Congrats to all of those who have applied for H1-B i got following email from my company lawyer ...


Great news! 


 


The USCIS (Immigration Service) just announced that the H-1B cap has NOT been met yet.  This means that your case has been accepted for processing.  While this does not mean that your application has been approved (the USCIS still has to review the application), this is wonderful news.  If the government gives any indication on processing times for the H-1B petitions that were filed on April 1st, I will let you know.

Think... How many of them who filed last year (faked ones) were not eligible for H1B (still they filed creating all these issues) while the eligible did not even reach 65000 this year.

How can u make sure the case is accepted ?? They will still do lottery once they get more number of petitions and the same lottery luck.

I asked one of my indian friend. he said that non of the indian consultancies have field for H1B this year. he might be true. Well hope all of our nepali friends get their H1-B

H1B Cap FY 2010 Not Hit

Looks like H1B Cap for FY 2010 was not hit during first 5 days. So, this is good news to companies that submitted H1B this year. There will be no lottery.

USCIS Continues to Accept FY 2010 H-1B Petitions
WASHINGTON – U.S. Citizenship and Immigration Services (USCIS) today announced it continues to accept H-1B nonimmigrant visa petitions subject to the fiscal year 2010 (FY 2010) cap. USCIS will continue to monitor the number of H-1B petitions received for both the 65,000 regular cap and the 20,000 U.S. master’s degree or higher educational exemption cap.
Should USCIS receive the necessary number of petitions to meet the respective caps, it will issue an update to advise the public that, as of a certain date (the “final receipt date”), the respective FY 2010 H-1B caps have been met. The final receipt date will be based on the date USCIS physically receives the petition, not the date that the petition is postmarked. The date or dates USCIS informs the public that the respective caps have been reached may differ from the actual final receipt date.
To ensure a fair system, USCIS may randomly select the number of petitions required to reach the numerical limit from the petitions received as of the final receipt date. USCIS will reject cap subject petitions that are not selected, as well as those received after the final receipt date.
Petitions filed on behalf of current H-1B workers, who have been counted previously against the cap, will not count toward the congressionally mandated FY 2010 H-1B cap. Therefore, USCIS will continue to process petitions filed to:
Extend the amount of time a current H-1B worker may remain in the United States.
Change the terms of employment for current H-1B workers.
Allow current H-1B workers to change employers.
Allow current H-1B workers to work concurrently in a second H-1B position.

      You have a valid point, but based on what was published today as a USCIS press release the following lines caught my attention:

      I am not sure if all the petitions will be involved in the lottery or not. I am also quite confused on how to interpret the sentence.

        The lottery will involve only the applications received the Final Recipt Date (wichh is the date in which the cap will be reached and superceed) and it won’t affect the application received prior the Final receipt date

    I’m guessing 50,000 Standard Cap and 15,000 Masters Cap applications.

    Sounds like they are going to wait until the final receipt day and do some sort of lottery. Is this the mini lottery thing? and to those of you who have previous experience/info, does this mean if you applied already you are in?

    My company’s immigration personnle got back to all of us on behalf of whom H-1B petitions has been filed this morning and told us about the good news that the H-1B cap has not been met for both 65,000 regular and 20,000 Master’s cap. Since they have filed for premium processing, we were also notified that we should have the visa approvals within the next 15 days, although it won’t be effective until October 1st. It has been an amazing day for all of us who had applied for the visa, and as long as its a legit case through a legit company you should’nt worry at all. As fas as Mr. Raju - the aspiring immigrant who wants to come here and buy a BMW, I along with many others who have seen your weird and meaningless rambling over the quotas and visas on this forum for the past month - please do keep us all posted if at least one of your 5 H-1B applications gets approved.

    and BTW, that was just an expamle explaining the meaning of the mini lottery. I did not mean that Apr 7 is the FINAL receipt date at all!!! The final receipt date is still an unknown so for those who still didn’t file their application should file it ASAP!!

    A USCIS spokesman said that based on preliminary numbers, the agency
    has "about half the petitions" it needs to meet the 2010 fiscal year
    cap of 65,000, but it is "just short of the 20,000 advanced degree cap."
