Yo dherai patak sodiyeko hola...tara maile vetina maaf paum.

why do you need to go Nepal to marry? why don't you try marrying girl nepali/kali/gori with citizenship. you don't need TPS, you will get GC straight.

@collegefootballlrocks Ma aile CPT gardai xu...yespali apply gareko H1B approve vayena...so aba 1 time matrai baki xa h1b apply garna...aba aune h1b pani vayena vane arko college padnu parne hunxa and tuition fee haru dunya diwana ko tensn...baru TPS apply garne bichar ma xu...1 or 2 choti ma ta approve hola ne H1B...What do you think?

TPS garera Nepal ma bihe garera aayo bhane it's very likely you will be sent back from POE. TPS will be granted to you based on the fact that it's an unfavorable condition right now to go back to Nepal. POE officer might think that travel to Nepal and marrying implies that unfavorable condition does not apply to you.

@ny2 Good observation... Suppose TPS approve vayo and h1b pani vayo vane maile TPS chadna milxa? and TPS chadera bihe garera liyauna milxa hola ne haina?

ny2 is wrong regarding the travelling concept. You can travel as many time you want using AP without any issues.
@nature_freak, In your case, I go to Nepal in F1, get married and ask spouse to apply in F2. Once she gets visa and when I am back to US, I will apply TPS before December.
Also, from my understanding when you apply TPS while F1, you cannot apply H1 and change your immigration status. You have to directly file GC through your employer or through Asylum if your case is strong enough.

I think you have to maintain continuous physical residence since 24th june 2015. going to nepal before applying TPS might have you ineligible

@damauli_guy,.you have no idea what u r talking abt so it's pointless to respond to you
@naturefreak, You can definitely travel with AP under TPS but the reason should be good enough to be able to return back. Travelling with AP under TPS is not equivalent to traveling with AP with pending greencard application.
If you follow damauli_guy's idea and go back to Nepal in F1, get married and bring your wife in F2 and apply TPS before December, I can tell you right now with 100% confidence, your TPS will be rejected. USCIS needs continuous residency starting Jun 24th, the day it designated Nepal as TPS eligible country. So it doesn't matter whether you came to US on Jun23 or 2 years ago, they don't care about your residency before Jun 24. All they care is starting Jun 24th, if you have travelled to Nepal using your current status, it means it's favorable condition for you to travel and you do not meet the continuous residency.

You can't adjust your status during TPS to immigrant status but if you were already eligible for something else TPS won't hurt it. Damauli_guy is somewhat right.

Also even those who are out of status or do not have valid immigrant status they can travel with TPS +AP to Nepal. Those who have criminal offense may face deportation at POE rest should be fine. Staying more than 60 days might be issue but rest can travel freely as many times as they wish make sure they have multiple entries on AP

@ny2 You are right on the fact that I cannot get TPS if I travel back and forth after Jun 24. Continuous physical presence is necessary for TPS.

@mangale I think that I can apply for H1B as long as I maintain my F1 status while being on TPS.

If you were living in US (before June 24th) and travel to Nepal (for short period), you can still apply TPS. But if you are coming for the first time after June 24th, you are not eligible at all.
AP will let you travel as many times as you want without any issues (I have friends from African countries with TPS, they are doing all the time). Its not recommended to travel if you have asylum application pending or have criminal background.
One of my friend was in Nepal for his marriage during Earthquake and he came after June 24th, when he consult a lawyer, he is still eligible to apply TPS.
