One of my fren is coming to US through 10-15 days training. But He wants to stay in US further. He has visa for 4 months. Is there any possibility that he can change his visa status to F1 or stay legally further? Or is it better to return back after training? Or stay illegally here? He has wife and children in Nepal. Wha should I suggest him? DO you guys have any suggestion?

stay for a while and then file for refuge/asylum within a year of his arrival in here. Hopefully that would help ur friend.

i think it is possible if he/she can get admission on any uni or coll. i think he can change hsi status to f1. i know some person he came here on training visa and later got changed into f1. i don't know how he did it..or it can be done now.. but migh tas well give a try.

Thank you usofa, nut and ab_belial. If you have any contact information on those guys, I will highly appreciate for that. Till now 3 options.
1. stay illegal.
2. Convert to F1.
3. File asylum.

I hope for more suggestions from other guys in sajha.

Best idea - get married with an american girl no matter black or white or hispanic. Forget about everybody in Nepal. This solves your dream to be in america.

staying illegal is not a bad option if you don't want to return back home for good. if you want to stay illegal then the best option would be large cities. i have seen so many Nepali staying illegal in New York and other big cities.

file asylum :- this is another good option and California is the best state to file asylum.

This is a perfect example of why visa is getting more more difficult for the GENUINE people. Coming for training and staying illegally!!!Wow wow

No...no...no, Its is too bad idea to stay in USA illegally. Bad for him and bad for every Nepali. Why does he want to live in USA without proper documents...without social security number. It is very risky for him and his family.

Please don't do that. But encourage him to join a college and get student visa which allows him to get the social security number.

Again, do't do that. he will regret and cry some day.

A sincere advice from a Nepali.

I informed him regarding difference before and after 9/11. Eventhough he is mentally prepared to come. So as a good friend what I can do is just show him the way with least danger and pray for him. Thats it. BTW he is not govt. officials.

He should not stay in US without any proper documents. It would be a foolish thing to even think about especially since he has family back whom he'd probably want to invite in the US after he's settled. If he becomes illegal then not only will he go down but also his wife and more important his kids future.
So, he should stay legally and if he can't then just go back to nepal and enjoy his life there instead of living here illegally. Even though a lot of people are here illegally, i bet you that 9 out of10 of them regret it, unless they don't mind having no life but just money.
So don't even plan on staying here without legal documents.:)

Actually it depends upon the person himself. Some of my friends came on training visa and enrolled with university. Some of them married with citizen there and some staying as illigal accumulating money not knowing what is next.Though they need to go home because of problem they could not because if they go to Nepal they can not come back.

regarding change of status to f1 to my friend, i went to international offic in my university. The international office suggested me that they would have no problem to accept the student but student himself should file to change his status after 60 days of his arrival into the US (not before 60 days) and if get approval, university will allow him to enroll into class. The advisor told me that the student should prove his intent to change the status. She also told me that the even if USCIS approve the change of status, visitors who got their status changed over here had hard time to get visa once they went back to thier country. Now two issues are here: whether your friend can prove that his intent to change his status is geniune or not. And whether your friend want to return to nepal and get back to US again. I heard that USCIS has approved the change of status of students who joined for PhD.

My suggestion go back and apply for F1 if he is a geniune student. It only costs his airfare and he also can save the training quota for his colleagues for futuere. We all know that Nepalese people need visa even for transit in HK. However, it is his personal decisions.

great news to those nepali who are without state ID or driver license.
i recently came to know that Texas issues State ID or driver license to those illegal immigrants who has expired VISA but valid passport . if any of you are interested making driver license or state id then you should act soon.

I had asked International student advisor once about the status change and got a feedback to go to Mexico and come back in student visa or any other visa you wish. Also a friend of mine came in tourist visa and got admission to a college and went to Mexico to change to F1. This is the fastest process rather than waiting for USCIS approval.

ANSWER: Hello King,

Its very risky that Mexico consulate MAY know that you are out-of-status, thus they may deny your visa which will prohibit your entry in US either 3 or 10 year bar. Please proceed with caution.
