Hello Dear Sajhawasi,

I have some queries about H4 visa.

I have to call my family to US. My H1 B is approved last october. Now I asked my employer about that and he says ok call your wife to make an interview appointment date for visa in Nepal . Your spouse's H4 and other documents will be done in one week......before the interview date.

Q1. Is this possible to get I-797 approval in one week?

Q2. To make an appointment doesn't she need her I-797 form approved from INS?(Ofcourse she will need   while in interview) ? 

Q3. What type of documents will she need to attach with application for appointment ?

Q4.  Previoulsy I was in F1 status. So should I send all I-20s's copies also to her to produce in interview ?

I visited US Embassy in KTM's website but there was not so clear information about documents which should be submitted for H4. I found this :  

Family members qualifying in derivative status should bring the following at the time of interview:

-        Approval Notice of the spouse - Form I-797 issued by the USCIS

-        Proof of the applicant’s relationship to his/her spouse, and/or children (e.g., marriage and birth certificates, pictures, letters etc)

-        Evidence of Financial resources  ( This means my pay stub  ??? or Bank Balance in US?  If pay stub how many months of ??)

-        Any other relevant documents .. For Example...........

rmxyz,

1. proof of marriage certificate infact english translation of marriage certificate

2. photo (album) wiht clear pictures of you and your wife marrying and also people attending.

3. your H1B approval documents

4. your bank statement along wiht stated balance out here in US bank

5. I didn't had to have I-797 so dont know about that.

6. I dont think that you would need I-797 for your wife. I-797 is something that is issued when in US. From Nepal, I think it would be entirely interview. Please correct if I am wrong. But yes, you have to send copy of your I-797 (H1B approval document)

7. Copy of Paystub 2-3 months

8. W-2s or Tax return

9. Letter from Employer stating your position, salary, date of employment.

10. Your letter to Consular as well as support letter.

11. Affidavit of Support I-134.

12. Copies of your passports, visas, I-20s chronically which shows you are in status since you entered US.

Yes, Nepalko lato and Sampada said are both right. You don't need anything else.

Just these: Good Pictures of the wedding where you and your spouse are clearly shown......(They look into these pictures  in detail with few other people if they have doubt about your marriage)

Copy of your H1B.

Your Employer's letter on the letter pad stating hwo much you make.

Your Bank Statement and a letter from you requesting the US Empbassy to issue visa for to your spouse.

 If you have these items, it  will work perfectly! Goodluck RMXYZ!!

Dear NKL ( I don't want to write full name b'cose it doesn't suit u) , and

Dear Haribansha.

Thank you so much all you guys for taking time to give me valuable suggestions.....

I think she doesn't have to take photo album of my family since we have live proof of our marriage  But anyway she can do that ....

So by all you guys' suggestion I am ready to send Nepal these letters(Photocopies):  

1.  My all I-20s

2. My PP's all pages + Visa's (Which is expired)

3. My all acedemic certificates (Nepali and US ceritficate)

4. My H1 Approval letter (I-797 letter....I-94 is attached so I don't have to go for stamping anywhere)

5. My employment letter

6.W2 document

7. Last paystub ( I have only one month's (December)..Will it be a problem)

8. My Bank Statement and a letter  requesting the US Empbassy to issue visa for my spouse.

9.      Dear NKL    Can you explain more about Affidavit of Support I-134.

Beside above docs she can submit our marriage ceritficate,birth certificate, relation certificates in US Embassy in Nepal..........

So I don't have to get any letter from USCIS in US for her H4. 

Am I right ??
