 h1b stamping in Nepal - Urgent help

Hi Friends,

I graduated in May 2006 and I applied for h1b in 2007 through IT consultancy.  I got my h1b approved with change in status with new i-94 starting from Oct 1 2007 till 2010.  I joined Masters since May 2007 to bridge my gap until Oct 2007.  On Oct 1st, 2007 i droped my classes and i started working with my company.  I don't know what happened to my SEVIS after october 1st.  My international offer didn't cancelled it manually.

Now I am planning to go to Nepal but i have to get visa stamped.  I have all the required documents but a little bit worried if they won't let me back in US.  Please let me know if it is safe to go to nepal and go to embassy for h1b stamping there.  Does anyone has bad experience?

 

I really need your advise friends.

I don't think you will have any problem, but many of my friends who had similar situation as yours went to Mexico and got their H1B visa stamped. I am not exactly sure why many people prefer going to Mexico over Nepal for visa stamping, but I would guess it is easier to get visa stamped in Mexico and if there is a problem at the Consulate or at the entry point, or if they demand more paper work, you can promptly contact your company lawyer or immigration attorney and straighten out the case. i think you are fine with your status but  its always better to consult a lawyer for the piece of mind. why don't you consult an immigration attorney, pay some 100 odd bucks and get the professional advise.check murthy.com. i find them best in the market.

regarding the h1b stamping in nepal. i had a successful stamping this march. but it was not a peaceful one. they halted my decision by 10 business days saying they need to investigate about my consulting company.  during the interview i was asked hell lot of questions out of blues. their conclusion was i am over qualified for the job i was doing and i should have opted for some better positions. they finally asked me to go home and wait for their phone. no timeline, no deadline just wait. but they assured that it was just a process. i had to delay my nepal stay by 3 weeks just because i did not get visa. but i am finally back here working on the same project.

moral of the story: avoid getting h1b stamped in nepal as far as possible. go to mexico, you don even need a mexico visa and its just a one day process. but if you already have your tickets done for nepal then don worry, your stamping may be delayed but never be rejected (unless its a unique case). I have already booked round trip ticket.  I got vacation for 2 weeks so i will have to come back right after 2 weeks i reach nepal.  Will i be able to get visa appointment within 2 weeks?  Is there any h1b stamping rejected case in Nepal..... Please let me know...

If you mean you applied for H1B with new I20, your sevis should be automaticaly terminated by Oct 1. No need to worry, you are authorized to work from Oct 1.

Now the visa stamping thing. Think about yourself, if you did your schooling without semster break, average or good GPA, working in the same or similar field, chance of visa stamping is very high unless they find your name matching with their criminal list. If your name matches with that, they may make you wait for 2 to 4 weeks. Average time is 2 weeks. If you have a degree in Biology and you are working in IT, still you dont need to worry. But I have seen more problems in such cases than earlier one. This is the main reason people go to Canada or Mexico to get their visa stamped. These are things I have seen here and there. Last thing, there is no reason to get worried, rejecting H1B visa is very very slim. Only fery few people with bad luck have to wait sometime 2-4 weeks. This is just my practical immigrant knowledge. Hi Nepalean, thanks for your suggestion.

When i applied for h1b, i didn't have new i-20 and USCIS approved my h1b and they even changed my status without new i-20, even my opt expired on May.  I got new i-20 (around July) after i got h1b and COS approved.  I don't think my SEVIS automatically terminated.  Will I have any problem in that case?
