I am hoping somebody can answer my inquiry regarding I-140 and I-485. I had recently submitted documents for RFE in regard to I-140 (USCIS received those documents on September 11) and the website still says it is in a processing phase however, it now said they have sent me another RFE letter for I-485 (filed I-140 and I-485 concurrently). I am confused as to what my status is for I-140????? I thought they only review I-485 after approving I-140. Has somebody gone through similar experience? Please help....

Hello everyone,
I also has similar problem. My I-140 approved last year and my company is not able to sponsor GC or I-485. Therefore, I have to transfer to different company under EB 3 category. I went USCIS requirement. Now, I do not know how long I have to wait for I-485 approval. If you guys have any answer, Pl let me know.

USCIS recently sent us a RFE asking for MMR vaccinations, as my wife didn't take this during the 140/485 applications 6 months ago, as our daugther was just 2 months old and was breastfeeding. She is still breasfeeding and we'd like to continue to do so until the baby is at least 18 months. If we have a doctor put a statement in the supplemental I-693 saying that "the mother is breastfeeding and will provide MMR in June 2008", will the INS keep my wife's application in suspension until we provide MMR results or will they issue greencard and ask for MMR in June 2008. Any inputs in this regard will be highly appreciated. Thanks in advance.

Thanks Aex for your help. I already received my greencard. My case was approved within 6 months of applying in EB1 category and received the card in less than a week after approving the case. Thanks all for your support.

Katrina, there must be something wrong on your case,,it should not take more than a week at worst case..check your attorney immediately, tell them to inquire..

Hi,
I had my biometrics/fingerprinting done on the 22nd of March in Chicago. My employer (NGO) filed my I-485 last month under employment category (EB 2). Now, how soon or late could I expect my case to be approved? How long did it take after fingerprinting to get your card? Any ideas? I'm just curious. I'm currently on H1B and planning to visit Nepal in May 10.
Thanks in advance for your thoughts and suggestions, etc. etc.

Simonsaurav, could you share your timeline for EB2 application? I started mine through EB2 on Feb, 2007. I am still on labor.

Xtreme, labor will take about 2-3 weeks. After labor approved, I-140 and 485 can filed together. but you need medical report, birt certificates, tax paper etc to file 485, so start gathering all those documents. in 6-7 moths you will get your card in mail.

the case I mentioned above as mine is actually my brother's, not mine (I am still stuck on getting a waiver because of my J visa all these years of residency and fellowship), but I will give you the timeline.
My brother's employer had filed for and secured labor certaification some time in December '06. He filed his i-485 and i-140 concurrently through his employer's attorney on the last days of Jan, '07. He got fingerprinting dates for mid-Feb, but he was out of country at that time. His wife requested for rescheduling and got it for March 22. My bro is on H1B. He has a degree from UK and came to US last year only.
labor: Dec 06
application/i-485: Jan, 07
finger printing: March 22, 07 (rescheduled) ---next?

any updates on your case, Xtremejyu? how fast are other people getting it?

Saan dai, my bro says he didn't need to file tax papers, even for 2006. He turned in everything his lawyer asked, including medical reports and birth certificates. Will the USCIS ask for it later or just send him the green card once the case is approved? What else have you heard about such cases?

Haven't got my labor yet. My lawyer says it takes up to 90 days.
I have a friend whose labor got approved in 15 days.

Simonsaurav, I think since your brother arrived last year he has not filed any tax at the time when he filed I-485. May be that is why USCIS did not ask for tax papers.

Labor or PERM depends on the type of job and location.

Mine was approved in 7 days, though it was through PERM for EB 2.

My I 140 was approved in 4 months. But for one of my friend's I 140 it took almost 7 months to be approved, as it was EB3.

I filed by I 485 on December 4th, 2006 and still have not received my Biometric appointment letter. But I already have my Employment authorization, and travel authorization approved. I am worried as it has been almost 4 months. What do you think I should do?

Hello everybody. My I-140 was approved today. I would like to know what would be the next process. The approval mail is on the way. Do i get a card? Now I have to file for green card, my lawyer didn't do file at once with I-140. Green card, when can I expect it? I know it's going to be along wait. But still I'm happy today.

kastamandap, it is always a good idea to go for 485 once you received your 140 approval rather than going for cuncurrent filing, it expedites your process significantly. now, you said your 140 is already approved, you will receive your GC approval within 45 days if everything goes ok, but if you are RFEd, and /or found anything wrong on your security, fingerprint check....then not before 6 months at least.

filing 485 after 140 approval expedites your process significantly, only if you go for I140 premium processing.

saan dai, I140 was approved in 7 months just like harris said. Once i hear from my lawyer, I'll file for green card, hope everything goes ok, I also wanted to make a travel document, contour, harris, if you have any information pls share. feel like going home, it's been awhile. I think I have to file for GC, Contour, Harris will this approval letter tell me what to do next, some said, it will give me an appointment when and where I can to got get my work permit. after that i file for GC probably. I hope you all can share with me his wisdom.

You could certainly have filed both i-140 and i-485 concurrently, you didn't. That's not a problem, only an opportunity. Now that your i-140 is approved, the next thing you want to do is file i-485. The sooner you file, the sooner you get it. Your lawyer has other fish to fry too so he/she may not get to you in time. You can actually remind him/her that your i-140 has been approved and you want to file i-485 soon. S/he will tell you what documents you need to prepare. If you already gave him/her those docs like immigration physical, photos, job offer/contract letter, tax papers, birth certificates, copies of passport and i-94, etc. then you are all set.
While applying for i-485, you can also file for travel document ($ some extra fee). If you travel after getting it, you don't have to apply for visa when you out of the US. But hey, when are you planning to visit Nepal? If your travel plans are not unitl six months from filing i-485, you may not want to file for this document and save that extra $$$. If you have a job with a good company (universities are the best) and no problem with name clearance (FBI), you may get it within 2-5 months of receipt date of i-485. Good luck.

Any suggestion on my case?

I still have not received the finger print appointment letter yet? I had filed for I 485 on Dec 4th.
