Has anyone been successful in applying and actually getting h1b1 visa stamp from US consulates in Canada, especially in Vancouver, BC? Do they process third country application? My h1b1 is expired, but I have approval notice good through next year, and need to travel to Canada to attend a conference and return back to US. What are my options in securing a h1b1 stamp in my passport without needing to travel all the way to ktm to apply from there??

Hi,
Well I know one of my friend who got the H1-B VISA stamped from Canada. But just to be in a safer side...he also hired a lawyer there and paid $1000 so that there is less chances that your H1-B would be denied. So may be this is something you could think of doing rather than going all the way to Nepal.

Hi,

The reason he hired a lawyer is to make his case stronger. I mean tyaha gayera deny bhayo bhaneta bore huncha....so lawyer hire garyo bhane interview huda I think that lawyer will assist you during the interview. If you need more information then I can talk to my friend and get back to you.

Lemme know if you need more info.....

Take care.

No point hiring a lawyer unless your case is not straightforward. I don't think lawyer's can add much value if you are capable of doing thorough research.

I have done this twice in Vancouver, BC and there is no problem at all. You just have to prepare all the documents that you get with appointment confirmation letter and thats it

JaiGanesh,
How did you schedule an appointment? Through this website http://www.amcits.com/appointment.asp or or calling the consulate? Just wondering.

At the moment, I do not have a Canadian Tourist Visa. Would Canadian embassy grant me the said visa when my passport has no US visa, but the approval notice for the 7th year h1b1??

Hi,
I went to Canada last year and I got visa without any problem. But its good to be prepared with any sort of documents and questions that might be asked.

- Schedule an interview at any US consulate in Canada using website http://www.nvars.com
- Make sure you have passport with you when you go online to make the appointment, as you will have to enter your passport number.
- You also need to get Canadian visa to enter Canada. You can apply for Canadian visa once you have received posted the US consulate appointment letter. You need appointment letter from US Consulate to apply for Canadian visa.

Take to the US Consulate/Embassy the following:
1) Valid passport (at least valid for 6 months past the original approval stay in the US)
2) Any previously expired passports showing stays in the US.
3) I-94 card
4) Complted Form DS 156, application for Nonimmigrant visa for USA.
5) Completed Form DS 157, if you are make between age 16-45.
6) Original and one copy of H1-B Notice of Approval, Form I-797
7) All your educational documents (diploma, transcript, etc.)
8) Current letter of employment stating position, salary, job duties that correspond to H1_B support letter. This is the most important document you should have.
9) Copy of H1-B petition (i.e. I-129, I-129W, L.C.A, employer letter, etc.)
10) One passport-type color photo
11) Visa processing fee $100.00
12) Company brochure or annual report, if your company has one
13) Recent pay stubs
14) Consulate appointment letter
15) Copies of US Federal Income tac returns
16) Resume
17) Original form I-20(s), if you were ever in the US under F-1 student status.
18) Original Form I-797 approval notice for each previous change of status/employer.
19) Original marriage certificate for spouse
20) Original birth certificate for each child

I hope this information will help.
