I have been going through different post in Sajha but looks like no one posted like my case but I and some of my friends have same question.
We are using F1-OPT Extension which is valid for another one year. Now, H1B got picked up and approved which will be applicable from October. F1- visa expired but no worries, can travel after October after changing F1 to H1B.
Question:
1)Is there any benefit of filing TPS in this case?
2) If there is any benifit, Can my employer directly apply for GC when I am in TPS?
3) What will be my status if TPS expired (Assuming TPS will be granted after October,in that case I will have H1B before going to H1B )

Employer can file GC during TPS.
TPS ma budi launa paidaina. If u need to bring her, stay in H1b
If you file TPS when u r in h1b and if tps ended you will be back to h1b. So if u r thinking of applying it apply when your h1b started

My f1-visa expired. H1B will start in October so no way to travel Nepal before that. Once H1B starts in October, I can go Nepal get stamp for H1B with wife and come back here with wife in December (Before TPS reg ends) and Apply TPS. What will happen to my wife as she will be coming in December with me? Will she be out of status?
What could be best way in this case?Staying on H1B only or TPS? If I stay in H1B, I cant change my employer easily.

2roomrent969, If you are already married you dont need to go to Nepal to bring your wife. Once you have H1B approval receipt, your wife can apply for H4. Thats what I did. I got married in OPT and my wife applied H4 in Aug when i got my approval.
I read it somewhere that if spouse is eligible to apply TPS, wife who is staying in US is eligible as well..I am not sure on this, you need to find detail regarding this.

Planning to get married ni bro.
Also, TPS requirement is person must be in US on 24th June. But, that is not the case if she comes with me in October/November. So, when I come back with her and apply for TPS in December, what will happen to her status?
