Hi Immigration gurus,
I need your suggestions on GC filing. I've Bachelor Degree in Computer Science (US degree), 3rd year working in IT, 2nd year on H1B. I'm doing MBA currently and will be graduating in 1 year. Could you please suggest what would be the best option for me.
1) File on EB3 category now.
2) Complete MBA and file on EB2 after 1 year.
3) File EB3 now and port it to EB2 after 1 year.

If I choose the 2nd option would MBA be enough for the EB2 process or work experience required ?
Any kind of suggestions or experience sharing would be appreciable.

Just because you have an MBA does not mean the job qualifies for EB2. Remember, the category is not about your qualification.. It is the requirement of the position. So if the position only requires a bachelors degree, you can't file an EB2 even if you have a phd. And you can't just make the position require a masters degree if similar jobs in your industry and geographical location does not require it. DOL will reject such cases.

You have to assess all these options based on your situation. There is no hard and fast rule on which route to take and it all depends on your job situation and/or your employer.
Let me try to break it down.
1) File under EB3- the dates for EB3 moved radically fast to somewhere around OCT 2012 couple months ago and is not backlogged and is currently at April 11. So if you think there might be a chance that this dates progresses then sure, file under EB3
2) Complete MBA and file under EB2: This depends on what your job requirement asks for. While just having a MBA doesn’t necessarily qualify you for EB2, you might have to work with your employer to make a JD that requires a master’s degree. Keep in mind, if you are working directly with big organization, they usually do not do that. Ideally you will be a Fresh Graduate with 0 yrs of experience and they must prove that you are worth for the job.
3) File EB3 now and port to EB2: This combines both options 1 and 2. This process might involve more money as PERM, i140, lawyer expense is usually NOT refundable. You can try this route but again to port to EB2, your employer must create a JD that requires you to have masters degree.

Think through all these options and depending on your situation and how much flexibility you have, pick one and go with it. I have seen many people in this dilemma and I think it’s pretty common. Some chose one over other so the final decision depends on your situation. Hope that helps.

Thanks for sharing your understanding on this issue. Since I'm through a consultancy, who is easy to work with, I believe there won't be any problem for them to work on the JD if necessary to assist my application on EB2 category. And looking at my situation, I'm in 2nd year in my H1B, I've enough time to complete my Masters and start EB2. I think it'd be better for me to wait and apply after 1 year under EB2 rather than taking changes on EB3 (long wait) or porting EB3 to EB2 (I heard sometimes this might be complicated).
