marriage Marriage is traditionally conceived to be a legally recognized relationship, between an adult male and female, that carries certain rights and obligations. However, in contemporary societies, marriage is sometimes interpreted more liberally and the phrase ?living as married? indicates that for many purposes it makes no sense to exclude cohabitation. It should be noted, however, that even this more liberal definition usually excludes homosexual couples. Although cohabitation is increasingly accepted, and is now the normal prelude to marriage, people continue to make a distinction between living together and a ?proper? wedding and marriage.

Much recent sociological research, both in Britain and America, has been concerned with the growing fears that marriage as an institution is in decline. These fears stem from two roots, the first being concern for increasing marital breakdown and subsequent divorce, and the second the fact that marriage is going out of fashion, with more people cohabiting and even rearing children outside matrimony. Certainly, divorce is on the increase, and if current divorce-rates in Britain continue then one in three marriages is likely to end in divorce. In recent years, the median age at first marriage has increased and teenage marriages have declined significantly, with a growing proportion, albeit still a small minority, never getting married. At the same time, rates of cohabitation are increasing, with it now being virtually the norm to cohabit before marrying. Moreover, an increasing number of children are conceived and born outside marriage. Looking at these statistics, one might reasonably conclude that the future of marriage looks bleak, but marriage still remains the preferred way of life for the vast majority of the adult population. Even among those whose first marriage fails, a majority are sufficiently optimistic to marry a second time.

Why do people marry? In Western societies, the emotional aspects of marriage are stressed, and what Lawrence Stone calls affective individualism prevails (see The Family, Sex and Marriage in England, 1500?1800, 1977). Choice of a mate is influenced primarily by the desire for a relationship offering affection and love?although, as Peter Berger observes, the ?lightning shaft of Cupid seems to be guided rather strongly within very definite channels of class, income, education, racial and religious background? (see Invitation to Sociology, 1963). The tendency for people of similar backgrounds to marry (marital homogamy) is strong, but there is no clear understanding of why it occurs, or whether the degree of rigidity in mate selection differs among different social groups. Surprisingly, some recent American research suggests that the higher the class position, the less the homogamy (M. Whyte, Dating, Mating, and Marriage, 1990). The same study also indicates that homogamy is a poor predictor of marital success.

Concern with marital success and marital adjustment has played an increasingly prominent part in recent research. As David Morgan (The Family, 1985) suggests, marriage has become ?medicalized?, with therapists and marriage-guidance counsellors at the ready to tackle marital problems and enhance marital quality. This raises the question of how marital success should be measured. Clearly, stability is not a sufficient indicator, as some couples stay together even though they are totally miserable, whereas others divorce, despite having a relationship that some would envy. A variety of marital quality inventories have been developed and recently it has been recognized that marital quality and marital problems are in fact independent. For example, conflict and arguments may be signs of caring and engagement in some marriages.

Marriages clearly face different problems at different times of the life-cycle, and raising a family, especially for parents of younger children, is associated with high marital strain. Remarriages appear to be at greater risk of breaking up than first marriages, especially when step-children are involved. This may be in part because remarriage is an incomplete institution, in the sense that societal expectations and norms still reflect the traditional expectation that marriages will last a lifetime. As Anthony Giddens has pointed out, terms like ?broken marriages? and ?broken homes? embody the traditional ideal and have unfortunate negative connotations, especially regarding children whose parents are separated or divorced.

Increasingly, research is focusing on the interrelationship of employment and family life, including marriage. The primary focus has been on how women's employment has affected the marital relationship. Using longitudinal surveys, American researchers have found that women who contribute a higher share of the household income are more likely to divorce than women who contribute a lower share, or housewives. It may be that wives who become less dependent upon their husbands financially are no longer willing to tolerate a subservient position?and have the resources that enable them to leave. Another important question is whether the employment of women has led to greater egalitarianism within marriage. Some family researchers have painted a rosy picture of how families are becoming more symmetrical, whereas others continue to exercise scepticism, asserting that the traditional division of labour within the home persists, even when women also hold full-time employment.

Jessie Bernard (The Future of Marriage, 1972) has claimed that there is not one marriage but two?the wife's marriage and that of the husband. Studies have consistently shown that marriage tends to be more beneficial for men than for women, with married men being in better psychological health, and showing fewer symptoms of stress than married women. Some feminists who see marriage as an oppressive institution have urged women not to marry. The inequalities of marriage, however, are reflections of the inequalities of the sexes in society. As Chris Harris states, ?it is to be expected that however great the formal equality between the spouses, wives? sense of inequality in marriage will persist as long as they cannot, for whatever reason, participate on equal terms with men in the labour-market' (Family and Industrial Society, 1983). Bernard goes further, suggesting that the metamorphosis of housewife to bread-winner sends tremors through every relationship. Dual-earning marriages are sowing the seeds of change. However, despite the dire statistics, marriage seems to be a rather resilient institution; perhaps, very gradually, the benefits for both husband and wife will become more balanced. Marriage is a legally sanctioned union usually between one man and one woman. At the beginning of the 21st century, marriage between people of the same sex was legally recognized in two countries, The Netherlands (2001) and Belgium (2003), and some Canadian provinces. Civil unions or domestic partnerships between persons of the same sex, which entailed many of the rights and obligations assumed by married couples, were recognized in numerous other jurisdictions, including several European countries and some U.S. states. Other U.S. jurisdictions, while not recognizing civil unions or domestic partnerships, granted a range of legal rights to same-sex couples.

Because marriage is viewed as a contractual agreement subject to legal processes, a newly married couple undergoes a radical change in their legal status. This change involves their assumption of certain rights and obligations to each other. In many societies, these obligations include living together in the same or nearby dwellings, the provision of domestic services such as child rearing, cooking, and housekeeping, and the provision of food, shelter, clothing, and other means of support. The rights of marriage include the shared ownership and inheritance of each other's property to varying degrees and, in monogamous marriages, the exclusive right to sexual intercourse with each other (see monogamy).

These generalizations notwithstanding, every past or present society has had its own concept of marriage, and many have created marriage laws that reflect their particular cultural standards and expectations concerning the institution. Ancient Roman law recognized three forms of marriage. Confarreatio was marked by a highly solemnized ceremony involving numerous witnesses and animal sacrifice. It was usually reserved for patrician families. Coemptio, used by many plebeians, was effectively marriage by purchase, while usus, the most informal variety, was marriage simply by mutual consent and evidence of extended cohabitation. Roman law generally placed the woman under the control of her husband and on the same footing as children. Under Roman law no slave could contract marriage with either another slave or a free person, but the union of male and female slaves was recognized for various purposes.

The canon law of the Roman Catholic church was the only law governing matrimonial relations between Christians in western Europe until the Reformation and still has considerable authority in some Roman Catholic countries. The church historically regarded marriage as a lifelong and sacred union that could be dissolved only by the death of one of the spouses. This exalted view of marriage envisaged the husband and wife as made of ?one flesh? by the act of God, and marriage was thus transformed from a terminable civil contract under Roman law to a sacrament and a mystic union of souls and bodies never to be divided. In canon law the free and mutual consent of the parties was regarded as essential to marriage. Marriage was regarded as completed between baptized persons by consent and then consummation. Canon law held a marriage to be null and void in cases in which the parties were within prohibited degrees of close blood relationship (consanguinity and affinity).

Marriage law as it developed in England specified the requisites of marriage as being the following: each party shall have attained a certain age; each shall be sexually competent and mentally capable; each shall be free to marry; each shall give his or her consent to marry; the parties shall be outside the prohibited degrees of blood relationship to each other (consanguinity and affinity); and the marriage ceremony shall conform with the statutory formalities.

The marriage law of most western European nations and that of the United States (which is itself based on English marriage law) is the product of canon law that has been greatly modified by the changed cultural and social conditions of modern industrialized and urbanized life. Modern marriage law regards marriage as a civil transaction and allows only monogamous unions. In general, the legal capacity of a person to marry is the same in most of the Western world and is subject only to impediments such as consanguinity and affinity, age limitations (which have been revised upward in most countries from a minimum of 12 years old or younger to between 15 and 21 years old), and restraints due to mental incapacity. In the United States the federal Defense of Marriage Act (1996) defines marriage as a legal union between one man and one woman only and allows states to refuse to recognize same-sex marriages performed in other states. In response to court rulings in some states favouring the legalization of same-sex marriage, more than 30 states have passed laws similar to the Defense of Marriage Act or have amended their constitutions to the same effect.

Divorce is almost universally allowed, with restrictions on divorce undergoing gradual relaxation in Catholic countries. In Russia only registered civil marriage is recognized. Monogamy is strictly enforced there, and marriage must be completely voluntary between the parties, who must be over 18 years of age. Caste and social standing continue to influence the incidence of divorce in areas of South Asia.

In Muslim countries of the Middle East, Asia, and North Africa, the prevailing Islamic law regards marriage as a contract between the two spouses for the ?legalization of intercourse and the procreation of children,? though it is always seen nonetheless as a gift from God or a kind of service to God. The terms of the marriage depend on the will of the consenting parties, and it may be constituted without any ceremonial. The essential requirement of marriage is offer and acceptance, expressed at one meeting. Islamic law has historically permitted the practice of polygamy, but its practice was always limited and was waning in virtually all Muslim countries by the late 20th century.

Polygamous marriages are still permitted under customary laws in many African nations, but there is a growing tendency toward monogamy. Many developing nations in Africa and elsewhere are markedly different from Western nations in that there is no uniform marriage law. The regulation of marital relations is based either on religion or on the customary laws of the territory. This leads to a diversity of laws within one territorial unit and often gives rise to complex problems in the case of tribal, ethnic, or religious intermarriage.

In Japan polygamous marriage is prohibited, and age limits of 18 years for men and 16 years for women are specified before marriage can take place. Consanguinity to a close degree is prohibited, and all marriages must be registered in accordance with law. Polygamy is also forbidden in China. Formality in the marriage celebration has been abandoned, but the civil marriage must be duly registered to be valid.

Anyway SobeNO... (sweetheart?:|).... I see that you are good at debating I like the points that you stated. Quite strong and convincing.. though I am not convinced. Well.. the thing is as my dear danny da... who is hiding under the name of anonymous..(oops was I not supposed to disclose that? :P) it doesnt really harm the other people in the same society. Do you think that gays do not know that they are gays and cant reproduce and one day the human race will come to an end if all people become gays? Of course they do so I do not really think that the possible solution would be to make them sit in a room and lecture them like crazy. Robbers and )whatever your other example was) are NOT the same as gays. Robbers do stuff that hurt others... and well gays are like us only with a different idea of sexuality.

And as you stated.. I agree that gay world doesnt exist and if it did we would all never be born. Similarly... gay society DOES exist.. there are several oraganizations that do support gay marriage and all that. Also, i am not really against sex change.. I was just saying that if tht is not against the law then gay marriage shouldnt be either! just a thought! we all have our own ideas and should have the freedom to express them. We all have our own sexuality and should be able to live in peace with the society rather than with the looks of prejudice and venomous whispers!

My dear friend Anonymous, you made some very good points to support homosexuality. You even gave a very fine example of some lizards, and their evolution into unisexual organism who indulge in homosexual intercourse for reproduction. But my friend, according to what you told, I do not agree that the type of intercourse those lizards have are homosexual ones, and it totally does not support the homosexual nature in human beings. You said, for reproduction sperm has to be generated within one of the pairing individuals even though it has to be aroused by another same sexed partner. But I ask you my friend, sperm a male reproductive tissue, has to be generated within that female individual. Besides they evolved into such organisms, (despite the fact I have tremendous difficulties in believing this story, but we will stick to with what you have to say), nature chose them to be like that, and it seems like nature is still not in the mood to lay off the very fundamental principle of having opposite sexual systems co-function at the time of reproduction whether be it instantaneous like in the case of your lizards or for long run like in the cases of any other animals. But the main point I want to draw your attention to is that human homosexuality is not even remotely close to what you have to say. Tell me, during human homosexual intercourse of gay men, does one of them produce ova (female reproductive tissue) so that it can fertilize, or in the case of gay women is one of the partner able to produce sperms, and in either of these cases is one individual solely capable of possessing both the tissues for fertilization and hence reproduction? Hell NO! Has evolution constricted human species to evolve into unisexual organisms like you claim might be the case in future? Of course not! Given the fact that every new born human is born either strictly male or strictly female, I see no signs that humans in the future will evolve into unisexual organisms like you speculate. Having read your article, I come to the conclusion that you have a total misconception about human homosexuality which is ? I state again- very unnatural.

Come on people, battle of the sexes, inequality of rights, one of the genders getting less privileges, they, are all more of a social issue than natural, and it should be addressed in a more social way - Not turning towards some thing unnatural like encouraging homosexuality as its answer. That?s insane. When I gave the examples about robbers and frauds, I knew at the back of my head that everybody will fail to see the bigger picture it portrays and will jump with short sightedness. Of course robbers and frauds give physical harm and effects are relevant at that very instant, similarly homosexuality will physically harm our social well being and natural balance whose effects will be far more painful on the long run. I admire Ananymous? thought about things that we are let to believe, the things that are there from the past are the only things that we think are right, we are unsusceptible to change and that we need to have an open mind. To some extent I share that thought with you but not in this case. My friend, look around you, there are men and there are women - each of them play a significant role in reproduction. That?s a fact. The concept about "things that we are let to believe and things that are new does not readily find acceptance" is not even a little bit relevant in this case.

It clearly indicates that you don?t even practice what you preach. You strongly lobbied for the fact that people who support gays are not necessarily gays. Now look what you have done, in just one swing of your words you turned everybody - Ananymous, Rhythm, Matrixgirl, Matrixrose, Echoes into gays, whom I believe-are actually not. Honestly man I have a strong feeling that you are very gay, correct me if I am wrong. I wonder why you refuted it in the first place, and seriously, if you are not then you better come up with a real solid alibi this time to support it.

And lastly, Rhythm, sweetheart (please don't get offended when I say that) I like your name very much. I am not prejudiced like you said, not at least in this case. Until recently I did not seriously question homosexuality and its threats to us- just like you. But ignorance is not innocence and with facts in your hand, supporting it would be even more of a heinous crime.

First of all you must understand gay............most of the gays i have seen is male/female trapped in the body of opposite sex. There is giver and taker.........one acts like male and one acts like female. If they have been traped then what can u do? are u gonna do another massacre of history simply by killing gay and lesbians....coz it is not encourage by all the relegion....hahahahahahahahahahahahahahah
only thing i want to say is ..........some ppl became gay coz they cant get girl or girl who cant get guys....but i have seen some gay turned in straight as well.......may be they are confused.....but in gay terms or what gay say is? those ppl are simply bisexual. For example ppl who goes to war for long time and they cant see gals and engaged in war.......they screw each other ass or even in prison......but dosent mean they will be gay. They can alwyas come back and screw there wife....it is just a need of your organ. If we talk about relegion........why kamasutra has so many pics of orgies? hahahahahahaha

the lizards story is all true..hope u do get to catch that documentary one day..it got me thinking..cos yap they are animals(arent we?tho of diff types)...well was tryn to look at the big picture..but wat evolution for us...we shall never know but then again these days humans are doing things we believe only 'god' has the right too..and the possibilities wat humans will be able to do is just too limitless..we always try to put a limit ..a boundary..to go as far as we can...(dun we?)..we like to test ourselves and make us push further..(we are too thick headed!!thats me opinion anyways hehe)...well yap this subject is really too open...and everyone opinion will be right in one way or another cos there is no such thing as the eternal truth in this...so let me not speculate more on this hehe...pretty much cant stop thinkn wat will become of us in time...esp given enuf time to survive in this world...did we ever imagine or had the slightest clue that from the prehistoric apes ..we be wat we are right now? a more 'defined' version?and future?well who knows wat evolution has in store for u....

and about those lizards...lizards do lay eggs hoina?and we dun?..but eggs def still has to fertilized by sperm..(which def comes from the male?applies to most animals anyways)..just the fact that once they had male lizards who provided sperm...ceased to exist..cos of some weird evolution..female lizards were able to do it..tho they still had to 'act' the fertilising scene..get aroused by touch etc...i dunno if those female lizards were able to create sperm before(hopefully one day when i have so much time!will go find more stuffs to read about them :oD..) so yap that was just me thot hehe..of cos we are diff from lizards or any other animals!!dun we regard ourselves as the top of the food chain?cos we have common sense?the ability to think and make decisions for ourselves?etc?and yap i do hope u get to catch hold of this documentary and more..just opens up ur mind to so many ideas i tell u!!..that documentary was about which animals had the female species ruling them...think their theory was humans too is gonna that follow that thrend if it wasnt already followed ;oP....i do like to think we do try to co exist..give and take but seriously if u ask me...im not too happy to say this..but i think i will give way to me other one more wahahaha...well i basically hate to quarrel and end up gettn me head spun or spinnin other ppls head ...enuf of tension!!!hehe...

so lets disregard evolution...wat might happen in the future..or wat we are right now..lets just stick with wat we can do right now...

so back to homosexuality and the topic..yap got to stay with what the world is now..how it is etc...males we cant produce ova...women cant produce sperm...but well technologies these days..u know having sperm banks...(another dumb theory can be added that...who knows?enuf sperm will be collected in the world one day..that women wont have the 'need' of men?hehe..technology aint that great yet..that anything can replace women or the womb of theirs ..which carries the future of the world for 9 mths :oD..yap too much thinkin of plots for B grade sci-fi movies ;oP hehe)....but dun u thik if everyone was a bit more 'understanding' and worked together...lets say war btween the 2 gender..but both realises we need each other to survive...but of cos everyone has their needs...so..well women one side..men one side...all tries to fulfil their needs themselves..(lets say a new hiter is born and ruling the new world hehe..too much dumb theories hehe dun mind me)....so women are all lesbians..cos in this alternate world of ours..they are brought up to be lesbians..and mens as gays....but of cos to reproduce...thts where sperm banks comes into use...men go donate their sperm...and well women has responsibilites to carry some babies per life(maybe paid to do it? just like men will be paid to donate?of cos in a real world..not everyone will do anything if there aint any incentive hoina?)

so in this scenario...if it was to happen..which definetly can happen if its allowed to happen....mens and womens role of reproduction takes a new meaning doesnt it?we do work hand in hand for survival of human race..but of cos smthing like this to happen...there was to be a real big war of the sexes and a hitler and a hitlerni born who detest each other so much..that their hatred for each other spreads thru and seeps into everyone in the world...most of them..and in this world of ours..majority rules..minors have to follow wat majority is doing..like it or not?if u dun do it...u wont survive...and if everyone was practicing it?wouldnt it be culturally accepted?cos wat is culture?(been doing some couse on culture this yr..electives hehe..pretty much opens one mind..but makes one realises..there is no such thing as a definite answer hehe..well thats wat it made me think anyways :oD..)...yap old cultures were created in time..and some of them have withstood time..and got 'deinfined' ....but new culture is coming out these days...and i like to believe..homosexuality is one...and right not of cos the majority of the world doesnt like the idea cos its too..as u call it..ewww ?cos its new?that they never thot was possible?but ppls minds are opening..(is that good or bad?no idea..but if its opening..lets accept it..we have to accept the truth..can we run away from it?) so yap the 'trend' seems like ppl will be more acceptable in the future(this is speculating hehe..)...but wat are the chances of it being accepted?havent we seen when we ban smthing..the more desirable it becomes?....

maybe cos we humans desire things that others dun have..grass looks greener on the other side eh?Im definetly not encouraging homosexuality...hehe..but in the end..all im sayng is..i see it happening around me...and of cos i have to accept it..why not?just cos i dun understand it?does it mean im right?and they are wrong?how do we measure right and wrong this time?homosexuality definetly aint an answer to those social issues we have..but who knows some of us might be resorting to it to get some answers?its a weird world..and the things we do..we have weird reasons....robbers..frauds etc..they do wat they do..to gain smthing for themselves...and of cos sadly but true..that is one of the human traits of ours...to do smthing to gain smthing.....we can label them as bad for society..cos they practice it in a way that will def hurt society..both socially and physically...if it was said its ok to rob and fraud and kill..like in a war?where one has to kill to survive?how will the world be?more chaotic than right now that we do know more sure..so we def need rules..a balance...to make sure it doesnt get out of hand...

but for homosexuality...homosexuals do wat they wanna do..cos yap they are gaining smthing from it..what?only they know...they are gaining the same things we might be gaining by doing some other things?a sense of belongin?comfort?pleasure?....which they dun gain even tho if they did the same things like us?...but socially does it corrupt?i mean ...what might mean corrupt to me might not mean the same to another...but does it preaches violence? etc?all it is askn for is acceptance...(thts me opinion anyways hehe)

If we start saying homosexuality is not right..just cos we dun understand it..and cos we have not been 'taught' or nothing in our history says its ok to be a homosexual...isnt that a form of segregation itself? if anyone thinks..this keepin purity of who we are is right..to make sure we dun lose our identity..they will def not support homosexuality...but those who thinks identity of ours..is wt we are..what what we can become..(past glories hah..why cant we get over it!!)..that to make it better...its about acceptance(accepting that is acceptable..def not talkin about accepting killin...robbing ..cheating ..wars etc hehe)..nature made us men or women...but there are time nature made freaks...siamese twins....etc..why?i mean i hate to label them as freaks..but just to get me point across...they def wont feel the same as us...if we were to just think nature is always right..and we shud follow wat it made us..wat we shud be..wat about those..who doesnt know wat nature made them to be?nature do makes mistakes...doesnt it?.but wat is the mistake nature made? is it the 'diff' ppl it made that was its mistakes..or is it us?who cant just accept that there will be minorities who wont be like us..who are diff from us...just cos they are made the way they are by nature..for example..an impotent man(im not one btw if u thinkn im one ;oP hehe..just clairifyn duh!!hehe)..what must he be thinkin his whole life?he is a man..yet...an impotent one...wat does it make him?why did nature make him so like men..but didnt give him all his capabilities?...can anyone answer him?

so many questions out there..that never will be answered...but wel in the end...(i better finish this!!!hehe i got work to do and dyam i got carried away wahahahaah)...anyone who did botherd to read this..hope i did make some sense and me point came across..(i think i tangent off too many times hehe thats the way i am:oS hehe).....two ways to look at it....either naturally...or socially..(is there more?)....

socially...its more about being taught..and this we know can change in time..just look at how far we humans have changed socially...dun we find it dumb that we used to burn ppl once not that long ago..cos we called them witches?...

and about nature...all nature does tell us..is that there will be a lot of diff types of us...both in skin and color....(well one day if everyone does have a bit of each of us..i guess we can eradicate this skin and color..but do we wanna lose our so called 'identity' that we do seem so proud of?i mean im glad im a nepali...but then again ..if someone else is proud to be who they are...well they are like me..like us :oD..and well of cos we get a bit not too happy thinkn some of our identity is goin to get lost..but look at the big picture!!hehe)..and even with same skin and color...some wont have wat others normally have..and mind?no mind are the sames..if anyone says it is..well we have common things..but same to the extreme level?well u know wat i mean hehe..

in the end...well one thing i do believe we have..that we are so proud to be..is that we have our mind and we make our own decisions..tho of cos there will be factors that affects our decisions....but in the end...as everyone knows...we need a bit more acceptance..and even if u accept it or not...homosexuals..and their culture is here to stay ;o)...and to make ones life easier..its better to accept and adapt..unless if u wanna be hitler good luck ;oP...

well i dunno me history details..but i like to believe..a part of hitler was jewish..thats why he hated it so much..cos he was left 'alone' by a part of him...bloody ironies...

wat is right bhaney?is there an absolute right?...lets 1st get rid of the homosexuals..cos they are a minority..lets not them "exist" and once that is done...lets see who is the next minority?...what race?..wat religion?.etc...hah...

i know i wont see armegeddon in me life..but dyam it be fun to see it hehe...pretty much goin there dun u think so?but then again..we humans been surviving for generations..so guess me better not underestimate us humans ;oP hehe...guess if there was no "conflicts" and "issues" world just wont be the same for us ;oD.....we do like to create conflicts for ourself dun u think?like im doing it for meself!!i better go do me work!!!wahahahaha..

anyways sobeNO bro..its always nice to read wat u write :oD...i dun feel no hatred towards me or me opinions..and well if im feeln wrong..cos im a bit insensitive..dun mind me ;o) hehe..but im just sharing me opinions..that might now make sense :oD...but def no hatred hai..hehe..and nah i dun call it a debate..cos duh!!im not tryn to win or anything here..so of cos i will def contradict meself a lot..cos one has to question oneself to find the answer too hoina?DIY!!!!!hehehe...if i dun even question meself..will other ppl questions make sense to me?smthing to ponder hoina ;o) hehe...
