I just heard that quota for foreign Nurses has just expired on Sep 1st 2006,
and I also heard that they will add few numbers by the end of this year..
i am just confused, but can anyone help me out with more info regarding this matter?

The lawyers I talk to says quotas might and might not be added. Congress has been talking about it for quite a bit but no decisions yet. They say if the congress gets pressure then there is chance.... all we can do now is wait for the congress to make a decisions.... if not go back to school....

Here is the latest information:

50,000 nursing quota was added in 2005 when the regular EB-3 got retrogressed. Before that Nurses would file under the same EB-3 category but didn't have to go through the Labor Certification Process. That 50,000 quota was one time allottment which is going to expire at the end of this month or sooner. [Definately you can't file adjustment of status on or after November 1, 2006. However, whether you can continue to file until the end of October remains uncertain as there is no precise information on how many quotas are left. If the quota is left, you can continue to file until the end of this month].

Demand for nurses still remains at the alarming rate. There is good possibility that Congress will find some other way to give more immigration visas for nurses. However, until this happens, the application for I-485 is not accepted as the immigration visa will not be available.

However, it doesn't stop you from filing I-140. As long as you have other non-immigration visa status to remain in the US and you have met the requirement for green card filing, go ahead with your regular application for I-140 (Pettition for Alien Worker). Acceptance of I-140 will set your priority date for future I-485 filing. However, you must have other visa status to legally remain in the US until the priority dates are current.

At this moment, the priority date for Nurses is October 1, 2005 for nurses. Those who have already filed for I-485 in the past few months and haven't received the decision yet, will have to wait until their priority date is current. However, you can renew the work permit annually and will not have problem to stay and work in the US. You can also apply for Advance Parole if you need to travel out of the country.

can anyone help me out ? I have 2 more years to go for nursing but my visa expires in 1 yr. what should i do after it expires. is it like illegal there after. and how it gonna effect in stuffs such as getting hired, applying for residency. what should i do after i complete my degree ? And immigration issues about more nursing quotas kinda depressing.. blah. blah .. it seems like everything is DHOSTA now.

are u talking about F1 visa? If yes u don't have to worry about it as long as u r in school and in status.. after graduation, u will be in OPT for about an year (which u have to apply about 2 months before graduation), u can find a job and work with it without any problem. U should be processing for Greencard within the OPT period... ofcourse if the congress decides to approve some more quotas......

WTF, my wife just joined a nursing school thinking its a good carrier, whats now going to happen, all my money and my wife's time??

Nobody needs to be worried for future prospective of nursing. The visa retrogression is a temporary problem. If somebody is in school, just focus on getting good grades!!!!

I don't believe this will be a long term problem. Only those who are about to run out of non-immigration status and are about to apply for the green card have to find some ways to remain in status. That's it. You can look at the other poor EB-3 fellows who have to wait 3-4 years to file for a green card....
