Hello, anybody out there please explain what 's up with a constituent assembly. How is it formed? Is it like a referendum or a general election? Do parties run for the House on the basis of their own manifesto, or do they have one common agenda for the people? After the election what do they do? Does the elected assembly (House) decide en masse on the future of monarchy or do they select a committee of their own which decides the KG's fate? Another point: who writes the constitution and is the nature of the constitution voted by all members? What happens to the assembly after the constitution has been written and completed? Is it dissolved? New election for parliament again? Unfortunately, no Mother F*****r of a journalist has enlightened the Nepalese people about this. THEREFORE, Please BE THE FIRST ONE, even if you are not a jouro!

In my opinion, nobody knows clearly about the constituent assembly (CA) even leaders of SPA and maoist and they never tried to make it clear to people. So, now it will be fun to watch how they will proceed on this agenda.

As far as I understand, it is not a referendum and it is something like a general election in which people can choose the persons who will write the new constitution.

But I tried to figure out about the history of CA in the world, I surprised that none of the country in the world had CA.

Yeah, what is it?

The journalists in Nepa are not writing anything about it.... But let's start this thread by each of us writing what we think what this CA is about?

Seriousely, it's still long way to go with CA... Maoists are not clear, SPA is not clear about it, and many many negotiations will be needed before this CA can be realized. Meaning, Girija gonna rule for longer time than you might have thought. ha ha.. Girija.. moj gar moj gar. ha ha.... Sujata moj gar moj gar.... Now you should earn the money invested in the recent demonstrations back with 100000% interest included.

Thanks you AP 98 but that did not really help. How many candidates are there? Do they represent their party? Is it district wise or Anchal-wise? I'vnt the foggiest idea!! Completely lost!

Basically they want to copy what India did in 1946.

To my knowledge, Constitutional Assembly is an elected body similar to a parliament which have full power to make the constitution of country. If there is debate in any issue then it will be decided by voting in constitutional assembly. For example if there is a debate whether Nepal will be a republic or it will have a ceremonial king then constitutional assembly will decide it by voting.

So basically it a constitution made by representative of people. It is a beautiful concept; I hope Nepali will get this chance.

As far as I know, Constitutional assembly has been there in many countries including Norway, Sweden, South Africa, Timor to name a few.In Norway, CA was first done in 1814.
As far as I have understood, it is a body which drafts a new constitution which is then left to the people to accept or reject by voting. It is a long process which takes at least 1 to 2 or more years.

1) First a Constututional Assembly if formed of some members of the parliament, distinguished judges and lawyers, some cabinet members and members from the head of the state. The appointment is done by the parliament.
2) A time, usually up to 6 mth is spent by this assembly in which the current constitution is studied in detail and the clause which need change or rectification are listed. Then discussions are held on these points and drafts of the changes to be made is prepared. Two third majority of this assembly must approve the draft.This may take another 6 mth.
3) The final draft is sent to head of state for approval.
4) Those points in the draft which are in a debate and about which no consensus can be reached in the CA, are put forward in front of the people and voting for this is held like general elections. The people can either accept or reject these points.
5) The final constitution is then made.

Maoists wanted CA from the street and not from the Sansad, probably becoz they didn't want members from head of state side etc in this assembly. But CA through sansad is the democratic process and everyone should accept it.
