An announcement came from the USCIS on May 11, 2007 that they were unable to meet their projected deadline of that date for issuance of all receipts on regular H1B cap-subject filings. This was attributed to the receipting and data entry required for such high case volume. This means that there are still H1B regular cap cases that were selected in the lottery, but that have not yet been issued receipts.

VSC Receipts by June 2nd and CSC by June 15th

The USCIS did not provide a date by which all cap cases absolutely will be receipted. They did provide information about the Vermont and California Service Centers' (VSC and CSC) expectations for when they will be back in compliance with the timeframes for issuing receipt notices on the H1B cap-subject cases. These dates are June 2, 2007 for the VSC and June 15, 2007 for the CSC. The USCIS is asking the public to wait at least 30 days from these dates before contacting them with inquiries about H1B receipts.

Mailing Delays Possible after June 15, 2007

The USCIS reminds everyone that further delays may be experienced in the mailing of receipts, once they have been issued. Many MurthyDotCom and MurthyBulletin readers are waiting to learn what has happened with their cap-subject H1B cases, so this update should provide them with at least a little assurance.

Hey guys,

I had applied for H1B visa through a consulting company. They told me that my docs were reached to USCIS at 30th of April(very last day). As I am graduating in this month, I do not have my degree yet that's why I had applied with an expected graduation date.

Will there be any chance that my H1B visa gets approved without submitting the degree? The fact is that i got a job in a different company and I want my H1B visa not approved for this year. What will be the complications if got approved ? Thanks for your comments.

I have a similar problem. The consulting company I applied through has told me that my application has been selected. But after the training I don't wanna work as a BA with 5 years experience. I am thinking about joining a non profit. This company has lied to me too much. So if you get any information about how you can go about forfeiting your current H1B employer, do let me know. I would really appreciate it.
I was also thinking about joining a school this fall and getting a CPT, then again apply for H1B next year. I don't know if this would be a problem. My mind is too screwed up right now. I was seriously hoping to not get selected for the H1B, but then they tell me that my application was selected. I hope this is one of their lies too.

Pale, If your application reached at USCIS on April 30th then I think you are out of luck for H-1b for this year. Did you not know that there were more than 150000 applications received by USCIS on the first day and 50000 more on the 2nd day of April.

That's why they came up with the lottery system. Your consulting company not only lied to you but they were doing what they were supposed to do. They should have mailed it before April, so it could reach USCIS on time. Anyway, if you haven't graduated yet then finish the school, work on OPT and try your luck next year-- on time. F**k your current consulting company. Choose the consulting company very carefully. You can, however, still apply for H-1b IF YOU CHOSE TO WORK ON NON-PROFIT organization, like schools and Hospitals. If you are good in math and science, try your luck in teaching. G'luck to you.

XX-Nepal, NOT every non-profit need not worry about quota. I think it only applies to hospitals and schools. Do some research and don't be so sure about it. G'luck to you too.

xx-nepal,

I understand that you are trying to join Grad school and apply for H1B next year. You should be fine as you would qualify for H1B next year because of your Bachelor's degree. Also, I think you could still cancel your H1-B even if you get one this year. If you quit your job, that would mean that you would not be on H1-B status anymore forcing you to go for F1 again. Hope this makes sense.

I have heard about many Nepalese getting exploited by these so-called Consulting companies. I guess the key would be to do some research before going for any Consulting company that gives you a call and promises you everything.

Thanks for the info explorer and NepaliJose, appreciate it very much.

As for the H1 to F1, does it happen automatically, or do i need to do something. My OPT lasts till Jan 14, 2008, and since H1 starts from Oct 1, 2007, I was thinking about joining a school this fall, so it would knock off the H1B effect. I really don't know how it works. Do advise me on what you know.

My H1B was filed on May 1, 2007 claiming "Not Subject to H1B quota" on the front page of the papplication. The start date has been mentioned as Jun 10, 2007 as my OPT expires on Jun 9, 2007. I work for a county. It does not qualify for exemption from quota as it is not affiliated to institution of higher education nor is a government 'research' organization. So in the I-129 Data Collection NUmerical Exemption and Determination Section, boxes 1 to 6 have checked "NO" which makes sure that county does not qualify for quota exemption. Box no 7 which asks if the applicant has masters or higher degree from US instituion, it has been checked "Yes". It makes my application subject to 20,000 quota. However it contradicts the statement "Not Subject to H1B Quota" on the front page.

Acc to USCIS website, the cap of 20000 was reached as of April 30 while my application was filed on May 1. Interestingly one lawyer from NY says that the CAP was hit on May 4. If so there is a slim chance.

Once my OPT expires on Jun 9 and if there is not any decision regarding H1B, employment ends on June 9. If H1B gets decided and approved after June 10, I can come back and work but if it is denied, I have to get I20 (another status) within 60 days starting from June 9. However the start date on I20 does not have to be within 60 days from June 9, but the start date on I20 can not be more than 150 days from Jun 9.

I have applied to schools as well and hope to get I20 within Aug 9 i.e. within 60 days of OPT expiration. If I get I20 issued as well as H1B also approved, I think I will have the option to choose anyone I want.

If the start date on H1B had been Oct 1, 2007 and my OPT expires on Jun 9, then I need to be out of US during this time or get an I20 issued within 60 days of Jun 9 to cover for the time in between. IN my case the H1B start date has been put June 10.

Need suggestions regarding my situation. Anybody been through like this? Need help guys.....
