Innocence in Coma: A young guy hit by US embassy vehicle battles for life

With tubes and needles attached to his wrist and various parts of his frail body and nurses regularly checking on him, Sunny Nakarmi, 20, is struggling between life and death at the Intensive Care Unit (ICU) of Blue Cross Hospital in Tripureshwor, Kathmandu after he was hit by a U.S embassy vehicle just a day ahead of Holi festival on March 9.

Doctors involved in Sunny’s treatment say he immediately slipped into a coma after suffering a serious brain injury in the accident and has been bed-bound for the last three weeks.


For more than 18 days he was under ventilator support due to acute respiratory failure, the doctors say, but now it has been removed and he is breathing normally.


Dr Ashish Shah, one of many doctors attending Sunny, said the young lad has passed the critical stage and that his bodily functions is gradually becoming normal. But that’s just about it.


“I can’t really say for sure when he will come out of coma or even if he ever will,” Dr Shah said. “His half closed eyes sometimes respond, but his body is simply unable to make any voluntary movement.”


According to the doctor, Sunny suffers regular seizures; otherwise he remains in an immobile state all the time.


“He is as we call it in a vegetative state,” he said. “It is highly unlikely that he will now lead a normal life, but let’s hope for the best and pray for this young man.”


Sunny, an undergraduate student from Ace Management College, was seriously injured when his motorbike was hit by a vehicle driven by Jennifer L. Kar, an employee at the US embassy in Kathmandu, at around 9 pm, near Jai Nepal Cinema Hall. He was returning home to old Baneshwor after meeting with his friend.


His family members claim this is clearly a hit and run case, and quoted a police official, who was the only witness to the accident, as saying that the vehicle with the blue license plate and having registration no 61 CD 25 (blue license plate are driven by the diplomatic community) immediately fled from the scene after hitting Sunny.


The policeman, Inspector Bam Dev Gautam, who witnessed the accident first hand, told a leading daily that the vehicle immediately sped away after hitting the motorcycle, and that only after he reported the accident on his walkie-talkie, that it was caught in Durbar Marg, few hundred meters from the scene of the accident.


Embassy officials arrived at the Durbar Marg police station shortly after the vehicle with its driver – later identified as Jennifer L. Kar through the license the police seized from her at that time - was taken under control. As is usual in accidents involving vehicles, the Traffic Police took over the case.


Meanwhile, police rushed the gravely injured Sunny to Bir Hospital.


“But since there were no beds at the Intensive Care Unit of the hospital, we took him to Blue Cross Nursing Home,” Suresh Nakarmi, Sunny’s elder brother, said remembering that fateful night.


Suresh said in the days after that they met few US embassy officials, but Jennifer, who was involved in the accident, never turned up. And despite their requests, they weren’t allowed to meet her or neither anyone from the embassy visited Sunny at the hospital to learn about his condition.


Kishore Pradhan, one of the US embassy officials they met during the period, took the responsibility of the accident, assured them that the US embassy will meet all the medical costs and provide appropriate compensation also. Only after this, the Traffic Police returned the vehicle to the embassy.

“But later they tried to wash their hands off the case by making various excuses like, for instance, saying that this is an official matter and they have to first hear from Washington DC before doing anything in this regard,” Suresh said in an agitated tone. “They remained out of touch for another two weeks. We tried to contact them, but to no avail. After it simply became unbearable, we went to the embassy. At first they altogether denied that anyone with the name Jennifer works at the embassy. But after we kept on with our demand that the embassy should bear all the medical costs, they said we can go anywhere or do whatever we like and that it is none of their concern.”


Unable to bear the mounting medical costs – according to family members the hospital bill alone has come to Rs 600,000 with more than Rs 20,000 per day in medical bills and other hospital expenses– the victim’s kin took the case to the Foreign Ministry hoping something might come up with it. But Keshav Khatri, who is Sunny’s cousin brother, said they received little help from there also as the ministry officials were reluctant to take up their case after learning that it involved US embassy and kept making various excuses not to meet them.


The victim’s family members then went to National Human Rights Commission (NHRC), but the officials there said that since it is a case involving a diplomatic official, it clearly falls out of their jurisdiction. They, however, agreed to file a complaint case.


On Wednesday, 23 days after the case got much media hype with most of the television stations and major dailies covering the story, the US Embassy issued a “news release” under the title “Motorcyclist Crashes into Embassy Vehicle” in which it claimed that its employee was not at fault in the accident.


In the statement the US embassy said, “On March 9, at a police checkpoint near the Chinese Embassy, a motorcyclist attempted to avoid the police line, lost control of his motorcycle, and crashed into a vehicle driven by a U.S. Embassy employee.”


It further said that the police already at the checkpoint witnessed the motorcyclist’s crash.


A police report of the accident was immediately filed. No charges were filed nor detentions made because the accident was clearly the fault of the motorcyclist evading the police, the release said.


Extending best wishes for a “speedy recovery” to the injured motorcyclist, the US embassy said that its staff, including the driver of the vehicle hit by the motorcyclist, “have acted, and continue to act in full accordance with all Nepali laws and cooperated fully with the Nepal Police at every stage.”


According to Transportation Act 1990, if a vehicle hits a person resulting in the death of the latter, then the driver of that vehicle (or its owner) will have to pay a maximum of Rs 300,000 in compensation and 17,000 in funeral expenses. If the victim is injured, then the vehicle owner has to bear all the medical cost of the victim, sometimes, in the case of critical injury, for his whole life.


Similarly, if the vehicle’s driver runs away from the scene of the accident without attending to the victim (or doing something to take him to the hospital), then a prima facie case may be lodged against the driver which assumes that he or she was clearly at fault.


Holding a press conference at the Blue Cross Hospital Tuesday, relatives of Sunny accused the embassy and its employees of acting ‘irresponsibly’ towards the victim.


Suresh said that their father, who was sick from a long time, also died three days ago after being unable to bear what had happened to his son. Sunny used to mostly take care of his sickly father.


Including elder brother Suresh, Sunny’s mother and two sisters can’t be at the hospital as the strict mourning rules require them to stay in their house for 13 days.


Reacting to the embassy statement, Suresh said, “Even if for the time being we assume that what the embassy is saying is true and that the driver was not at fault, I still want to ask why she fled instead of attending to my brother.”


According to Suresh, his brother was left lying on road for half an hour after the US embassy official’s vehicle hit him and that if he had been rushed to the hospital immediately after the accident it would have made a big difference.


“But she just ran away from there. Didn’t she even have a little bit of humanity left inside her?”

Motorcyclist Struck Dead In Northern Allegheny County

PINE TOWNSHIP, Pa. -- A
doctor is accused of hitting and killing a motorcyclist with his car on
the Pennsylvania Turnpike in northern Allegheny County after leading
police on a high-speed chase early Thursday morning.Pennsylvania State
Police said the motorcyclist -- Keith Brown, 46, of Green Bay, Wis. --
was struck near mile-marker 33 in Pine Township at about 5 a.m.Police
said the driver who hit the motorcyclist is Shiva Lal Acharya, 33 (pictured below).
Trooper Robin Mungo of the Pennsylvania State Police says Lal Acharya,
who is a medical doctor from Illinois, ran from the crash scene. Mungo
also says Lal Acharya's troubles began hours earlier when Ohio police
tried to pull him over for speeding.


"The suspect appeared as though he was going to stop. But after a mile
and a half he increased his speed hoping to elude the patrolman. They
reached speeds up to 130 mph before the officer called off the 23-mile
pursuit at the state line," Mungo said.


Mungo told WTAE the doctor never slowed his BMW down and instead made
one bad decision after another, ending with the death of an innocent
man."It's surprising when anyone leaves a scene. No one should ever
leave the scene of a crash no matter what type of degree you have,"
Mungo said.But in this case, police said the degree may have mattered
because the man who should by law have rendered aid is a man who makes
a living saving lives.Following the crash at about 4:10 a.m., Lal
Acharya ran into some nearby woods and was located after 8 a.m.
following a search that included several police agencies on the ground
and a helicopter above the area, police said. When he was arrested,
police say Lal Acharya was wearing shorts, a T-shirt and no shoes, with
visible head and leg injuries. He was taken into custody on several
charges, including homicide by vehicle, hit and run, leaving the scene
of an accident and other traffic violations.Investigators said Lal
Acharya had been on his way to Easton, Pa., for a job
interview.Eastbound lanes of the Pennsylvania Turnpike were closed and

A Chicago doctor charged with killing a motorcyclist in a hit-and-run
accident has committed suicide in the Pennsylvania jail where he was
being held, officials said Sunday.


The Allegheny County medical examiner’s office confirmed the death of
33-year-old Shiva Lal Acharya. An autopsy was scheduled for Sunday. No
details were immediately available.


The doctor killed himself about 11:30 a.m. Saturday, Acharya’s nephew,
Ramesh Lamichhane, of Harrisburg, told the Post-Gazette of Pittsburgh.


Acharya was driving from Chicago to a job interview in Easton, Pa., on
Sept. 4. Police say he began fleeing Ohio authorities at high speeds
because he didn’t have a valid driver’s license in that state.


Police say he lost control of his car on the Pennsylvania Turnpike,

अमेरिकी दूतावासको गाडीले ठक्कर दिँदा गम्भीर घाइते भएका एक नेपाली
'कोमा' मा छन् । तर, दूतावासले क्षतिपूर्ति दिनसमेत मानेको छैन ।



एस म्यानेजमेन्ट कलेजमा अध्ययनरत २० वर्षीय सन्निना नकर्मीलाई फागुन २६ गते राति
साढे नौ बजे हात्तीसारमा अमेरिकी दूतावासको गाडीले ठक्कर दिएको थियो । बानेश्वरनिवासी
नकर्मी सोह्रखुट्टेमा साथीलाई भेटेर घर र्फकंदै थिए ।



६१ सिडी २५ नम्बरको गाडीले नकर्मीलाई ठक्कर दिएको उनका आफन्त केशव खत्रीले बताए ।
गाडी अमेरिकी कूटनीतिज्ञ जेनेफर एल सरेले चलाएकी थिइन् ।



तर, दुर्घटनापछि कूटनीतिज्ञ जेनेफरले घाइतेको उद्धार गरिनन्, तत्काल भागिन् । संयोगले
प्रहरी प्रभाग दरबारमार्गका निरीक्षक वामदेव गौतम हात्तीसारमै थिए । 'मेरै अगाडि
दुर्घटना भयो, गाडी भाग्यो,’ गौतमले नयाँ पत्रिकासित भने, 'मैले तत्काल निर्देशन
दिएँ, गाडी दरबारमार्गमा समातियो ।’



गाडी प्रहरीले नियन्त्रणमा लिएको केहीबेरमै दूतावासका कर्मचारी आए र छानबिनको जिम्मा
ट्राफिक प्रहरीले लियो । 'मैले दूतावासका कर्मचारीकै रोहबरमा गाडी र चालकलाई ट्राफिक
प्रहरी महाशाखाको जिम्मा लगाएँ, त्यसपछि के भयो ? मलाई पनि थाहा छैन ।’



उता घाइतेलाई तत्कालै प्रहरीले वीर अस्पताल पुर्‍याएको थियो । 'घाइतेको अवस्था गम्भीर
थियो, वीर अस्पतालमा आइसियू खाली थिएन । त्यसैले त्रिपुरेश्वरस्थित ब्लुक्रस नर्सिङ
होममा पुर्‍यायौँ,’ घाइतेका आफन्त केशव खत्रीले भने ।



नकर्मीको टाउकामा गम्भीर चोट लागेको छ, घटनाको २३ दिन (मंगलबार) सम्म पनि उनी कोमामै
छन् । नर्सिङ होममा उपचारका क्रममा अहिलेसम्म ६ लाख रुपैयाँ खर्च भइसकेको छ ।



थप खर्च जुटाउन नसकेर नकर्मी परिवार अत्तालिएको छ । तर, अमेरिकी दूतावासले क्षतिपूर्ति
दिन त परै जाओस्, घाइतेको उपचार गर्नसमेत अस्वीकार गरेको छ ।



घटनाको अर्को दिन प्रहरीले कूटनीतिज्ञ जेनेफर र घाइते नकर्मीका आफन्तलाई दरबारमार्ग
प्रहरी प्रभागमा बोलाएको थियो । 'तर, घटनाकी जिम्मेवार जेनेफर आइनन्, दूतावासले प्रतिनिधि
किशोर प्रधानलाई मात्र पठायो,' घाइतेका आफन्त अश्विनीले भने ।



दूतावासका प्रतिनिधि प्रधानले घटनाको जिम्मेवारी लिँदै उपचार-खर्च बेहोर्ने र सक्दो
सहयोग गर्ने प्रतिबद्धता व्यक्त गरेका थिए । यही सहमतिका आधारमा ट्राफिक प्रहरीले
दूतावासको गाडी फिर्ता गरेको थियो । तर, 'अफिसियल केस भएकाले वासिङ्टनमा सम्पर्क
गर्दै छौँ भनेर झुलाए, र दुई सातासम्म सम्पर्क गरेनन्,' पीडितका आफन्त अश्विनीले
भने ।

कर्मचारी सम्पर्कमै आएनन् । 'के भयो, कसो भयो भनेर बुझ्न खोजेका थियौँ, तर त्यहाँका
कर्मचारीले जेनेफर एल सरेन भन्ने मान्छे नै दूतावासमा छैन भनेर पन्छिन खोजे,' नकर्मीका
आफन्तहरूको भनाइ छ, 'हामीले उपचार-खर्च चाहिन्छ भनेर जोड गर्न लागेपछि जे सक्छौ गर
भनेर धम्क्याए ।'



दूतावासका कर्मचारीले जेनेफर नामकी महिला नै नभएको दाबी गरे पनि जफत गरेको लाइसेन्स
प्रहरीसँग छ । तर, भाग्दै गरेको गाडी नियन्त्रण गर्ने र अर्को दिन मौखिक सहमति गराउने
प्रहरी अहिले मौन छ । 'उच्चस्तरीय कूटनीतिज्ञलाई हामी कारबाही गर्न सक्दैनौँ भनेर
पठाए,' आफन्तको गुनासो छ ।



सहयोगको याचना गर्दै पीडितका आफन्त परराष्ट्र मन्त्रालय, नारायणहिटी पनि पुगेका थिए
। तर, अमेरिकी दूतावासको विषय भनेपछि परराष्ट्रका अधिकारीले भेट नै दिएनन् ।

अमेरिकी दूतावाससँग यसबारे प्रतिक्रिया लिन खोज्दा उच्च अधिकारीहरू सम्पर्कमा आएनन्
। फोन-सम्पर्कमा आएका एक नेपाली कर्मचारीले भने, 'दुर्घटना भएको हो, रिपोर्ट माथि
गएको छ, अरू थाहा भएन ।'

The embassy thinks they are above our law and our weakling government doesn't even have the guts to stand up for its own citizen. When the Maoists were in the jungle they roared against American neo-imperialism and now they are pissing in their pants. If the government won't protect its own people who will? I am disgusted by what has happened here. This news needs to get as much attention as possible. Keep the thread alive.

She fled the scene
because Nepali are bheda. People would have probably beaten her to
death and vandalised the vehicle. Thats how nepali are. She probably
have lived in Nepal long enough to know that it is better to flee than
risk your own life. I have seen a guy beaten badly by local people in similar case and he would have beed dead have police not came on time.

Nepali is not like US or any other
country. In nepal if you hit somebody by car than you have committed a
crime in the eyes of public. And they will beat you which is wrong. 
Accident can happen to anybody. Killing somebody in an accident is not
a crime as long as the driver is sane , not drunk and driving
carefully. Accident happens. Nepali must learn this fact.

Having
said that US embassay is still fully capable of providing medicle
treatment and some funding for the future. Common sense should prevail.

You are justifying the fact that someone can run away after an accident? You smoking weed or something?

a crime as long as the driver is sane , not drunk and driving
carefully. Accident happens. Nepali must learn this fact."

But it's a crime to flee a scene after an accident. And do we have proof that the woman's life was in danger? Was there a crowd trying to beat her up? You cannot leave someone to die in the street, dumbass!

Jedimaster. Dumbass  Are you new to nepal or what?? I am not trying to jusitify anything. I still said US government should take full responsibility of his treatment and future.  Tell me how many accident in Nepal goes without beating and vandalising.  It is very different in Nepal and in US . The place I used to live in Nepal I had a not so good experience of seeing 6-7 accident every year.  Every occasion driver used to get  nasty beaten. It is just a norm in Nepal .

This is shameful. Can someone post this story to news agencies like bbc, cnn, abc, nbc? That person from the embassy should be tried in court. I can't believe the embassy is hiding the culprit and putting the blame on the victim.

Few years back when the Nepalese ambassador was alleged to have stolen a book, there was a huge outcry from Nepalese public about it. But now when someone from american ambassy puts someone in vegetative state which is worse than killing they get to go scott free by releasing a fake public statement.

We need to not let this issue die down. Stand up self respecting nepali people.

Well, If embassy  are trying to run away from this issue then it is utter shameful. It should not cost much to help the poor guy whoever fault it was.

who r we kidding here?The embassy is far too engrossed at this moment to think of Sunny.This is what they r dealing with:


 The lovely Jennifer must be talkin to her family for hours on the phone telling them how traumatic it's been for her not to sleep for two whole days since the accident and later learning that alien has ended up in the hospital.The honorable ambassador must have personally called her to enquire about her state and extended her full support in case she needs some emotional counselling and offered her paid leave.Jenny must have been greatly humbled.Her friends have been calling her endlessly lending their support and wishes and a common answer  on hearing her traumatic ordeal .."wow!Jenny,we love you!please could you take a break to Thailand,it will do your health a world of good!'A good number of  doctors at CIWEC in King's Way must have called Jenny and asked her to call them anytime day or night if she thinks about the accident.


The Embassy must be planning a cocktail party this friday evening to come together for a noble cause of wishing Jenny their shared support.The honorable ambassador  is personally attending the event and has ordered Jenny's favourite cupcakes to be served before the entrees.Jenny is finally looking forward to it and the doctors are so glad on hearing she actually bought a nice pair of evening gown online.They are hopeful she will make a quick recovery.


Guys,we nepalese are fools to believe the Nakarmi family will ever see the light of justice.Instead of going to the embassy begging for their mercy the least we can do is send money from here to the family.So many times we have risen up to help a fellow nepalese in need.It's time we stood up and respected our shared destiny once again.


I am going to call up the embassy tomorrow and ask them if they can channel the money withoout any retard there embezzling it.


Folks,it's time we learnt to believe in ourselves and help each other,for far too long we have made a fool of ourselves in front of the world.Who gives a rat's ass about the americans,the least we can do is improve ourselves.

राजतन्त्रमा राजपरिवारका सदस्य सडकमा सर्वसाधारणलाई गाडीले कुल्चेर बेवास्ता गर्दै हिँड्थे, गणतन्त्रमा अमेरिकी दूतावासका कर्मचारीहरुले त्यस्तै गर्न थालेछन्। गत मार्च ९ तारिखमा राजधानीको हात्तीसारमा राति करिब साढे नौ बजे सन्नी नकर्मी चढेको बा २७ प १४५७ नम्बरको मोटरसाइकललाई अमेरिकी दूतावासका कर्मचारी जेनिफर एल केरले चलाएको ६१ सीडी २५ नम्बरको गाडीले ठक्कर दिएर भागेछ। सुरुमा क्षतिपूर्तिको कुरा गरे पनि पछि भने दूतावासले जे जे गर्न सक्छौ गर भनेर चुनौति पो दिन थालेछ। बिचरा सन्नी भने राजधानीको एउटा नर्सिङ होममा बेहोस अवस्थामा छन् अझैसम्म पनि।

अमेरिकी पारस ? यिनै हुन् जसले सन्नीलाई ठक्कर दिए। यो लाइसेन्स ट्राफिकले जफत गरेको थियो। तर पछि दबाबका कारण छाड्न बाध्य भएछ।


नकर्मीका परिवारजनले सन्नी नकर्मी जीवन संघर्ष समिति गठन गरी न्यायको लागि आवाज उठाउँदै छन्। यसै क्रममा उनीहरुले आज बबरमहलमा अमेरिकी दूतावासको विरोधमा यसरी प्रदर्शन गरेका थिए-

पुरानो बानेश्वरबाट सुरु भएको विरोध र्‍याली नयाँ बानेश्वर, माईतिघर मण्डला हुँदै मैतीदेविमा पुगेर टुङ्गिएको थियो। फोटो सौजन्यः रासस


यही दुर्घटनाको कारण घाइते नकर्मीका पिताको आकस्मिक निधन भैसकेको छ। घाइतेकी आमाले दोषी उपर कडा कारबाही र क्षतिपूर्तिको माग गरेकी छन्। र्‍यालीमा सहभागीहरुले पहुँच र प्रभावका आधारमा परी कारवाही नगर्ने प्रवृत्तिको विरोध गरेका छन्।


दोषी उपर कारवाहीका लागि विभिन्न सञ्चारमाध्यमहरुले पटक–पटक खबर प्रसारण प्रकाशन गरे पनि ट्राफिक प्रहरी कार्यालय हुँदै हनुमान ढोका प्रहरी कार्यालयमा पुगेको यस घटनाको थप अनुसन्धान हुन सकेको छैन। आफन्त, मानवअधिकारवादी तथा केही विदेशी सम्मिलित र्‍यालीका सहभागीले चैत ३० गते सम्म यथोचित सुनुवाई नभए उपत्यका बन्द गर्ने चेतावनी दिएका छन्।


दूतावासले भने पीडितहरु मिडियामा गएकोमा रोष प्रकट गर्दै अब कानुनी लडाइँ नै लड्ने जवाफ दिएको स्रोत बताउँछ। कानुनी लडाइँमा गयो भने ट्राफिक प्रहरीले निकै फितलो रेकर्ड राखेका कारण दूतावास पक्ष नै विजयी हुने देखिने प्रहरी बताउँछ।

1. when car and motorcycle are collided, we think it is car's fault. does it always happen to be fault of car???


2. we think driver is a criminal when he hits someone/something. but are we not ourselves a criminal to beat him up???


3. When a drunkard/child are hit by vehicle (bus/truk) why they valdalise the vehicle? Should not they beat (as they do-but no one should be beaten) the parent of that child who left their children on the road unattended??? [what does it sound if you write + sign instead of - in your math homework and your teacher shut you a bullet.   (one mistake can not be verified by showing other's mistake.) ]


4. Is the highway BISKUN SUKAUNE place? Is it good to halt highway just for little demand each time??? are not they committing crime to halt peoples' critical jobs, madications etc???


these are just my thoughts.......... against our thinking "aafule gareko sabai thik, arule gareko sabai bethik"


 


i felt deeply distressed when i read this story. May god listen to all of ours voice for sunny's recovery.

hundari,


while i agree with your four points, but i highly doubt if any of those four points can relate to this accident.  whatever the case and whoever is in fault, it is a crime to leave the scene after accident.  the person should at least try to contact police or make an effort to take the injured person to a hospital.
