Sabai lai namaskar.. hamro sajha ko khunkhar IT guru haru bata suggestion cahiyeko awastha

Ma last 2 year dekhi euta indian consultancy ma kam gardai, yo barsa H1B chittha parera approve pani bhayo. Ma kam gardai gareko client le malai fulltime bas bhanera dikka banai sakyo, offer pani dherai ramro cha.

Mero jamma IT experience pug napug 2 barsa tara malai client le offer gareko position chai dhannai 7-8 barsa experienced manche lai thik hune. Suru ma nakkali resume dekhayera proxy lai interview dina lagayera aaiyo aile yeso halka kam chai sikyo. Tara yesari full time jada k huncha hola? Jana huncha ki hudaina? client lai mero resume fake ho bhanne ki nabhanne? Bhane kasari bhanne, nabhane k garne? Ani yeha full time bhayera mero H1 transfer garda USCIS ma paile file garda bujhako resume mismatch bhaye k huncha?
Manager sanga k garera kura garne ma ta sochnai sakeko chaina ..

Ekdamai tension ma pariyo k garne sajha ko dajubhai le sahayog garnu huncha bhanne apekshya cha. Sabailai dhanyabad. Please help.

Ma last 2 year dekhi euta indian consultancy ma kam gardai, yo barsa H1B chittha parera approve pani bhayo. Ma kam gardai gareko client le malai fulltime bas bhanera dikka banai sakyo, offer pani dherai ramro cha.
You need to transfer H1b to current company from Indian Consultancy. Full Time offer gareko company le H1B transfer petition USCIS ma apply garnu parcha, It's exactly like applying H1B and takes atleast 5-6 months and expensive too. Ask your company if they are going to spend all those processing fee and do not deduct from your salary. Once H1B transfer petition is filed and received receipt number, then tell your Indian consultancy that you quit your job from them.

I see two risks here:

1. If your H1B transfer is denied (should not be in most of the cases), then you are immediately out-of-status (given that you do not have TPS/EAD. SO, why do not you file TPS with EAD as backup plan.)

2. If your Indian Consultancy did some kind of contract agreement with this company who is offering you full time job, they might sue you joining this company. Go through the contarct document before jumping into the offer and resolve the issue. Do not tell the consultancy company that you are leaving them and joining this company. Act wisely to avoid legal hazards.

Whatever way you followed to get this job,once you are onboard, thats it. Your are done with the process and worry about the performance and job done on time and with perfection. Rest are tapaseel ka kura hun. As long as you are doing your job, you are safe. Be consistent in your resume. whatever you submitted during job search and interview process, stick to that. Never ever change anything from that baseline, however you can add whatever you have learned within this two years.
So, same resume with updated version of resume should be send to USCIS for H1B Transfer to be on the safer side. Do not complicate yourself and land on the desert danger zone.

So, play the rule of the game safely. You need to be very careful with Pros and Cons of both the side, Full time vs. Consultancy.

The benefits of full time is that you do not have to deal with the Indian Consultancy who takes chunk of your salary. Make sure that full time employee will file the GC for you immediately after you joined that (use GC chip as a deciding factor to join them). However, after joining them, after few weeks/months, if you are fired or lay-off , you are out-of-status immediately under H1B (so get TPS with EAD-my suggestion).

The benefits of Indian consultancy is there is never firing and lay-off, you just sit in the bench and enjoy the fruit. That's why they get the cuts out of your salary and they even might file GC for you if you convince them and they think that you are cash cow for them and get into project earning for them. WIN-WIN situation.

Decision is yours. Good Luck.

Ma sanga TPS cha, EAD chai apply gareko chaina. Ma aba yeha arko 5-6 months kam garera afno real experience nai dekhayera arkai thau ma job apply garne bichar ma puge. Sadhai dhatera kati tanab ma basnu.
Yini haru le H1B transfer pani file gardincha, GC pani gardincha, Aile offer gareko position pays a lot tara paisa bhanda atmasantusti pani herna parcha jasto lagyo.

here are some points and things to consider -
1. go through your contract and see if there is something that stops you from joining client directly. consultancy are good at this and put some clause so that they don't lose their piece of pie. If there are more mouth between client and ur consultancy, its get more complicated. But at the end, it all comes down to $$$$$.
2. Do not tell anything about ur resume to your manager or client if you decided to take full time. You don't know how that going to react.
3. The resume that you submit to USCIS is not fake. So there will be some challenge to avoid that ur client don't see that resume. Act smart, tell them you would love to work with same lawyer that you have worked. Find one and do all your paperwork directly and ask employer to pay.
4. They want you full time not because of ur resume, but because of ur work. So background check will be at its minimal.
5. Done there been there .....PM if you need more insights..

Hi Bro... my suggestion is don't go full-time... I know the situation same some of my friend faces already... according to that experience "don't go" .. 1st point your fake resume..someone saying the background check is minimal, that is not true... contract position background is minimal but if you apply or go for full time then background check is deep, once they know that you got this job by fake resume, you might get more worse situation. That's happen too... also depend on company how they react, that might may take it seriously too make you blacklist... so think twice whatever you want to do. Now you have at-least 2 years exp and you learned the work as well.. better try another company.
I am not saying this all just like that, it is all from someone experiences... Good luck and take care.
