Can I be on H1 and apply for TPS? Denied Asylum I have valid H1B till 2017 and full time job but I haven't gone for stamping because my Asylum case was pending since 2012. Asylum got denied few months back. Can I apply for TPS and visit family back home and do visa stamping at the same time? Any problem later when applying for GC? From lot of conversations, what I found is- we have to maintain any status we currently have even though we get TPS to get back to that status after TPS ends. Please suggest.

@tpsfornepal I don't think you will have any problem applying for TPS, but what are the benefits of that? You can get TPS Advance parole, and you can leave the country, and come back, but I heard while coming back how you gonna return? With you Parole or H1B. That time it might be a problem. Going out and coming in on parole is not 100% safe, and it might have side effects. Don't do any mistake in rush.Talk to a lawyer if you want to leave country on parole. Each person has different case.
