Need H1 to F1 Help Transfer Help !!!


Please Let me know if you guys have change your H1 visa to F1. Couldn't find the job for last 5 months so I want to go back to grad school but I don't know how I can change to F1.


Please Let me know the process and if I need to go thru lawyer...the name of the immigration lawyer that you know of.


Looking forward to get the reply.

please remember contacting lawyer and paying their fee is the only way out to atleast get answer to immigration related issue (esp. h1b) as there are so many loopholes and every case is different than the other.


making a google search, asking question to seniors and posting threads in online forums will not help at all and you might end up with false answer. so please make sure to contact lawyer to atleast get the correct answer even when you might decide not to change back your status to f1. BETTER SAFE THAN SORRY.

you dont need a lawyer to change your status.  get I 20 from a school and they will help you with changing your status.

You cant just get I-20 from school when you are in H1 visa.Once you are in h1 your SEVIS record is already cancelled so inorder toget new I-20 the school has to generate new SEVIS record for you for which you have to apply change of status by filling form I-539 along with the supporting documents like an essay mentioning why you want to change status to f1,  $300 fees plus there are a list of documents which INS/DHS requires. I have the requirement list print out I can email you if you want.


So pedro pls dont fall into false impression only changing between schools in f1 require new I-20. but change of status from h1 to f1 is completely different process. I know this because I have similar situation like yours I also went to my international advisor and asked for new i-20 as i didnt want to stay in h1 anymore. My advisor smiled and replied me back explaining school cant just issue an I-20 for me as my SEVIS record has already been canceled. I've to file change of status which takes 2-4 mnths and go thru the procedure. I dont wanna make things complicated but once again please contact lawyer for safe and sound solutions .


Remember, making sure that you dont loose your h1 status just in case your f1 transfer request gets rejected should be your top priority and lawyers are the only one who can give you proper advise by studying yor case in depth. BETTER SAFE THAN SORRY

I did nt do it for myself but i know a person who did.  things might have changed but i believe you can apply to colleges even when you are in H1 status and can get I 20.  however, you have to change your status and it does take 90-120 days.

Hey Peter1234,


I am also in same situation and trying to change to f1. My prob is I do not have pay stub. I did little research and found out that I have to submit paystub to show that I was in status while in h1.If you have paystub for at least 2-3 months you wont have problem to change to F1 when the college accept you to admit.


If anyone has changed from h1 to f1, please share.

Hi even i am in the same boat my h1b started from oct 2008 from f1 status and since then i didnt got any job n now my employer is asking me to go back to home country. I want to change to f1 again but i dont have paystubs since my h1 started. so please anyone who r in the ssame situation and have any information please advice.

Guys,
         I am also in the same boat. My employer revoked my H1b within a week after my project got over. But immediately, i have transferred to some other company. It is in pending status. I am really worried what would happen if it gets rejected. I heard that if it is rejected, i can file change of status from here. I need to leave country and then file for change of status from there. Is that correct.?

           From changing status to F1, I talked to international adviser of Norther University of Virgina. According to her, i can get I20 and enroll the class. Once i enroll the class, then i have to file for change of status. I agree getting I20 and change of status is two different process. But i believe, we can get I20 and enroll the class. But after enrolling the class, we have to file for change of status.

If you don't have paystubs, then u need to contact labor department. Your consulting company cannot keep u in h1 and not pay u. That means, call the labor department and make your company pay for the time when they didn't pay you..even if u were never in a project or between projects or whatever the case might be.............being in h1 and not having paystub means being out of status ........so even if u goto Nepal, they might give u problems in getting VISA again to come to USA ........saying u were out of status in h1 cause u didnt have year to date in tax ....so there is no other way , but to contact labor department and make your company pay for the time u were on h1, but when they didn't pay.......the worst would be to overstay your I-94 ...which means being illegal............Since h1 laws are confusing and complicated and it has been abused recently......they might let u come back even if u didnt have paystubs ......but they will definitely wont let u back in the country if u overstayed when your I 94 had expired ..........so don't be shy, or be in fear..............yes, they might have helped us get h1 .....but they had also abused h1b program and now they are busted.......and they had always exploited us when they had a chance........not that we wanna go against these companies..but we dont have a choice.....maintaining our status is our top priority now ......and this is how the dice rolled .......and the only way and choice we got is to call labor dept.......make the company pay......get the pay stubs ..and then going back to NEPAL FOR MBA in good school ..........even staying in america and doing MBA might not get us anywhere..same h1 B.S .........so let's go back home and get married..and we will enjoy oranges in the sun with our wives........and try to get a job or do some business....or better join politics.............if our parents can support us financially, or have a brother to crash and go for MBA school...staying in USA might be a good idea.......and also get money for the h1 and trainning fees from the company.......that the company charged........that was illegal...........sorry but things are busted now .....and we all know that ........so better in compliance with the US government and its laws..........and it's helping poor consultants like us........so go get your MONEY ! ...then goto CANADA australia .....or better go do something in nepal.................buy an inverter, a big television.......and enjoy NEPAL !
