"AUGUST VISA BULLETIN SHOWS SHOCKING ADVANCES
Released yesterday, the Department of State Visa Bulletin for the month of August exhibits unexpectedly brisk forward movement in both family and employment-based preferences. On the family side, the Family 2A Preference, for spouses and unmarried children under 21 of permanent residents becomes “current”. This means that the foreign national relative can proceed immediately to adjust status in the US (if certain requirements are met, such as continuous lawful nonimmigrant status, in most cases) or finalize processing of an immigrant visa, if abroad.
On the employment-based side, the EB 2 for India, which we expected to advance only a few weeks in the remainder of the fiscal year after speaking with Charles Oppenheim in April, has leapt forward by almost four years, to August 8, 2008, after remaining stuck at September 1, 2004 since October of last year.
Note that persons in the US whose priority dates will become current cannot file an application for adjustment of status until August 1. We expect that once an application is filed, in order to use all the available visa numbers before the end of the fiscal year, USCIS will aggressively move to schedule applicants for biometrics and adjudicate these cases quickly. Applicants should ensure that their attorney push USCIS to move on their cases before any retrogression might occur.
Keep in mind that despite these advances, Charles Oppenheim conveys the following words of warning regarding future visa availability in the recently-advanced categories:
“These changes for the Family F2A, and India Employment Second preference categories reflect actions which have been taken based on current applicant demand patterns. Readers should expect that some type of “corrective” action will be required at some point during FY-2014 in an effort to maintain number use within the applicable annual limits. Such action would involve the establishment and retrogression of such cutoff dates and could occur at any time.”
