Hi Sajhaians,
I had applied for extension of stay for my parents who are here in B-2 Visitor Visa. It has been two months and a week and haven't heard anything back. Their current stay expires by end of this January. I am confused about whether to return them by the end of this month before current I-94 expires or wait for the decision.
1. Is stay beyond extension is consider unauthorized stay?
2. The worst case scenario, If extension is denied, is a grace period given to return?
3. Will there be any effect on coming back again at POE? They have 5 years multiple entry visa.
If you have been through this, please share your experience.

Hello Euta Nepali,
Before answering your questions did you check if the filing fee you had submitted by check has been withdrawn from your account by USCIS ? If yes you should received 'Notice of Receipt' by mail. If you filed the extension yourself call them. If you did it through an attorney he/she should call and give you an answer.

Adhikari Bandhu - Yes, received the 'Notice of Receipt'.
Just wondering if anyone has gone through this in recent years and what was their experience?

Calling to USCIS didn't help much other than saying it is under process and there is a back log of 6 months. They even didn't tell if there will be grace period to leave if denial.

If you applied through online ELIS system, then there is a delay of 4 months.
