Hey guys, I am in my OPT right now. It started from December '06. My H1B has already been approved. I am trying to change jobs. HOw does the H1b transfer work if I transfer before October 1st. Am I still in OPT or already in H1B . Any help would be appreciated.

You will be on OPT before October 1st. Thats for sure. I am not aware of other legality about transfering H1B.

Once you get H1B approved from one company you can transfer it to other company only after you receive two pay checks from the date of your H1B validation means, Oct 1 2007. you cant change the company now because you wont be able to file petition for H1B since its already full. So you have to wait until Nov 1.

Since you're still in your OPT (F1 status), your previous paychecks will not count. Your H1-B doesn't start before Oct 1 07, so I don't see any option other than working for the current employer (the one who filed your H1) for at least one month. I am not an expert on this matter but the above statements holds true (friend's experience). But again, you might wanna talk to an immigration attorney.
