Answer to your question is "yes". However, the matter of getting H1B approved and VISA stamped is whole different ball game though.

Whatever it is good luck with getting the process straighten up. I have seen lots of H1B pettition failed, even those who have applied from US. So, do not take it lightly and for granted. Rest is u know.

Happy Friday ya'll..

Thanks, I understand, as I am planning to back home and if I didn't get visa (for my PhD, quiting this job) to come back again here, I am just wondering if I can apply H1 from Nepal or not? As I have already work experiance here in USA and had master's degree from USA, I am thinking about the worst (missed this lottery this time).

You cant apply for H1b. You company has to apply it for you. Regarding indians, they do it through either consultancies or they have a branch company over here, like InfoSys. According to my understandin, this branch applies on behalf of them.
