Tikapurebhai,

If u r going to apply from the US, it will take about a year. I have heard that the government of Canada is going to change its PR policy effective Jan. 2008. I don know much about this though. So follow up regularly and apply asap. Regarding appointing a lawyer, its a good idea for the precise documentation but it may cost around 1000 CAD.

Anyway good luck and welcome to canada

to Tikaput, For your information, read carefully that form from Canadian Consular website. Make sure you already got your recent TOEFL and ITEEL something from Canadian testing agent for English. Make sure FBI finger print letter from FBI, which normally takes more than 5 months and police report from Nepal Police. Get a letter from your job to show your experience, your US degree. If submit your copy of paycheck. Read twice your application. They will send it back until it properly filled.

When you have to select the Proficiency of your English, you will have 4 choices.

High Proficiency
(Maximum of sixteen (16) points)
Moderate Proficiency
(Maximum of eight (8) points)
Basic Proficiency
(Maximum of two (2) points)
No Proficiency
(No points)

If you select High Proficiency, you have to prove that you really are.

There are two ways to prove.

#1 Either you  are  born and raised or raised only in an English speaking country for example NZ, Australia, UK, USA and Canada etc. In this case you have to show that you did your high school and college in one of these countries.

#2 If you do not qualify for #1 and you choose high Proficiency then you have to take IELTS and you have to get very good score.

If you choose Moderate Proficiency, you don't have to take IELTS. They will know your when Proficiency you take your interview.

I am not saying all these on my own; I attended a workshop about immigration provided by Canadian embassy in NY.

Here is the link to site to take quiz, you must get at least 67 in order to be sonsidered yourself eligble.

If you have taken TOEFL then you do not need to take any other test. I used my TOEFL score from 1996 when I applied for Canadian PR in 2003. In addition to my TOEFL score, I also sent in some other class projects from school, my GMAT score from 1996 and a letter explaining why I think I do not need to take the IELTS to prove my proficiency in English. The Canadian Consulate did not even call me for the interview.

I think using a lawyer is waste of money since the application forms are pretty easy to fill out and all you need to do is have all the supporting documents according to the instructions. Most of my friends did it on their own too.
