 Difference between EB 1 and EB 2

1) Does anyone know what the difference between EB1 and EB2 is?

2 ) I have a bachelors and a master’s degree from here, do you think I can get my labor processed under EB2 ?

3) Does anyone know good consulting companies that deal with SAP or PeopleSoft and would process EB2 and green card right away?

4) I would prefer someone who has been through this answering these questions please.

From what I hear,

If you have won extremely extremely extremely prestigious international award like Nobel Prize, then you qualify for EB1.

If you fall under the National Interest category - doing cutting edge research on relevant scientific field - or you have advanced degree, such as PhD, in scientific field and your employer is sponsoring you, or if you are an executive of an international organization, then you qualify for EB2.

Rest qualify for EB3.

Am I right?

EB-1 Priority workers

Foreign nationals of extraordinary ability in the sciences, arts, education, business or athletics
Foreign national that are outstanding professors or researchers
Foreign nationals that are managers and executives subject to international transfer to the United States

EB-2 Professionals with advanced degrees or persons with exceptional ability

Foreign nationals of exceptional ability in the sciences, arts or business
Foreign nationals that are advanced degree professionals
Qualified alien physicians who will practice medicine in an area of the U.S. which is underserved. Read more about this particular program.

EB-3 Skilled or professional workers

Foreign national professionals with bachelor's degrees (not qualifying for a higher preference category)
Foreign national skilled workers (minimum two years training and experience)
Foreign national unskilled workers

EB-4 Special Immigrants

Foreign national religious workers
Employees and former employees of the U.S. Government abroad

If your job requires minimum Masters Degree or Bachelors Degree + Minimum 5 years of Work Expereince in the related filed, then you qualify for EB-2.
EB-3 is back logged at this time.

About EB-2 :

Can someone delineate the process step by step for me? What's the time frame like?

eb 2 for nepal is current. once ur labor is approved which takes about 3-6 months u can can file i140 and i485 together and this will take 6-8 months. thats it. but i am not sure about the requirements though

I understand you can get your work authorization card and advance parole permission sooner than actual GC. Is that true? And if so, how soon?

What happens in scenario below:

1) You are in H1B,you apply for GC..your GC got denied...can you still work in H1b or you got to leave country?

Tris, yes you will be able to stay if you didn't use EAD.

Labor
RD: Aug 9, 06
AD: Aug 12, 06

140:
RD: Oct 10, 06
AD: Oct 14, 06

I485/AP/EAD
RD: Nov 01, 06
Advanced Parol AD: Nov 21, 06
Employment Authorization Document AD: Dec 12, 06
I485 AD: ONLY GOD KNOWS :=)

Ax, thanks for your timeline. Very nice of you to share.

It was kinda hard to decipher your acronyms, I guessed: RD = (application) received date (by USCIS) and AD = approval date. Am I even close?

Seems like a great turnaround. Just 2 days for PERM? Why did you wait 2 months between PERM and I-140, and, 1 month between I-140 and 1-485 processes? I thought you could file I-140 and I-485 together, am I mistaken?

Well, we are about to start our EB-2 process very soon. The employer is doing it for us. Being a complete novice in this area, I was trying to figure out the roadmap of the entire process. From what I could gather from above, there are basically three major steps involved. Please tell me if I am wrong or missed anything.

PERM

I-140

I-485
- Advance Parole
- EAD

Does that mean if you do not give EAD to employer and did not use EAD to work anywhere even after receiving EAD
OR Has not applied for EAD??
