Hi Guys,
what are the best ways to stay legally until I hear from USCIS about my H1B application. My OPT expired in May 24th, 2007 ?
I would really appreciate your suggestions...Thanks...

Join KAPLAN or a community college for fall.

I believe you should join any school before your OPT expires and maintain F1 status.

I have same problem ,my opt will expire in august 27, 2007 . I guess ,I still have 2 months grace period . i did get my H1 receipt couple of weeks ago .... DO I still need to join school?? coz i'm not sure if my H1 will be approved. any advice please??

Lightnup, I think now its the time to come home.

Why all the fuss about OPT and H1b's?

Arent you coming back to Nepal too? Youre supposed to, as you have explained when getting the VISA.

I dont see any reason why you should remain in the US not your origin country Nepal, where i am right now.

LightnUp I know our own country is so bad that most Nepalese are desperately leaving to migrate to other countries like the USA, cANADA, Australia, the Middle East and everywhere else where they can find employment and live permanently. Despite our backbreaking labor in the country, people can hardly make both ends meet. Parents think of leaving so they can earn more in other countries, and have their earnings reserved for the education of their children. They prefer to be away and earn much more, rather than earn the pittance wages here, and not be able to save for the future.

I love Nepal but we are wrong we did get help along the way from many different countries. The Shaha empire was great too but it did fall. If we do not stop the invasion of corrupted politicians then our empire will fall. If we do not quit trying to be PC and never offend some people then our empire will fall. The politicians must be held accountable for everything from allowing the degradation of morals to the waste of taxes.

And IF we all young highly educated Nepalese dont go to Nepal after our completion of studies, and dont want to find the oppertunities to build it then we as a country are doomed.

Always remember getting education from foreign universities bring respect when working in your own country.

BTW rnmn, I am also a US Graduate from GeorgeTown Univiersity in DC alumni of 1998. I never thought of applying any h1's and GC, though i have a Nepali American born wife Sunita.

I pursuade my wife give up the US citizen, and adopt Nepalese.

Thanks for listening. Lest develop Nepal, make it heard and seen with development.

if u r OPT expiring on 15 May-->Get I-20 for fall before July 15.
if u r OPT expiring on 30 May-->Get I-20 for fall before July 30.
if u r OPT expiring on 15 June-->Get I-20 for fall before August 15.
if u r OPT expiring on 30 June-->Get I-20 for fall before August 30.
if u r OPT expiring on 15 July or later date-->Get I-20 for fall.
Condition:
if you have I 20 for fall 2007, you could stay legally at US for 4 months (correct me if I am wrong) before your classes starts.
Remarks:
this is not a legal advise, for better advise, plz contact your international advisor.

hey spiderman,

while applying for H1B, one has send I 20 from different school and then after getting new i 20 from otehr school, does not the person will have both f1 and H1 status at same time? my question is, which one will be valid?

Number,
If your I-20 gets approved AFTER the H-1 got approved, then your H-1 will be invalid. Its whichever gets approved last. so be careful and talk to a lawyer for further consultation. Go to http://boards.immigrationportal.com/ and post your questions about visa issues, they seem to have better answerers there.

Thanks a lot for the prompt advices.
Darky, I understand the meaning of going back. I often ask my family if I should go back to Nepal, and prepare for next adventures. Then I hear pause for a second. Going back now, I think would put me to square-one from where I had first left Nepal. However, I am happy to read you from back home.

Friends in U.S., since we are talking about joining college for Masters Program, what are the decent colleges with affordable tuition fees? I have Mech. Engr. undergraduate, and I want to pursue Info. Tech. Thanks again...

you are wrong here.

that would be true iff you woul have attended school for 9 mths(2 full sem) in that particular year.
when you are going from 1 degree to another. you cannot stay in US for 4 months in the gap.

3 months would be max. meaning.... 60 days grace from expiring OPT/degree completion.
then 30 day [ prior to starting new term i.e. you can come 30 days prior to start date only]
beyond 90 days. its not legal.
