Kantipur Report


KATHMANDU, June 4 - A meeting of the House of Representatives (HoR) on Sunday declared Nepal as an untouchability-and-discrimination-free country.

The practice of untouchability will now onwards be considered as a social crime and the government will enact laws in such a way that the inhuman and discriminatory practice is more punishable," Minister for Law, Justice and Parliamentary Affairs Narendra Bikram Nembang told the House prior to tabling of the proposal for decision.

i suppose u are lawyer.could u give us some insights what kind of laws was there on descrimination?don't tell me hindu country etc?tell me the laws.it is social issue not legal.

The only provision in the constitution under the right to equality is that:

ARTICLE 11(4): Untouchability shall be declared a crime.

The punitive provision is in Mumuki Ain: Adal ko Mahal: Section 10 (ka)
If someone treats another as untouchable, he MAY be imprisioned for 1 month and/or fined up to 3000 Rs.

We, from Lawyers National Campaign Against Untouchability LANCAU Nepal filed a writ petition (a apublic interest case) in the Supreme Court in 2004, demanding the government to scrap the provision that did injustice to the 3400000 Dalit Community who are discriminated every day in different ways.

We demanded for stricter laws with heavy penalty as this was already considered by the constitution as a crime against the state.

The supreme court finally decided the case and issued a directive order againt the government to immediately enact a strict law to curb untouchability.

You will be surprised to find that, due to the social pressure, fear, trauma, threats from the so -called upper class people, until 2005 December, only 3 cases were filed by people who faced severe atrocity.

I had an oppertutnity to interview the then IGP Shyam Bhakta Thapa and asked what police was doing and planning to curb untouchability. He did not have knowledge that such law even existed in the nation!

So you admit that it is not the problem with law.So why big fuss about it.the problem is implementation.The present govt should focus on implementing not just try to be hero "from now onwards nepal will be descrimination free" we will see how effective implementation is going to be.
The big problem is consiciousness, education .As almost every society in this world .nepalese society will evolve too.it takes time and effort.Just by putting in newspaper headline is not the solution.the solution comes from everysingle person of the society.

one more thing making stricter law against it just does negative effect as well .people should not try to tame people with fear but education.funding is required on education not on punishment.

Imi can i know how it will bring negative effect when there is stricker law...?????
these dalits cannot even stay in society like a normal human beiing....so when there is a strict law making punishment you seems to be against it... can you please explain me what will make nepal better?????are you talking about education to the people or to dalit.
This kind of dalits things came from tradition so it is hard to uproot it...for me its better to make strick law so they won't be harrashed anymore...

Stricter laws differentiates one people from another.the whole idea of it is not to differentiate.yes , law will help some what but the goal of ideal society is not achievable with stricter laws.The negative affect is when you feel you are different than another and you can not assimilate with the person from another caste.It creates more differences in mentality.We need to change mentality not to jail them.Social issues are more sensitive than you expect.I am not against dalit or for upper class.i am just for good harmony in the society without descrimination.

i was glad when i first read the news, but then reality suddenly slapped me. it is not soo much about the law. it is about the peoples and their willingness to change and work towards it. US has had laws against discrimination for how long? more than 50 years right! and yes things are changing gradualy, but soceity is still not as good as the law ni. so as of now, and may be for aother decade or so, nepal will not be discrimination free....but we are definetely moving towards the rightttt direction. i couldnt be more please with the progress.

Laws cannot itself module a society. Niether a society can be a slave of the law. Law and society are actually the sides of the same coin. When one side seeks a shine, the other side should be glittering too.

The legal provision was termed as 'sufficient' above. Is it?
Do you think, 3 school children being seperated by the schoold during free nutrition program of World Food Program, just because their surname hinted they were dalits, can be justified for a mere 3000 Rs?

FYI. There has been just ONE decision by the Dhading District Court in this regard. Even in that case the Brahmin judge decided to fine the preperator Rs. 25 ! Is that enough?

FYI: No person has ever been arrested on crime of untouchability.

The flaw is in the law and the flaw is in the implementation too.

Look at the root cause not the problem.Eliminate the root ,there will never be a problem.

If someone doesn't allow somebody inside the house -isn't his right to do so.Though he is not going to say that he is desiminating the other fellow .What brings this social change.law ??law can go only so far.when it comes down to social issues .Alternative solution like education might be more effective than force.

Exactly.........

Poverty, Illetracy, poverty, low-hygine, superstition, ill-traditions lacking scientific reasoning, everything is a part of the 'clean nepal' issue.

to clean up the house, you dont just throw whatever is in your trash bin, you have to clean up all the corners, nooks, ans to some extent search for the garbage tirelessly.

In real and fact of Nepal...

In 6 decades of Nepali Democracy failed because of...

(1) Racism

(2) Discrimination

(3) Crimes and Corruption

New political parties and government must be done by all means:

(1) Constitution, Law, Order, Rule and Regulation must have true democratic and equal for all Nepali Tribes or groups.

(2) Constitution, Law, Order, Rule and Regulation must define in detail. All weak and loop-whole of Justice and Law systems must be patched or sealed.

(3) Balance act must be written in constitution and law, which is all Nepali backward tribes and native tribes, must get high priority in high ration in Nepali education, government jobs and political participation. They must get free education up to high school or bachelor degree to uplift their social and poverty life. They must get economy support and help from Nepali government. They need skill job trainings so they can stand by their own.

What do you think all Nepalese people around the world? Do any Nepali political members, lawyers and intellectual have any idea on it?

you are in the right track

The weapon for equality for the discriminated should be unconditional reservation in every sector. Such as a majority percentage of any allocation should go to the Dalits without any question, biasness and obstacles.

WHY?
Because they have a history of discrimination compared to those who do not .
Becasue they have been undermined sicnce ages, exploited and supressed.

FREE AND COMPULSARY EDUCATION WITH STIPEND:
Government should immediately issue orders to the Ministry of Education to impose compulsary and free education to all children.
Dalits should enjoy more rights in terms of education because the state has the duty to apologize to them for the thousands of years of discrimination.

Dalits should be offered lifelong free education and provided with all the resources to meet that education. Hostels should be made available for them in priorioty basis. Stipend should be provided for their daily living. technical subjects must be taught if they choose, keeping in mind the fact that they possesses the best skills among all such as in metal carving, woor carving, musical instruments etc.

Global standard of technical expertise and education must be provided to them so that they can utilize their skills and produce international standard products that are competitive in the international market.
The government must arrange a 'Dalit Mark' such as 'Rugmark' to enhance thier reciprocal representation in the international market. The Dalit MArk must be provided subsidiary and quotas of imternational imports and pout in the first line of benefeciaries.
