House politicians propose 'emergency' H-1B hike

Microsoft Chairman Bill Gates clearly got through to some politicians with his plea for more H-1B visas on Capitol Hill earlier this week.

Late Thursday, a U.S. House of Representatives Democrat on the Science and Technology Committee, which Gates addressed, introduced a bill that would double the number of H-1B visas and remove other restrictions from 2008 onward. Then, on Friday, a key House Republican followed with his own proposal for "emergency" relief. His plan: tripling the visa cap.

H-1Bs allow foreigners with at least a bachelor's degree in their area of specialty to be employed in the United States for up to six years. Right now, the cap stands at 65,000, with another 20,000 for foreigners with advanced degrees from U.S. schools.

The first bill, sponsored by Rep. Gabrielle Giffords (D-Ariz.), would bump the cap to 130,000 beginning in 2008--and increase it to as much as 180,000 if the limit is reached in the preceding year. At the same time, it would potentially allow in many more foreigners, as the bill would exempt from that cap anyone who has received a master's or doctorate from a U.S. university in math, science, engineering, and other technology fields. Up to 20,000 extra visas would also be allotted to people who had obtained such degrees from institutions outside the United States.

The second bill, called the Strengthening United States Technology And Innovation Now (or Sustain) Act, is even more aggressive. Proposed by House Judiciary Committee ranking member Lamar Smith (R-Texas), it would raise the visa cap to 195,000 in 2008 and 2009--the highest level since its peak between 2001 and 2003.

Both bills are meant to address what technology companies say is a visa shortage crisis. They're also more aggressive than other recent attempts to increase the H-1B cap, which set a 115,000-visa target.

Gates and other technology company executives have long said they need the ability to hire more foreigners--both on temporary visas and permanent green cards--to fill gaps for which they can't find qualified Americans. Gates maintained that H-1B visa holders at his company receive high wages, prevent jobs from being moved offshore, and even lead to creation of more jobs for Americans around those senior engineers.

Last year, the run on H-1B visas ended one day after it began, and the year before, the supply was exhausted after about two months.

Criticism from programmers
The setup of the H-1B program, however, has landed a fair share of criticism from American programmers, who argue that the visas depress their wages and displace qualified American workers. There are also allegations that the offshore firms--particularly Indian ones--have been snapping up H-1B visas, recruiting foreign workers, and then outsourcing them to foreign companies.

Ron Hira, a public policy professor at the Rochester Institute of Technology and author of the book Outsourcing America, told CNET News.com after Gates' talk that it's wrong to suggest most H-1Bs are going to the brightest foreigners with advanced degrees and earning them big bucks. According to U.S. Citizenship and Immigration Services, the typical H-1B holder has a bachelor's degree and is making a median salary of $50,000. And the latest National Science Foundation report on the subject says only 1 percent of H-1B holders in computer fields held doctoral degrees (44 percent had master's degrees).

Other pending bills in the House and the Senate would place new obligations on U.S. employers before making H-1B hires, including requiring them recruit Americans first.

The application window for next year's crop of H-1B visas is set to open on April 1, and it's unclear whether either bill will see action before then. Both chambers of Congress are scheduled to begin a two-week recess on Friday and aren't expected to return until March 31.

This is just a proposal. It will be the good news only after it is set to action. Until then, it is bunch o' bullshiit.

that proposal would be really good if they make only from U.S. bachelor degree as did master. They wouldn't have to raise 65k limit.

That sounds pretty interesting and it means nothing to me. I have masters degree from American Univ. and I don't have a company that will sponsor me. What a luck.

It is just good for Nepalese but extremely good for Indians. They are the ones who enjoy this hike.

I agree with Java. The first priority should be for those foreign students (no matter what country) who graduate from US colleges. But unfortunately 90 percent will be captured by non US graduate Indians who enter here in H1B with fake experiences. This is the reality.

i've been hearing this kinda bull crap since 2002 about guest worker, 2 year opt, authorizations for students to work off campus, autorization for students from Nepal to work off campus , including the massive immigration rally in 06 which means no shyttt now.... sick of getting hopes high and waiting for miracle to happen, and nothing happens...i just keep getting older. one day will come when our nutsac get lose and hit the floor and they'll still talk ... besides, congratulations to the bhayyas in India ... more consultants working for h1bs and peanuts now ...oh on a sad side note, i heard today that some Nepali students got busted by their IPO advisor for working at a gasstation :( :((:( may god help them...

This is totally insane!!! To my knowlege this is a matter of great concern, this is not a good news for anyone who is on H1 status or wanting to get H1 status from US after graduating in grad or undergrad. Think  like this most H1 is applied by Indian companies like TCS, Infosys, SATYAM, and numerous other companies. If the USCIS approves this limit there will me more IT guys coming to US there will be a overpool of IT personnals in the US. We are already facing problems in getting jobs. Jobs that use to get filled in 2-3 months are getting filled within few days. If more people are coming to US those jobs will be filled in few min. The market is already very competative in terms of getting jobs now if we have more H1 there will be a competetion in the salary. Having a H1 status shouldn't be your concern getting a job paying atleast 52K in a full year period should be your goal, because if you don't you have to pay .26 percent of 52K which comes out to be roughly $13,500 out of your pocket.

Say for example u are in H1 status and u are getting paid $70,000/year. Caution: if your employer can get someone else who will do the same job for $52,000 you will certainly gonna loose your job and may be your current H1 unless you find your ways out. This way your wages are being cut and possibly your job is highly volatile. The offshoring of jobs are already an issue and bringing more people in IT field is gonna make it even worse. So, people who are trying to graduate and get H1 approvals your chances are very slim.

Disadvantages are already there. How you would ask? Think about this way who do u think is benefiting from this move. The answer is the US government and the client companies. They want people from other countries to make money and pay them taxes. How is the US government benefiting? The answer is you are paying to IRS. How many months do you think you will work in H1 status out of a 12 month period these days? May be the chances are 6 to 9 months, unless you are hired as a permanent employee(are you lucky? remember the chances are very slim). So, if I understood this right, your salary for a H1 is minimum of 52K and if u make 30K during the whole year you still have to pay taxes for the 52K salary mark. This way you are not making the whole 52K and you are paying taxes for the unearned income. So how much are you makeing in a year? Very less. may be a max of 30-40K. So, you are not actually making even 40K, otherwise may be 32K a year NET. That is getting paid roughly 15-17dollar an hour if u work the whole year around in other jobs working 40/hr/week. Another disadvantage is do you really think just getting out of college will get u a job? My friends from India with 3 years of SAP real time experience is getting a hard time to find a job. He is competing and likely not getting a job soon and even if he is an eligible candidate he has to go thru the pricing wage war with others.

So thinking logically there is not much room for any of us for survival and its a trap designed by the US government and the multinational companies getting cheap labor inside US and elsewhere. It is no different as having the illegal mexicans draging the mimimum wage down, because comeon I have been here in US for over 10 years and the fedral minimum wage is still the same( state min.wages might vary) but even if the wages has gone up, so has inflation. Just the gas price has gone up dollar and half in a year and your size of hambugers has shrinked in sizes or the quality of food and goods we consume has gone down as well. That is a whole other story.

But if you guys are in H1 or applying for H1 this April ask other H1 holders what the situation is. 8-10 years ago it was a different story now it is a whole new ball game.

WoW, forgot one other thing, if you are in H1 you cannot work in any other jobs besides your field. Now that is totally a trap. Get people from a third world or any other countries and make them pay taxes on wages that they really don't earn and they are obligated.

Some of you wouldn't agree with me, which I know, but people always look into a big picture and the reality of the real world.

Who is making the money? Consulting companies ofcourse, the US gov.= IRS and ultimately the Companies who saves money having cheap labor.

Who is in loss? H1 holders and eventually GreenCarders and the US citizens. Its a survival for fittest but that holds true in Natural envirounment not in manupulated envirounment. So good luck to you all. I am a GC holder if I loose a job I can go flip hamburgers if I have to survive. Do you think you have an option? Working underneath the table. Guess what there is a competetion there too. I know well qualified people working for less wages in gas stations or other unrelated field who are in IT filed. This holds true in any field of H1.

Concluding my statement: These are just my thoughts and my math, but my analysis is coming from the realtime experience and from the east and the midwestern states. The US economy has a lot to do with the current situation which is another major issue.

Hope you guys enjoyed my thoughts, but seriously think about it..........

I doubt that this will pass.  Especially not in election year.  Immigration is a dirty word right now among political circles.  Maybe this will be possible in 2009.

It would be nice if they give preference to US Bachelors Degree holders though.

Adding to Thyangboche's post with some changes:

30,000 US Bachelors Degree
20,000 US Masters Degree
20,000 US PhDs (PostDocs would be included here)

40,000 Rest of the world

20,000 for phd including post doc is big number.  I dont think usa will produce such a big number of phd graduates.  it does nt matter even if they are exempted from quota system.  i think number for undergrad should be increased to 50,000 masters to 30,000 and phds are exempted from quota.  just my thought.  this issue need some research though regarding how many quota should be added.  rest of the world, 20,000 is good enough.
