what will be best option to file green card?

I am applying on EB-2 category and I am on H1-B status. I am planning to get married this winter. Is this good idea to file labor certification for now and apply other application forms after I get married so that I can file both for me and my wife?

Please give suggestion. Thanks

If in NY (or even elsewhere), call up Keshab Seadie or Khagendra Chetry (google up their info).  These Nep lawyers here in NYC would give you all the basic info regarding your above issue or any other legal questions you may have for free...No need to stress dude.

karmayogi , I think this is the good time for you to start your labor certification.

Normally it takes atleast 2 months to get all the initial paper works done (Prevailing Wage Determination, Advertize in Newspaper etc.) and then it takes somewhere between 2 and 16 weeks to get the PERM approved. If you start today, your initial paper work will be completed by October 15th . In best case scenario you will get the PERM approved by November 1st. You will have 6 more months to file for I-140 and I-485 if you file it concurrently, May1st 2009 that is.

So, yes! file labor certification now, get married in winter and apply for GC after you get married. That would be a good wedding gift from you to your wife. She will start working before your honeymoon period is over.

Karmayogi, It depends. You might want to visit trackitt.com to see the approval trend of Green Card. I have seen some Nepali whose GC was approved in 2 months (EB2) and some waiting for 1-2 year.  At this point, the best shot for you would be getting married and apply for labor.
