Ma aahile H1B transfer garne soch ma chu, mero current employer bata main vendor ko ma, client chai tehi nai. Yeso garna khojnu ko main karan bhaneko chai paisa nai ho. Sabai kura thikai cha jasto lagcha, tero feri yeso gahiriera sochda kei complication hune ho ki bhanera ni daar lagcha. Of course, dhatera resume banaera Indian Consultancy ko through kaam gari ra ho, ani aaja vendor ko lawyer le filing ko laagi necessary questions haru pathayo. Vendor lai chai dhatera kaam gareko bhanne kura tha hola na hola. Yeso padhay, aaru ta testai ho main kura samasya bhaneko “Prior work summary” chahine re. Current H1B ko copy pani chahincha bhaneko bhaera yeso Consultancy le pathaeko mero application haereko ta, tya ta jhanai farak information po rahecha. Consultancy kai direct employee bhanera file garidieko rahecha, resume ni dhateko resume bhanda ni arkai pathae jasto cha lol. Consultancy ko through garda ta saab kura uni haru le milaera garidiye, khasai kei wastha bhayena, tara aba yo vendor ko through garda kei samasya aaula ki bhanera maan ma chiso pasyo. Yeso bichar gare, ma yeso garna khojne pahilo Nepali ta pakkai hoina, teslai yha haru kasaile H1B aauta employer bata aarko employer ma transfer garnu bhaeko cha bhane ra yedi nakkali experience rakhera kaam suru garnu bhaeko thiyo bhane kasari situation handle garnu bhayo?
Ani, yedi yo transfer petition approve bhayena bhane chai k huncha? Current employer sanga bhaeko H1 approval ma continue garirakhnu paauchu?

"Consultancy kai direct employee bhanera file garidieko rahecha" I have seen similar case with some of my friends as well.... now the whole thing depends on who is your vendor. Vendor pani desi kai arko consultancy, or desi kai vaye ne ali thulo like TCS Wipro HCL, or some what khaire ko ho like Accenture ..?

@HakuKalay -- If I were you, I wouldn't do it. You are asking for lots of headaches and tensions for few thousands dollars.
Unless it is directly with client and there are no legal difficulties, avoid it. Here are my concerns -

-- Offcourse, you file H1-B for your employee ONLY. There is nothing called direct or indirect employee. Either your are employee or contractor. You are an employee of your consultancy and they are your employer. For others like vendor and client you are just a contractor. Second, resume that will be send to USCIS during H1-B filing is accurate and correct. You cannot send 5/6 years experience resume to them. No body does that. You should know why?
So even if you go to vendor, your resume will be the correct one. Now you don't know how the Vendor is going to react on this when he finds out (provided they don't know all those added stuff in your resume that was submitted to them while getting job from this client). If your vendor is just another consultancy then they might be OK, but then why all these hassles. All these consultancies are same.

Now, usually there is some sort of restrictions that would not allow you to take the job directly from the client and/or move to another vendor within the same project. Look your contract if you have signed one. This is not always true, but many consultancies do this and it is a common practice. The number of days might be 6 months or 1 year, but usually there is one.

In my opinion, you can continue back with old consultancy if your petition is denied with new one as long as they have not withdrawn the h1-B for you. But then your are also risking the relationship with your current consultancy if they happen to find out about it.

Hope this will get you some ideas to make some decisions.

@STUPIDA and @Prem101. Thanks for your responses and I have decided that I will not do the transfer. @Prem101, vendor chai in terms of national origin, he is Indian, but definitely not like desi consultancies. It's a small local company. So, I have decided to share my dirty secret with as less people as possible. My employer has been very nice to me, and although I would get handsome raise after switching, in a bigger scheme of things and all risks considered, I am going to pass on and stick with my employer.

I really appreciate your responses, especially thanks to you StupidA.
