Hi dear friends,

I currently work in a Nepali restaurant in San Luis Obispo. The restaurant was opened just 2 months ago. I have been working there from the grand opening as a cook. The owner is my friend. I am an expert mo:mo wrapper and he really needs me in the kitchen.
I just got approved for TPS. He is willing to sponsor me for green card. Now, can he (as my employer) sponsor me for EB-3 green card? What would be the process? Please help me how I can get a green card.

Chef work does not falls under EB3

I have seen people getting GC after a long time 8 years even for Nepalese and since the restaurant is pretty new that they won't be able to show tax return and income which will be tough one for you to GC.

1. First contact an immigration attorney.

2. Find out if Chef falls under skilled work category to file for Labor Certificate.

3. If Chef does not come under skilled work category, you can ask you friend (who is the owner) to file your labor certificate as the manager of the hotel. A manager should come under skilled work force.

4. Again, you have to consult an immigration attorney on finding out what sort of documents would be needed to support your claim as a manager.

5. Immigration process is very complex issue so I suggest you hire an immigration attorney.
