Hey Guys,
I was wondering if you guys have any suggestions about Green Card Processing.

How long does it really take for Green Card Processing? (in a typical setting)

I have been working for a company for about a year now. I had my H1 since 1st year. so i have 2 yrs of H1 remaining. (I can have 3 more yrs after that :) )
I am currently working with my employer about getting my GC processing started.
However, I have been hearing rumors about back log of GC.. GC taking longer time.. etc etc..

So any thoughts..

crishna, as far as I know since you didn't get H1B through quota you need to apply for new H1B if you need to transfer your H1B to another employee.

ANybody knows any special agents to process GC without actually working ?? Do let us know. I know some people who did by not even working a company.

I have a question to immigration gurus here. My laywer says he has filed for I-140 on my behalf. But, he didn't give me any proof. How do I make sure if he really applied I-140? What should I ask him? Any suggestions?

H1B issued by universities are worthless when you want to join other profit organizations. That's why it's usually good idea to get green card from that university when you're working there. You must apply for the new H1B under quota if you want to change the employer.

Batuwa, ask for USCIS receipt number for I-140 application.

It is actually true that one can get a GC in less than 6 months. I am a prime example for that. I got married last year while I was in second year Medical School and my wife was in second year medical school as well. I started my process in April and I had my GC in July 17 th. It is Possible, I don't know if it is due to through marriage or not but I think if you have all of your documents in right order and right way you can get GC in no time. The good thing about that was I didnot have any lawyer either.

Thanks for your suggestions. Now, I am more confused than ever before. I think my lawyer is BSing me.. big time... I asked him about the USCIS receipt #, he said he hasn't received it yet because there's been a huge backlog or something at Nebraska Center. He should be receiving it any time next week. He said he filed I-140 by the end of July. How can it be possible? Does it take that long to get the receipt? Has anyone filed I-140 recently and having the same problem? My guess is that my lawyer has never applied I-140 yet... Should I be skeptical about him?

yeah, sue your lawyer if that is the case, dont use your lawyer to sue himself though.

Hi experts,

If my employer states they will file my GC in EB2 catogory, how long can it take me to receive my GC.

Hi Sidster,

I know a friend (from Nepal - nonretrogressed) who was filed in EB2 and got:
PERM approved in 1 week
I-140 approved in one month
EAD/AP in 2 months
AOS in 5 months

I-140/EAD/AP/AOS were filed in parallel. So it took her just a little more than 5 months. Of course, the advertising process for PERM took a little more than 2 months.

So all together about 8 months.

so when i receive my GC, will it be a conditional GC or unconditional.My concern is, will i be able to change employers. I dont want my employer to hold me hostage for an conditional GC.

Hi Sidster,

Sorry I am not so sure about that. The only thing I know is if AOS is in process for 180 days plus or if you already have GC, you can change your employer. But what I hear is if you change your employer as soon as you have GC or something like that, you may face some questions during the time of GC renewal. But again, I am not so sure about it.

this is how this works.

when an employer files a GC for you, based under any employement catagory, it is not a contractual thing that obliges you to be with the employer or the employer to keep you with them.

it is just a process, that says, the employer couldnt find any qualified worker ( ofcourse a resident already) so they're willing to sponsor you to be a PR.

once you get your PR, you are under no obligation to be with the employer, and neither is the employer to keep you there.

the so called "conditional GR" is actually a temporary green card, usually for 2 yrs, the only way thats not gonna be changed into permanent Green card is if you involved yourself in criminal , terrorism, work against the interst of US , and stuff like that.

and well, quiet franky, there is no such thing like permanent green card, coz US govt can alwasy revocke ones green card, should they involve in act agains US.

as far as changing your employer, that has nothing to do with converting your temporty greencard into a permanet or so called for 19 yrs.

I have a question for Katrina and for sure for Mansion.
My situation: I have a university job under OPT till May 2007. My next job may not be university job, so H1B is needed, and quota for H1B is full till next year. So I cannot start my job till Oct 2007. So, if I get non univsersity job right now, I may work from now to till May 2007 and and then I cannot legally work till the october, because H1B starts 0ct2007. I think I understood that part clearly, if not please suggest me.
To not to be end up in this situation, I am applying for EB2 GC. I have two option: 1) National interest waiver, 2) through my current university emloyer.
Now my question is: If I go through my university emplyer and file GC, but after filing or during the procedure I get another job (which I am looking for intensiveley), how does that will effect my GC applicaiton?
In this situation, is there any reason I should apply for GC through national interest waiver (no need of emplyer or labour certificate), though it is little harder to get?

I hope I made my self clear...Help Mansion or anybody. May be Katrina, because your friend got EB2 GC.

once you apply for your GC, and you change your employer, after your LC is approved, it doenst matter as much, if your new position at your new employer is consistent with your previous employer, and stated in your LC, as long as your new employer is willing to sponsor you too.

For national interest waiver, there are certian criteria USCIS follow , now you decide on your own if your job fits in any of these.

The aliens admission will improve the U.S. economy.
The aliens admission will improve wages and working conditions of U.S. Workers.
The aliens admission will improve educational and training programs for U.S. children and underqualified workers.
The aliens admission will provide more affordable housing for young, aged, or poor U.S. residents.
The aliens admission will improve the U.S. environment and lead to more productive use of the national resources.
The aliens admission is requested by an interested U.S. government agency.

my suggestion, use the regular LC way.

but consult your own lawyer.

I think Mansion is very knowledgeable in these matters. I am not so sure what to advise you myself, but I do believe Mansion is very knowledgeable and is very helpful also to share his knowlege.

There are several ways find out if your 1140 was actually sent to Immigration.
1. Ask your lawyer for proof of mailing or delivery method.
2. Please find out if your check or money order was cashed.
3. You should be receiving a receiving confirmation from Immigration with in two weeks.
4. Have you changed your address and not informed the INS with AR11?
5. Please call 18003755283 or try www.uscis.gov.

Thanks for bringing up this thread. Very informative!!

I also have a similar question. I started working with a unviersity since July of this year. How soon can I ask my employer to file for a GC? Will it take long time if they apply for a GC now vs. if I work for them for a year and then ask them to apply for one? What category would I fall under at present: EB1, EB2, or EB3?

What would be the best way to go about this?

working for the uni, most probably you'd fall in EB3, but it also depends if you have had any experience before or not.

THE SOONER THEY FILE YOU THE BETTER.
