Does anyone know if a company can file for H1 B before the official graduation date? My OPT starts in April, but my degree does not comes out till May. Can my company file for H1 by showing transcript till December 2006? Will a letter of anticipated graduation from the graduate office help to officially file for H1 B on April 1st? I will have master’s degree in May.

You need to have a degree in hand before applying for the H1B visa. It doesn't work like OPT where you can get it before hand. Good luck.

Your undergraduate degree should be enough to process for H1-b. Because you are expecting Masters degree soon, I presume you have an undergraduate degree under your belt.

Even you are in your OPT, you cann't apply unless you have a degree. You can have OPT before the completion of your degree. Are you going to apply based on your masters program? For masters, there are 20K visas available. Plus you can do the Preminum Processing, and you can have it in 15 days!. I would not rush things, and since you have OPT, it is letting you to work. Give it few days, the H1B application will start from April, and you are losing only one month. If possible, please wait till you have your Masters on hand.
