Proposed Constitution

Preamble

1. Nepal is a federal kingdom, a total, transparent democracy, with the sovereignty resting with the Nepali people.

Article 1: The Legislative Branch

1. There is to be a lower house, the Pratinidhi Sabha, with 180 members, 60 per state, and a upper house, the Rajya Sabha, with 60 members, 20 per state, all of whom are to be directly elected through constituencies demarcated such that the largest has a population not more than 5% of the smallest, geographically in close approximation to a circle or a square, and protected from partisan gerrymandering by an autonomous Election Commission. The constituencies need not respect district boundaries. Three constituencies for the Pratinidhi Sabha will make one for the Rajya Sabha. The entire Sabha is dissolved en masse when its term nears expiration.
2. All matters of national importance are to be decided by the national parliament through a majority vote unless otherwise stated. Parliamentary procedures are to be laid out or revised with a 60% vote margin.
3. The legislatures are to elect their Speakers and Deputy Speakers. The legislatures shall assemble at least once every four months, and as often as necessary.
4. No parliamentarian may be arrested while the parliament might be in session except for felony charges. Their speech in parliament is protected from any and all oversight, legal and otherwise.
5. A simple majority of the parliament will pass the budget. All budget proposals must originate in the Pratinidhi Sabha.
6. All bills must be posted online in three languages - Nepali, Hindi and English - for at least one week before they may be voted upon.
7. All regional and international treaties that Nepal might enter into will have to pass a 60% majority in the parliament.
8. Political parties may not engage in fund-raising activities. Instead each national party, described as those that garnered at least 5% of the votes in the previous nationwide elections, will get an annual sum that will be directly proportional to the number of votes it earned. That money is to be used for party-building and electioneering activities. Details of expenses are to be posted online in the three languages to the last paisa on at least an annual basis.
9. The Election Commission holds secret ballot elections for party leadership for each national party. Tickets for all elections are distributed by parties through democratic methods involving members at or below the said level in the organization.
10. The Election Commission puts in place ceilings as to election expenditures. Independent candidates may not raise money, but may spend their own money that may not exceed the amount of the party candidate spending the most money. Once elected independent candidates may not join a national party for at least one year.
11. Every person on the state's payroll - elected officials, bureaucrats, justices, police, army personnel - is to submit a Family Property Statement, to be posted online and archived and updated annually. Upon exiting the public sector, they may discontinue the practice, but the archives will remain, and the updates will resume should the individuals re-enter public service.
12. Details of all expenses incurred by the state, to the last paisa, are to be posted online in the three languages. All contracts offered by the state to the private sector are to be bid for in a similar transparent manner from beginning to the end. All job applications and promotions in the public sector are to be similarly handled in a transparent manner.
13. All formal political deliberations at all levels of government are to be posted online in as real time as possible in the language that was used at the venue. Efforts are to be made to make the same available in Nepali, Hindi and English. All votes are to be similarly made public.
14. Every elected official at all levels of government is to get a decent monthly salary.
15. Anyone above the age of 16 is a legible voter. Members of the Pratinidhi Sabha will have to be at least 23 years of age, and that of the Rajya Sabha at least 25 years of age. The terms of members of the two bodies shall last four and six years respectively. All elected officials are to have been citizens.
16. Acts of impeachment require a vote of 65%. This constitution can be amended by the same vote margin.
17. The parliamentarians may not increase their salaries in a way that might affect the members of the existing class. The same applies to the salaries of members of the cabinet.

Article 2: The Executive Branch

1. The legislative party leader of the majority party in the Pratinidhi Sabha becomes Prime Minister. The Prime Minister may elect members to the Cabinet that might or might not be members of the parliament.
2. When a majority might be lacking, the largest pre-poll alliance, or the largest single party, whichever might be larger, gets invited to form the government, and is given 30 days to prove majority.
3. The Prime Minister makes nominations to the Supreme Court and other constitutional bodies like the Election Commission (EC) and the Commission to Control Corruption (CCC) to be confirmed by a 60% vote in the parliament. The commissioners serve 6-year terms.
4. The army, to be called the Nepal Army, is not to be larger than 0.1% of the national population and is to be downsized accordingly within 5 years of this constitution getting promulgated. The Prime Minister is the Commander-In-Chief of the army.
5. The central bank is to be autonomous, and the governor, to serve a six-year term, is to be appointed by the Prime Minister.
6. All appointments made by the Prime Minster, except for his or her personal staff, will need a majority vote in the parliament for confirmation.

Article 3: The Judiciary Branch

1. The judiciary will reflect the composition of the government, from village/town to district, to state to the national level. Towns and cities with more than 30,000 people will be served with more than one court, the number to be decided through a formula by the state government. There will be a layer between the district and the state levels, the Appeals Court, 10 per state. The system is to be peopled like the civil service, on merit.
2. The Prime Minister makes nominations to the national Supreme Court. The Chief Minister makes nominations to the State Supreme Court. Both are subject to their respective parliaments for 60% of the vote. Justices to the Supreme Court are to serve to the age of 75 or upto their voluntary retirement.
3. The state and national Supreme Courts interpret the constitutionality of laws passed by the parliaments when thus challenged, but such interpretations may be overturned by the parliaments through a 65% vote.
4. The parliament, federal or state, may not diminish the salary of a sitting judge.

Article 4: The States

1. The current "zones" and "development regions" are to be abolished, but the "districts" are to be retained. The country is to be divided into three states, roughly of equal population, Eastern, Central, and Western, to be called Purbanchal, Madhyamanchal, and Paschimanchal, that are to include all three geographical regions, Terai, Pahad and Himal. Each state is to have a Pratinidhi Sabha, 120 members, and a Rajya Sabha, 40 members.
2. The districts will have their own governments, forming a third layer, named Zillapalika. It is for each state to design the formation and functioning of its component district and town/city governments. The village units are to be called Grampalika, the town units are to be called Nagarpalika, and the city units Mahanagarpalika, and will form the fourth layer of government. District, town/city and village elected officials are to be at least 21 years of age.
3. The federal government will directly transfer 10% of its annual budget to the 25 poorest districts measured by per capita income. This does not prevent further federal expenditures on those districts.
4. The income tax structure is to be as follows: 50% federal, 30% state, 10% district, and 10% village/town/city. The income tax is to be collected by the federal government, and funds transferred by the same to the other levels of government as per this formula.
5. The education system shall follow a tri-lingual policy up to Class 10, beyond which it is for each individual institution to decide on their own as to the language of instruction. The first language is to be the student's first language, the second language is to be Nepali. For those for whom Nepali might be their first language, the student may choose any language spoken in Nepal. The third language is to be English, the contemporary language of science and commerce. This policy applies to schools in both the private and the public sectors. The language of instruction for all other subjects to Class 10 will be a decision to be made by the individual school boards for the public schools and by the owners of the private schools.

Article 5: The Monarchy

1. The monarch is the guardian of the constitution and the one who formally invites formations of governments from the parliaments and formally inducts governments.
2. The first born, son or daughter, is heir to the throne.
3. The monarch's immediate family - defined as parent(s), wife, siblings and their children, children, and grandchildren, and others in direct lineage, and above the law - is to get annual allowances from the state at the 1991 levels. The amount may not be reduced by the parliament. The monarch may request the parliament increases to the allowance through the Prime Minister at any time. Such allowances are not to be taxed, although businesses owned by members of the said family will be subject to taxation and the law.
4. The monarch may decide to retire at an age of his or her choosing, or not.
5. It is a state goal to open up enough holdings of the royal family with consent from the monarch to tourists so as to offset the state expenditure on the monarchy through revenue from tourism. Rituals may also be designed and included.
6. The monarch will appoint a Prince/Princess for each state, to be called Prince/Princess of Purbanchal/Madhyamanchal/Paschimanchal from among the members of the royal family. The monarch may also choose to appoint members that might have married into the family. Such appointments may be rescinded by the monarch at any time. The title comes with extra allowances from the state and a state-funded residence in the state capital. The spouse of the appointed royal family member gets the accompanying title.
7. Members of the royal family may marry individuals of their choice, not necessarily from certain families, or from within the country.
8. The monarch will give the annual State Of The Kingdom address, the speech to be crafted by the Prime Minister summarizing the achievements in the public and the private sectors over the past year and outlining a vision for the future years.
9. The monarchy may be abolished with a 75% vote in the national parliament.

Article 6: The Individual

1. The individual is the most important component of the state and is to be protected and celebrated.
2. Every person has a birth right to freedom of speech, freedom of peaceful assembly, freedom of religion, a right to a speedy, public trial, and a right to privacy, a protection from unreasonable searches and seizures. No person may be tried and punished for the same crime twice. No person will be compelled to testify against themselves. No person will be deprived of life, liberty or propety without due process of law. Private property may not be taken for public use without due compensation. Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted. The privilege of the Writ of Habeas Corpus shall not be suspended. No ex post facto law shall be passed. No warrants are to be issued, except upon probable cause, and should specifically describe the place to be searched, and the persons or things to be seized. A person charged with a crime is to have compulsory process for obtaining witnesses in his or her favor, and is to have the Assistance of Counsel for his or her defence.
3. Every person born in Nepal is a citizen of Nepal. But this does not prevent people not born in Nepal from seeking Nepali citizenship.
4. Every person is equal under the law. Any law that might conflict with that fundamental premise will become null and void as soon as this constitution takes effect.
5. No person shall be taxed more than 40% of their income by all levels of government put together. Those in the bottom 40% income brackets are not to pay any direct taxes.
6. No business may be taxed more than 30% of its income, and businesses in the bottom 30% income brackets will not pay any taxes. All business expenses are tax write-offs.
7. The sales tax may not exceed 10%.
8. Elections at all levels are to be organized on Saturdays.
9. No citizen of age may be barred from voting for whatever reason.
10. It is a stated goal of the state to make possible lifelong education for every person in the country through creative partnerships between the private and public sectors. The state shall also attempt to provide universal access to secondary education and primary health care, free of cost.
11. The state shall attempt to provide universal access to micro-credit to all in the bottom 40% income brackets.
12. All persons that might enter into agreements, either in the private or the public sector, to access credit will have the option to declare bankruptcy as a last resort. Money owed by an individual, as opposed to by a business or a corporation, may not be passed on to the next generation. Indentured servitude is an illegal form of collecting money owed by an individual or family. Money owed may not be paid for through manual labor. Any person, group or organization, lending money on interest, the total of which is larger than Rs 20,000, to be indexed to inflation, is to register as a small business owner, and will be subject to taxation and regulation.
13. All educational institutions, public and private, must have at least 10% of its students on need-based full scholarships. Institutions may also opt to have 5% on such full scholarships, and 10% on need-based half scholarships, or 5% on full, 6% on half, and 6% on one-third scholarships. But at no time should the proportion of full scholarships dip below 5%.
14. Employees of the state in the education and health sectors will be paid salaries that are at least 10% larger than to those with similar qualifications serving in other fields.
15. An accurate, scientific census is to be conducted every 10 years, and scientific projections are to be made for the intervening years.

Article 7: Capitals

1. Within 10 years of this constitution getting promulgated, the national capital is to be shifted from Kathmandu to the Chitwan valley which will also serve as the capital for Madhyamanchal. Udaypur valley will serve as the capital for Purbanchal, and the Surkhet valley will serve as the capital for Paschimanchal.

I don't agree with this. Words are called proposals and if you want a degree of any sort (unless its a degree in proposal writing), you have to do the actual WORK to get that degree.

It's a sad state isn't it now. May be he should get some work done too. May be that's the reason he confuses Africa to be a nation and not a continent.

By your own declaration you are not our madhesi dajubhai. You are chhimeki dhoti (just for fun, please don't mind). We don't allow dhotis any role to write our constitution as much as we don't seek any role in redefining Indian constitution. Allright mate.

In fact Constitution of India is far more inclusive (of very different stripes and colors of its society) and foresighted than of Constitution of Nepal(1990).

The Indians had far more complex social problems to take care of than those of Nepal yet their Constitution has largely worked despite the enormous difficulties probably I guess there arent monarchs who would override their own Constitution with an aid of military.

I think Paramendra always mentioned what he is, and he is consistent
in his claims. Its not one Paramendra who has either father borned in
India, and mother borned in Nepal or vice versa, there are 100s of
thousand if not millions of Nepalis like him. Japanese call such people 50/50
i.e. half Japanese whose one of the parents is a non Japanese.
These half Nepali, half Indian or from other country, should be treated
as equally as a Nepali with both parents born in Nepal. (This is my
feeling). I am sure these people are loyal to both countries, and
they me be in confusion when there is a critical situation, especially,
a war. I had several classmates who are from Tarai and they used
to tell their story of being 50/50 and its natural to think like that.
We have to face it, primarily because our borders are open, we
don't need passport or visa to cross the border or get married to
a person across the border. Secondly, the national border between
India and Nepal is like a border between India and Pakistan around
Punjab-Jammu-Kashmir. Recently in TV here in USA, it was shown
the suffering of the people who were relatives and just divided by
the national border. I had also seen similar situation, in Vietnam
and China. I had a student in Japan, whose relatives are in Korea
but he is citizen of China. He wanted to be Korean because
many relatives live in Korea, but he is still a loyal Chinese as
he claims. He once answered to my question: what side will he take if
China and Korea fight? His answer was, "I wish we never have
a war". So, in my personal opinion Paramendra can be loyal
to both countries in normal time. Current constitution of Nepal
I guess does not allow dual citizenship, so if he holds Nepali
citizenship and a critical national crisis arises, I am sure that
Paramendra will (as a citizen of Nepal) be on Nepal's side.
But, I am sure that such crisis will never arise and therefore,
Paramendra and others like him will never have to fight against
one of their parent's country. ................ Now, I am sure
that no one human will like his parent's country be criticized
without a valid reason. After watching the Iraq war fiasco
in USA, I have started to feel that whether people should
defend their country even if its going in wrong direction
when it comes to your country vs other's country?

Only one thing, I don't understand why don't Paramendra
ji include Bhojpuri or Maithili bhasa in his proposal, but why
Hindi? Hindi, I guess is not the main language around
Nepal-India border. In Western Nepal, Tharu bhasa
is the dominant language around Nepal-India border.
I wonder whether he is trying to make Indian Political
Leaders listen to him by adding "Hindi" language in
his proposal. Let me hear his reasoning.

I was born in India. My mother is from India. My father is from Nepal. I grew up in Nepal. I have Nepali citizenship.

But that is not the point.

The point is you expect me to prove my citizenship. Whereas you don't yourself expect to do the same. For all I care, you could be from Bhutan. Prove otherwise.

If you have read the constitution, I think it might occur to you that it could me translated into realities also outside of Nepal. Perhaps India. I think the document has potentially universal appeal.

Hindi. It is the link language in the Terai. I just got off the phone with Rajendra Mahto after a long 90 minute talk. We talked in Hindi. When I talk to Hridayesh Tripathy, we talk in Hindi. Tripathy's first language is Bhojpuri, mine is Maithili. Our link language is Hindi.

But its better for you to avoid ambiguous comments regarding your loyalty to the homeland , either it be Nepal or India.

I am not a pahadi chauvinist or a freaking pakhey as you accuse. I have equal love and respect to all Nepalese- Ilam ko Limbu to Solu Ko Sherpa to Bhaktapur ko Newar to Lamjung ko Gurung to Pyuthan ko Bahun to Kanchanpur ko Tharu. I treat equally to every Nepalese be it Madhise, Pahade or Bhote and for your information, I have lived with the Terai tharu community for years and I am accustomed to their language, culture, food and everything. They are equal to me in every respect and perhaps deserve more from the nation for their hardwork.

While a madhesi is as much a Nepali as I am, I still regard an Indian just as a southern neighbour. I don't like them trying to decide the fate of our nation. I accept mistakes were made by our leaders while dealing with the Indian government in the past, but India and Indians have never treated fairly and squarely to their northern neighbours. Hence, I don't like an Indian being smart on Nepalese issues. But If you are a Nepali citizen, you have every rights to discuss on any issues relating Nepal.

There is nothing to think about. I will take Nepal over any other country anyday and twice on Sunday. May bet that's the major difference people like you and me. We don't make consitution, we abide by what she has to offer. We don't wish Nepal was someone else, we try to make her the best she can be. You can question the credibility of the messenger, and he has created ample room for others to do so, but you have to agree that he is on message and his message is strong and relevant to our times . We are in the middle of a bloody insurgency, there is talk about a constituent assembly, there is increased awareness of ethnic issues, the future of the Monarchy is being debated by more than just Sajhaites - bottomline : there is a lot on the table and a lot is at stake . These kind of moments come only seldom in a nation's history and we sure are living in interesting times.

My own views on this subject have been expressed in many of my postings in Sajha - in some cases directly and in some cases as a part of a point I may have tried to make on a social or political subject. In brief, I believe most people in politics in Nepal are in it with a desire to do good for the country. Gyanendra and Girija, I believe, do what they do because they are both convinced they are doing the right thing for the country. The problem is they both have made bad decisions and don't want to be held accountable for those decisions. And unfortunately, the purest of intentions may not be of much political importance if those making decisions and setting policies do so with the belief that they cannot, should not or will not be held accountable by the public for the consequences of their actions.

It is precisely because of this that we need a constituion that holds leaders accountable and creates an environment of accountability from top to bottom. Such a constitution will, I am sure, include many of the checks and balances metioned by Paramendra and perhaps more.

On the question of ethnic aspirations translating into constitutional provisions, I am willing to live by the decisions of a constituent assembly (assuming free and fair elections to such an assembly etc etc). Our administrative units may have lost their relevance in recent years and a shakeup might not be a bad idea. Anything that can drive accoutability in all directions, whether these be states as Paramendra would like it , or zones or counties or whatever - I am willing to experiment with ideas on how to drive more power and accountability downwards to local goverment.

That's all there is to say from 30,000 feet. Thank you for flying Air Sajha. Hope you had a pleasant flight and we look forward to your business again. When we hit the ground things may not be so smooth. I have a hunch the next constitution is going to be pretty much 1990 plus some checks and balances on the powers and duties of the King and Army. And perhaps some more controls on the life of a government/parliament. One or two big steps but mostly baby steps is my prediction.

In the new constitution:

1. The monarch should have neither any role nor any authority in military affairs and not even a ceremonial role (in military) if the system of monarchy should continue to exist.

2. The system of monarchy should be discontinued should the monarch directly or indirectly attempt to influence the national politics by any means(military or non-military)

3. Taxpayers will pay very little portion (not more than 10%) of expenses for royal family and will be for strictly for official business should the monarchy continue in the future. (Why should taxpayers pay all your expenses when you have such a little role.)

4. Military will undergo major overhaul and military will serve and remain loyal to taxpayers not the monarch (after all militray expenses are paid by taxpayers not the monarch) and any member of military who defy loyalty and service towards taxpayers will be removed from military service and will be deemed unqualified for serving in any position in govt. in future.

Newuser i would like to suggest you one thing as a Nepali, please change your mentality. "30%nepalese who are living abroad or neighbour countries have some sort of relation with nepal and nepali. you can't simply tell to one Sikimme Nepali who is teaching nepali from last 20 years on Sikkim to stop to teach Nepali on Sikim coz Nepali is not their country language. Can you? They can't hold Nepali passport like you to travel but they can speak nepali better than you, they love and respect nepal more than you, they love nepali festivals than their own country festivals. Is their mistake is it, newuser? what type of message do you wanna give them on this thred that they don't have right talk about Nepal and . if it is true than you are fail my friend to understand nepali and their culture. Ask Any nepali on Burma, how much they love Nepal? Ask any one whose orgin were nepali in Fiji, how much they desperate to see peace in nepal.Ask any one is Thailand who like to introduce themself with you talking on nepali about nepal.Ask anyone sikimme how they celebrate Nepali new year on Sikkim? Ask what did they cook on Tihar?

Tulasi Ghimire is from India , can you ask him to stop to make movie in nepal? ofcourse not. He is born in india but he doing everything for nepal and Nepali more than these Royal families and their Hanumans are doing towards nepal and nepali.

Paramendra was drwaing picture for Constitutionof nepal. That is just open picture , if you wanna change it, you can change it on your way but there is not any mistake to draw a picture.

I think we have mistreated Paramendra. Paramendra cares a lot about Nepal, but because he had been treated badly at school probably, he now makes it a point not to bow in front of those who want to continue to treat him like that.

I read his views, very good. I respect his views and love for Nepal and India. Because India is our big neighbour and a friend who often puts its uncomfy nose into our affairs, I think our constitution does need to take India into account, directly or indirectly (it's embarassing to us all we have to run to Delhi every time a big decision has to be made).
Our constitution should be written and supervised by those who are loyal to Nepal and consider Nepal as thier only subject, though. Period. Foreign advisors and well-wishers of Nepal may be allowed to play a part in the drafting, though, with veto power residing in Nepalese to amend the draft if necessary. If nobody is sure, a referendum to choose leaders who will write it might be a good idea. This way our madhesi and other compatriots will not be left out.

While we need to safeguard our interests vis-a-vis India, it does not mean we should not collaborate with India in many many development projects beneficial to both of the countries. There is a good opportunity in the horizon for the unified economic zone involving India, Pakistan, Bangladesh, Nepal, Sri LAnka etc.

Today's problem in the world is TERRORISM.
Today's terrorism is not that much on whether someone
is more patrioitic or not, but devil is wrong extreme ideologies
vs liberal societies.

Terrorism will remain the center of problems in the world in
this 21st century. Double standards played by rich countries
are the main reason for the rise in terrorism. American govt.
slowly accepts KG's rule in Nepal, American govt. has shown
indifference to Mushraff's dictatorship in Pakistan, in Saudi
Arabia, Egypt, ...... So, America's democracy in Iraq is
simply a dhwang, it happened just because Saddam was not
US panel like Mushraff is in. Such double standard will
lead terrorism to extreme ends and we will be sandwitched
between these two warriers.

Rich Countries' govt are run by ex-CEO's of war head
producers, e.g. Rumsfeld. So, they directly or indirectly
expect terrorism in larger or smaller scale so that they
can keep on holding the power by confusing the public
and swaying the public attention awa from domestic issues.

In 21st century, language will not play a central role, but
the extreme ideas ........... the competitiion is there between
the peoples who can confuse people by pouring venom on
across the societies. Probably, the best way to postpone
extreme situations is to not engage in such extreme ideas
or its by-products.

You have misunderstood me. I am not saying that non-Nepalese can't express their opinions about Nepal. Surely, they can.
But CONSTITUTION is something very different. It is the skeleton of political and judiciary structure of a country. As long as Nepal remains a sovereign state, its up to the Nepalese to think what to include and exclude in their constitution.
If you read all the postings from the beginning in this thread, you will see Paramendra declaring India as his motherland. My point is, Indian citizens don't have to bother about Nepal's constitution. Kura tetti ho. Bujheko bhae ramro, bajhne kaam nagarau.
