Frustrated not getting selected in h1b lottery with good education and experience. I was angry with all the H1b holders who has fraud resume and degree. 

Now there is a ray of light on the horizon.. See the see below. At lease USCIS knows what the heck is happening here.


Government study finds H-1B visa fraud

USCIS finds 27 percent rate of fraud in the H-1B visa program, including paying low wages, forging documents, and misrepresenting jobs

A U.S. Citizenship and Immigration Services [USCIS] study, H-1B Benefit Fraud & Compliance Assessment  published in September but just coming to light this month, found a 27 percent rate of fraud in the H-1B visa program.

The study, conducted by The Office of Fraud Detection and National Security [FDNS], drew 246 cases in a random sampling of the 96,827 "approved, denied or pending I-129 petitions" for employment of a non-immigrant worker filed between October 1, 2005 and March 31, 2006. Employers hiring IT professionals under the H-1B visa program must fill out an I-129 petition as well as an LCA [Labor Condition Application]. 

In order to insure that the applicants could be interviewed for the study, the BFCA looked at those seeking to extend their existing H-1B non-immigrant status or those who were seeking new employment as an H-1B nonimmigrant while living in the U.S. in another non-immigrant visa status.

The study found two types of fraud, "willful misrepresentation, falsification, or omission of a material fact" and a second type where there was no willful fraud, but "there was evidence that the employer or alien beneficiary failed to comply with applicable laws and regulations."

However, although some of the "technical" violations were minor infractions, the description of some of the "technical" violations appear to be serious breaches in the regulations.

For example, there were instances where "the employer failed to pay the beneficiary at least the prevailing wage for the particular occupation in the specific geographical location as noted and attested to on the LCA filed with the Department of Labor."

Another violation that was considered technical was the employer charging back to the petitioner the filing fees the employer was obligated to pay, according to the regulations. 

The study said this practice had the effect of "lowering the beneficiary's wages to less than the required prevailing wage."

The most blatant misrepresentation cited by the study was in a case where the H-1B visa worker "was performing duties that were significantly different from those described on the LCA and I-129 petition."

In this particular case, an IT professional hired as a "business development analyst" was found to be "working in a Laundromat doing laundry and maintaining washing machines."

Are Chinese also doing like Indians doing? I have never heard of Chinese IT consultancy . may be there are.

Because of these mushrooming Indian IT consultancy, I think very few is getting directly hired in IT field. All in contract. Except for some students from IVYs or similar or with very very strong resume and references (not faked).

I am not into IT. It is wierd to hear that people give phone# of friends for references. IT bhanne bitikai nai aba ta not a WOW JOB. Jaslai sodhe pani IT ma. Anyone from biology degree to Geology degree can learn IT in 1 month, who does not even know I of IT !!!!! That is a WOW certainly.

Bichara real IT students haru lai fasad.

Sure dude , Fools like u r tarnishing the image of Computer related field with these kind of statement..

if Learning IT means to open the internet and working withe office packgae then it won't take even a month dude..

I agree on the original post that dhoti consltncy le garda genuine people haru le job napayeko ho..And U don't have to graduate from IVY league and need referral get a job, if u stick to ur motive then  sooner or later u will get the job....

i also have not heard chinese consulting firm.  actually i asked one of my chinese coworkers and he also knows about this indian consulting firms.  ;)

i also had similar impression, how could i get the job done with my 2-3 months of training in certain field with fake resume while i have 16 years of education in some other field.  like mno mentioned, people from all background go for IT.  those with computer science will have no problem, but how about those with some other background who never too a single course in computer/IT. the news is definitely good and i hope all deserving will get H1 B rather than those with fake resumes from next year..

I agree with fact that everyone is saying they are in IT. And when you ask parents in Nepal whose children in US, what is your son/daugher doing in USA? most common answer "Computer Engineer" or IT no matter what they have been doing there. When But in most of cases, most people when the learn to type "Hello World" in Java, they claim that they know Java programming. They are not aware of the wider scope of the program. And most importantly, these days employer do not only expect you to be good only in IT (unless you are hardcore programmer) but expect you to understand IT Systems in terms of business.

Yes definitely, the fake people who got H1B has in fact cut the quota in which a genuine IT person would have joined the company.

As I have analyzed, most of Nepalese interested in IT are not aware of ERP Systems like SAP, Oracle Fusion, BAAM just to mention few. This is real IT which drives the global economy.
