Hi people, desperately i  need help specially,  who had  gone through this situation before or people who know somebody had this situation....your suggestions , comments will make change track of my life and will motivate me ..appriciate in ADVANCE...i strongly believe there are lots of people in shaja with big heart which i have found in my personal quite research...well my case is, after working hard and putting soo much effort(like everyone else) , i got two bachelors degree from here  . Unfortunately i found out "I am out of status" my parents don't know about it. I already talked to Lawyer, he said it's hard to put me back in status. so, i have been thinking about applying canada PR, i have tons of work experience in IT and restaurent management(i'm currently working now) and i'm sure i can score more then 67...i'm being out of status in US , AM I ELIGIBLE FOR CANADIAN IMMIGRATION?? IS VISA OFFICER CARE ABOUT OF MY STATUS HERE IN MY INTERVIEW?? DO I HAVE TO FACE THE INTERVIEW OR MAIL THEM A DOCUMENTS THAT PROOFS MY STATUS HERE?? i have done research in canadian official sites , no one explain about status...

PLZ GUYS I NEED INFO AND SUGGESTION....

( hopefully no one will be in tihs situation ..)

Hi

First of all I am really sorry you are out of status, It is not easy trying to get a degree and also working to pay for it. But Congratulation for achieving what you came to America for.

First of all,

1. Canadian official don't care if you are out of status as long as you were admitted in to USA as legal and you were in status for over a year.

and Second of all

2. if you are trying to apply for skilled worker you need 10 years work experience and you need to provide w-2 to tax returned to prove that.

10 years or 1 year of full time?  it is 1 or 2 years, and definately not 10 years man.... even aus is 2-3 yrs.... bro, best thing for you might be to file for asylum... while you're filing for canadian pr under skilled labor.

good luck.. and don't worry.. life's strange.. things will work out for you... if it is in your destiny , i've known of people destined to deported getting citizenship eventually...

D Bro:

I think recently they made a change to their proceses so they require you to be legal in US to be able to apply for Canada PR. I am not able to find that in their site but you may want to call them before lodging the application. Best of luck bro..

It's sad to know that you are out of status in US. There is always a way to come out of the situation. It's true to say that you won'r be able to retunr back to US any time in future, if you take exit no matter whether you become Canadian or Australian. If you want to stay in US then do whatever you can do here without taking exit, it may be getting married to US citizen or asylum (at least it will provide you with legal status to work in US as long as you don't receive you final approval), all other process will not provide you easy escape.

If you think you can make your life better in Canada and Australia then it could be just like playing a game as you can not predict the out come. I don't have much information about Australia, but I can help out with Canadian immigration guidelines. As per the  rule you need to be legally admited in US for more than a year,.........remaining works are kept silent which they don't ask but they do look for. It's presumed that if you have become illegal even for a day, your backgraound check will reveal your status in the US which will guide your application towards refusal. As per rule, they do 2nd background check at the time they issue Immigrant Visa, so it's not easy to hide your status from Canadian immigration officer. In the process of immigration Canada share lots of information with US govt. (as we are applying from US) which provide better opportunity to US govt to locate you and accelerate deportaion.There have ben only couple of instance that I know of, where ppl from US were issued Immigrant visa from Canadian consulate and that was way back in 1999 to 2000. You can find all above informations in google, try it.

The beter out come of this situation will be to file asylum in US, once you get you temporary status in US that means long before your approval, just go ahead and file refugee in Canada. The processing time for refugee is less as compared to skilled worker.

Thank you ARS , your input helps me out a lot to making my decision...Sakhu thanks for the contact info u have provided to me....BUT STILL CONFUSED!!!..some people i know they are saying status won't matter for canadian immigration...plz more suggestion from the people who had been through this situation,,,plz

Hi  D

 Status doesnt matter for applying canadian PR

While filling out the form there is a place where we need to write the status in USA and we can list "out of status " if you are not in status

the only thing matter is you should be lawfully admitted to US for one yr

You can check these things in the canadian immigration website by yourself

One thing I did not understand ... the immigration form does not require you to give SSN how they will be able to check your background???? Pls justify your answer...

ARs, if you could consult me too, i would be very grateful. I've been living in usa for last 8 yrs in f1 status and just completing my masters in few months. after years of hard work, and stress i am burned out and don't wanna go through another round of h1 and gc crap in usa. i want to be socially secure , even if i have to be poor and cold in Canada. can you guide me if there is a way for me to show my experience in usa to qualify for skilled labor in Canada since i was in f1 status and wasn't allowed to work off campus. I worked on campus but only temporary jobs like in helpdesks and stuff. can you tell me how to file for asylum?
your help will be truly  appreciated ...

Well whatever you saw in www.notcanada.com is bitter truth for Canadian immigrant. Keeping in mind that you may not get job in your field and still wants to consider immigrating to Canada then it's better idea if you have no other choice rather than going back to Nepal. You can see in video, every other people were educated in non Canadian university and they had long lasting struggle. So the best bet is to join Canadian university and get degree and then find jobs, this trick has helped many immigrant. Every one has their own reasons for immigration but process is same for every one it has point system and you need 67 points to qualify, having cutoff point is not sufficient to get approval, it depends upon many factor and circumstances that’s why I say outcome of an application is unpredictable. 

Kalopani, I see that you have masters degree without any work experience. Working in front desk won't help you. To be eligible for skilled worker you work experience must be listed on  Job title Category A NOC, If you do not find you job title in the list then you can not claim points for that work experience. It seems like you may not get any points from US local job until unless you have any other work experience back home, make sure don't lie anything as everything will be verified before any decisions are made. As far as refugee is concern, I don't see why any one in status will claim for refugee as this category is reserved for refugee and illegal people, I fear you may not fit into this category. The best goal will be to secure a position in US itself and then collect work experience which will qualify you for skilled worker.
