i believe you can report the loss to the police and on the basis of the report, apply for passport thru our embassy. When you have that, maybe you can contact INS and get further details.

Get a police report of lost passport. submit a copy of the passport and your citizenship with a $80 draft to Embassy of Nepal in Dc. At the same time apply for a lost I-94 to USCIS with the following form: www.uscis.gov/graphics/formsfee/forms/files/i-102.pdf appky at your service center mentioned in the instruction of the form. Hey Guys, my friend has a same problem. He lost his passport three years ago and now he is out of status. can he still go to the police station and file a lost report?? Do police ask any questions regarding his status..... Your help will be appreciated.. Cheers!!!

juxtapositions so far my knowlege is concerned, losing passport and I-94 do not affect ur immigration benefits. We do all type of cases everyday and if the passport or I-94s are lost, we just state it was lost. In the mean time u can apply for passport as said to adjust ur status. Majority of the muslims were caught when they went for NSEERS. IN the above case, similiar thing might happen. So it is better to make a case pending with the USCIS or the court before filing the complaint which will allow him to make an argument to have the application/ petition pending and can ask for certain reliefs like motion for continuance at least to have the case adjudicated. Or he can substitute his LC and adjust his status under section 245(i) which is the easiest way regardless of current status.
