Fatal delusion

The new parliament has declared that our country at present is without a constitution or at least it need not be followed by the politicians. They are still flying high on the revolution that gave the power back to them. They seem completely unaware of the dire consequences of their present actions of utter disregard for the constitution.

A big blow was served to our democracy and the nation as a whole by Surya Prasad Upadhaya, CIAA chief, by clearing Girija Prasad Koilrala of any wrong doing in regards to corruption charges against him. I think the whole of Nepal, if not the world, know that there is not a clean cell on Koirala’s body. No wonder, all the politicians think of CIAA as constitutional. It is not only corrupt politicians that are eating away at the nation but also corrupt and coward people like Upadhaya who promotes corruption by utter inaction. Although Kantipur has strangely stopped following up on Upadhaya scandal, his silence in regards to the specific allegation proves his hands are dirty as well. I would not be surprised if the new government dissolves the CIAA and legalizes corruption in Nepal. After all, there is no point is spending tax payers money to fund a failed organization. However, the whole Nepal at the moment is concentrating on the, soon to be held, peace talks between the Maoists and the government. Of course, the parliament would have to make a few decisions in favor of the Maoists before the Maoists agree for negotiations.

Then comes this thing about withdrawing all government charges against the Maoists and forgiving them of all wrong doings. So, no Maoist can be charged with anything (murder and other crimes like extortion) until a new constitution is prepared! So, not only the politicians but also the Maoists are above the law? The parliament has actually forgiven the Maoists (the victims would not agree) and have started punishing those who opposed them during the Royal rule. Of course, prejudice is not prejudice if it is done by the politicians. They have also taken stern actions against police chiefs and have at least talked about actions against the Chief of the Army Staff. It seems the Maoists have won the battle and are on the verge of winning the war. They have attacked all the institutions that were defending the country and they have done it through the parliament. Now, our civil servants are going to think, “should we really do anything against the Maoists because they might punish us similarly if and when they come to power!” Furthermore, if everything can be done extra-constitutionally why do we need to go for an election to a constituent assembly? They can just sit together and sketch up a new constitution.

If you look at the present situation in Nepal, at best we will have a bunch of thugs running the country together with a gang of murderers. That is, if everything goes well. The international community has also, so far, supported this venture for peace even before the details regarding the Maoists’ surrender of arms and other vital issues are confirmed. It seems everyone just believes that the Maoists have already accepted the values of multiparty democracy. But, what if not? What if the, so-called negotiations, between the government and the Maoists don’t materialize or fail? Should we not be prepared for such a situation as well? Are we ready for another round of war with the Maoists?

India , I think, would not want a Maoist government in Nepal regardless of whether they were elected democratically or not and neither would America for that matter. Of course, India would love it if the Indian Maoists declare that they accept the values of democracy and that they are willing to compete in a democratic system but it is only wishful thinking. Just imagine what 5 years (if the Maoists accept democracy i.e.) of support for the Maoists in India from Nepali Maoists (if they get to power) would do to the Indian problems. Even America’s stance of supporting a democratically elected Maoist government is a suspect. America has withdrawn all her support from the Palestine after Hamas was democratically elected there. What is most peculiar is the fact that, US, India and UK are being very positive about the present situation.

Whatever may the case be, the Nepali government would have to be very careful and maintain the rule of law in the country. They should remain alert to possibility of total anarchy prevailing in Nepal if extra-constitutional measures are too frequently pursued. They should also be very sensitive while dealing with the security forces who are putting their lives on the line in the name of the country and hence they are the true martyrs. The fact that the same security forces may be required by this government should the negotiations with the Maoists fail should not be forgotten and the government should do its utmost to keep the spirit of these forces high and motivated. If and when someone needs to be prosecuted, a proper and legal method should be pursued instead of randomly making political decisions to satisfy ones political ego. In other words, everyone needs to put national interest ahead of personal gains and prejudices.
