Lawyer said audit notification was received in LC filed. What is audit notification? How does this impact on approval??

In general, audit means the submitted figures, papers or documents not approved in the first place and under scrutiny.

If it is with IRS that means you have to re-submit your tax with the supporting documents IRS had asked for.

It is a case for immigration, your lawyer will able to answer you, not us.

I have seen a couple of cases which are mostly related with your birth certificate. Old Nepalese birth certificates are not recognized by USCIS and sometimes they ask for support documents. I am not sure if that is your case but that is what I have seen with the audits.

BTW, are you in the I-485 stage?

Never mind my last message. I just noticed your title. It says "LC" which I am assuming is Labor Certification. In that case, it is probably something to with the application and hiring process that you had to go through.

Sorry for the confusion.

Hey Catmandoman,

I've recently filed my 485(EB3- three mnths ago). I got some better opportinuity somewhere else. Now I need to switch my employer.

Somebody told my that if my previous Employer is willing to continue my 485 then my GS will be in process. Is this correct?

In my audit, DOL has asked to prove that 'The requirement is essential to perform the job in reasonable manner.' What type of document would help to answer this?? Any thoughts?

Legally, it is not. But USCIS is never going to know that you have started a new job, so as long as your old employer is willing to continue the process, you are fine. I would recommend to have your lawyer change the sponsor name to your new employer. If I remember correctly, it is after 90 days of original application that you can switch to any employer.

I am sure your lawyer can give you better information but as far as I know, that means your interview process (with the candidates who posses similar qualifications) information needs to be documented better.

You are f**ck* up. Audit Notification means a lot of critical stages. You need to submit complete recruitment report and all those stupid justifications. Regarding documents you can make comparative charts of experiences from your company and job market ads.

Hey Catmando, Thanks for the Info.

From my understanding its 180 days after we file 485 .

Mine is less than 90 days. So I was thinking if I can continue another 90 days then I can transfer to my new employer.

But still can we transfer it legally after 180 days?

Is there any web site where we can get this 485 transfer info. My current Laywer is totally freak dhoti. But the company I will be joining is genuine so kinda confused.

I guess you are right. It does seem to be 180 days. I talked to my lawyer though and he told me that it is 90 days. You might want to pay a $100 consultation fee and talk to a reputed lawyer. Here is a good team:
