Person A is US citizen and filed Family Based Immigrant Visa Petition for Person B (who is in Nepal). The petition is approved.

Person B has dependent Spouse and dependent Childen in Nepal.

When Person B applies for Immigrant Visa at the US Embassy, can the person include the dependents in that application for Immigrant Visa?

Thanks for any thoughtful/experienced/professional responses.

I think person A should have already included person's B dependants as well in the petition he filed.

Can you be more specific?

Since it is a family based sponsorship, What is the relationship between person A and person B?

At the time when you applied for visa petition did you include both Person B's dependent Spouse and dependent children on application? If not then you can't include them now. If person B married after you filed visa petition then thats totally a different case as far as i know.

Person B is one of the parents of Person A.

KOOLDUDE:

On the file I-130, all the dependents of Person B were listed on the petition, but separate I-130s are not filed for individual dependents.

 The dependent children of B are under age of 20.

 Dependents do not need to file separate I-130. If dependents were listed on I -130 when Person A filed petition then they are all set. Now since your case is already approved all you need to do is wait for visa number. When visa number is available for your case US EMBASSY in Nepal gonna contact Person B in Nepal. Then Person B has to fill form DS-230 Part 1 and 2 where they include all dependents.That means Person B must inlclude all dependents when they apply for immigrant visa application that is DS-230 part 1 and 2. Hope you got all information.

if on your i-130 u did not indicate the dependents, there might be slight problem...

it may be suspicious.. all of a sudden now u have dependents.
