I don't think client will conduct background check. You can ask them like "What are the hiring process and paper works? Does that include background/criminal/reference check? In my case, they didn't
3.) To be frank, Most of the client knows that all the things which you put in your resume are not true so they don't care and don't go into details. They just want to hire you because of your work. Think in this way, why do they want to play a game with new guy who they have never worked with rather than hiring a person (you) who they already know and saw you actually doing good job.

Giving you a Heads up!!!!

I won't work with the same client if your Vendor has made you sign the contract saying you won't be working with the same client, it depends on the strength of your vendor & your relationship in the past 1 year with them even though Know that you are a loser on this.

Used to think the same, but trust me, a lady she worked for 3 &1/2 years, & you know how some manager always roam around ladies, she could not get in onto the full time becasue of you know why, her manager could not do sh*t, they hired a new consultant for that job. They were so strict this time, they had the consultant fly from Phoenix to down where the client is to do the f2f after skyping.
It's tough right now man, do consulting for more years build some experience, 1 year does not even count in today's world, try not to go for FT in a year, sometimes it gets complicated too..

 here is what i think!
 I was in your shoes before 4 months..
The vendors always put the clause "if the client takes the consultant within 1 year or so, the client have to pay 20% of your next years income(kind of stuffs)", is your company willing to do that? I dont think so. Mine didnt do that,straight up.

Like someone above said, read the agreement form thoroughly with HR of your company, just making sure you try to pick the loopholes.
Here is one innovative idea, ask them to "fire " you and then after 15-20 days, apply independantly.

As far as the resume fake and background thing, dont worry.....its for criminal records and your education thing which i believe is authentic.......
