Namaste sajha friends,

this is my first posting in sajha. And greetings to everyone.

Well, I have a question and I wonder if anyone of you can help me with the answer. I am expecting a baby. Both my husband and I are on student visas and going to school. I have heard that if my baby is born in the United States, she can be an American citizen.. is that right? If it is right, what will be the status of us parents? Do we have to leave with our baby after we graduate? Or will we be allowed to stay in the country?

I hope someone has the right answer or at least someone can tell me where I can find the answers to my questions.

According to the 14th Ammendment of the US Constitution, Babies born in USA will have an American Citizenship.

The status of the parents won't be affected, meaning you still will be in student status. When your son/daughter is about 21 years of age, he/she can sponsor you for a Permanent Residence (GC) and subsiquently, a citizenship.

So yes, if your visa expires and you don't get another status, you HAVE to leave the country. Legally, your child is not required to leave as he/she is a citizen.

What will happen to the baby once both of the parents go to Nepal and take the baby with them? The baby will have to keep getting Nepali Visa until he is 21? How would this work?
