Is it a LOT easier for someone to get Asylum Visa when out of status(illegal) as opposed to someone who is legal and is on F-1?

Hi Sahayog!!
My brother is just here in US in visit visa and the immigration has given him a maximum stay of 3 months. So, is there any way that he can remain on status, other than going for school? Any suggestions will be highly appreciated. If any body has good idea about that plz help. Thanx in advance

To begin with, ASYLUM is NOT a Visa (carta visa). Asylum is not about immigration: it is about protection and safety.
I would suggest that before you start the process (and perhaps a war on your own conscience), understand what asylum is (not the common usage you find blabbered among Nepalese but the actual legal and international context stipulated in laws).
