 Do you know how she came here?- I mean as a regular undergrad/grad student or some sort of medical student or on some other things?

Hey BBMB,

Here is what you have to do for the waiver: -  (Based on one of my friend's experience)

You have to apply to Department of State for waiver. Then you will get a form which you have to send to Nepali embassy. Nepali embassy will then send (along with that form) a letter stating that Nepal has no objection if you changed your status. After Dept of State receives the letter, it will recommend USCIS for waiver. After USCIS approves the waiver application you can then apply to USCIS for adjustment of status (For example J1 to H1B).

Unless you are in govt sponsored program (such as Fulbright), you won't get denied. (I think your boss wants you to go for J1 instead of H1, so I don't see a point why your J1 waiver will be denied). But as you know, "Raja ko kaam kahile jala ghaam"; it might take a while for Nepali embassy to process, you should be fine if you plan well ahead for the J1 waiver.

 thanks trunepali and sparty for taking time to write.
I have never been associated with the governmental office or any kind of scholarship back in nepal.
So I believe i will not have problem in getting the no objection letter.
