I am on F1. It has been 8 months I have been here now. I started to work for a motel 'unauthorised' from the very start-with a social security, because I had to. I was paid in pay check all the time. Last week I was authorised by my school for CPT 'authorised' employment and I started the job. They authorised this in the 3rd page of my I 20 a a full time CPT and it bears the name of my 'authorised' employer too.
Yesterday, my motel manager, 'of course an Indian' called and gave an offer for me and my wife,who is also on a F1 without a social security. The offer is, we both will be provided with a 1BR apt in the motel and we are supposed to work as a resident manager. I dont want to give up this oppertunity as we wont have to pay for accomodation! and the perks are too good to avoid.
The issues I have to resolve with the help of you "Mastermind Sajha Counsellors" are:
1) The motel want to pay us together in a lumpsum basis on my social security number, so that I can divide or pay the amount between me, my wife and two other Nepali bhai and buhari. They dont want to simply pay me in cash. What should I do? IS it ok to do this on my social?
2) what are the consequences of unauthorised employment? I MEAN ANY REAL EXPERIENCES YOU MAY HAVE HEARD OR KNOWN OR FACED.
3) How does this later affect me If we plan to file for an asylum or go for H1B and later be sponsored for Green card by my 'authorised' employer?

santoshgiri ji namasate...ma pani motel mai kaam garnay vhakoe lay yo thread ma aakoe.pahila suru tapai vhanue huncha tapai ko wife F1 student, tara how come she have no SSN?..the first of all , there will be no any such consequences working unauthorized unless untill someone reports to INS or you do something wrong or illegal acticities besides working. i have been here for 4 years, almost working in paychecks,never worked i n cash and filling my tax returns every year, iam too f1. never had workpermit.now lets go to your topic........don't make ur wife work in ur SSN. another think if u work n live together in the hotel. u know they will make u work like hell. not all but most indians they do. so if possiblew work w/ hour basis if good enough money then just get ur paycheck only do not include other salay..the tax they cut when u have that much money in 2 weeks , u won't beileve. this week i ahd $365.29 only in tax cut.also u can make wife dependent so ur taxcut will reduce. ra best thing don't make ur wife work there if really thats only solution tell them to pay in cash..and never inculde ur bhai and buhari ..ok take it easy.................

These days u wo't get SSN until u have job in school so his wife doesn't have SSN. Don't work on indian motel in check. I dunno why u wanna work there if u have already CPT. you can work legally if you have cpt. indian talks very nice in first and later they will put u in trap. IF you still wanna work in motel work only in cash. but i suggest to you to work in cpt which willl be better for ur future .. carrer

I totally agree with Ricky Nepal..I had a friend, who used to work at a Motel owned by an Indian in Oklahoma. The owner assured him of processing H1B for him, and H4B for his wife....made both of them work their ass off, only to find out he never did any...they kept working, paying taxes, but the taxes was actually collected by the woner himself, he(the owner) never paid the taxes to IRS on my friend's behalf.....Like Ricky said, they talk nice at face, but will butcher you in the back.....If you have CPT, better to find a similar job in US owned hotels, such as Holiday Inns.......since you have experience and all that......Make good use of the CPT brother....don't fall in traps ofthe Indians......We can only suggest...Decisions are all yours ! Take care !

As far as I am concerned, Don't ya work in the indian motel as you already got CPT. They will bust your ass off and pay ya minimum wage. Not only this, they will yell at ya every time when you work with them. It's the indian motel manager crook policy and don't ya be trapped in that jal. There is a saying that auta moreko dhoti le 2 jeudo nepali lai thagcha. So what he is doing, is trying to lure you for his profit so don't ya do that. Otherwise you will be regretting for your whole life.

just be careful how you make and what you do to your earnings... IRS knows everything.. don't try to fool them... you can get away from anything in this country but not the IRS. and they are not going to believe that you are working 100-120 hours a week in two different places. They would rather spend thousands of dollars to get hundreds from you. -> personal family experience. you can have the indians pay cash to your wife, bhai and buhari.. even after taking the tax out if that indian wants to.. but you do not want to report that in your ssn. yes, it will affect your green card applicaiton from your other employer. until last year INS and IRS were two separate things and still are.. but now they will be sharing their database. so, just don't do anything that your heart says not to unless you want to screw things up...

Since you are a legal student , I think you should play it safe. Ask the motel manager to pay in cash. If he wants your service so much, he will agree , if not, find something else. Dont mess up with IRS, INS..

As far as legal consequenceds are concerned the following is what could happen:

Per the Immigration and Nationality Act, working without authorization falls under what the INA terms "violation of visa statuts" which is one of the most used grounds for deportation.

Secondly, As a F-1 student who has been "legally admitted" into the U.S, you are eligible to adjust status at a later date to say a H-1 (B) visa; however, adjustment of status is not available for a person who has worked without authorization.

Third point, if the motel is paying you in check based on your social security number, there is every possibility that he will at some point report that as "expenses" so he gets a tax benefit and that would leave you exposed.

I know these are the legal basis and what happens in reality is far different, but, you need to know that the INS has been working overtime in recent months in enforcing rules--thanks to the pressure of the Right wing over "national security".

If you have authorization from school and have an approved employer, it is TOO BIG a risk to take to work with the motel merely becuase you don't have to pay for accomodation. I know that as a student, every peeny saved counts..but you need to think in the long term. If you have any other questions regarding possible legal outcomes, let me know.

Santosh bro,
euta kura ke bhane USA ko policy on forieng student is not a check list procedure. For example , visa dida pani kasailai as per I-20 and kasailai 3 yrs, 5 yrs etc hunchha. Aba visa issue garda ta kurai bhayena as you know best of the kids are denied and some rottons get it. The same applies to unauthorized working. On vague they say its illegal and will hamper the cause while applying for H1 , or green card or even on re- entry to USA. The reality is that IT IS ABSOLUTELY A CASE BY CASE policy and you dont have the right to say "mero saathi ra mero same case thiyo tara uslai kehi bhayena tara malai kina yesto ". Tara based on my experience of 8 years, the immigration people are quite soft on Nepali students. Until and unless it apears that you are absolutely not studying but only working , they may get tough.
By the way taking risk on your wifes behalf is understandable but for your friend ??? thats absurd and something you dont want to do in USA.
The situation though is getting tough quickly as patriotism, xenophobia, conservatism is on the rise in USA . Good luck dude
and lastly , mero bhai le jasto dukha garera kaam garyo , school baal chhaina mahina ko 2500,2000 kamaye yo umer ma USA ma life cool bhai halchha bhanera dukha garera kamaune udaune nagarnu hai.
