You have heard these stories before on how some employers take advantage of the GC situation with consultants.

Some of the ways that less-honest companies can mess with your GC application are:

X They keep you hostage by paying you less money than they should be. You end up working for a low salary because the company is working on your GC and you cannot move in the middle of the process.

X They slow down the GC process so that you are stuck working for them for a longer period. You are again the hostage! Right now, GC applications are taking longer than ever to process – why would you want to risk joining a company that will delay the process even further?

X Companies like to keep you in the dark about the specifics of your GC application – they can misinform you about the procedures they follow and mislead you into thinking that the process is going smoothly – don’t find out too late that your GC application is going nowhere fast!

X Companies can just lay you off right in the middle of your GC application. It doesn’t matter if you’re working for a Fortune 500 corporation – they don’t care about you or your personal goals – often a downsizing is beyond the control of your hiring manager. You may recall the boom IT years just prior to Y2K – everyone was hiring. However, as soon as the needs were fulfilled, IT employees were dismissed in droves. Imagine being in the 5th or 6th year of your GC process and that happens!


Here are some of the stories we hear from candidates on a regular basis:

– “My employer kept telling me that my GC filing has taken place. It’s been 3 years now and I still have no idea at what stage is my GC filing at. They are very vague with me on this issue.”

– “I thought my labor was already filed – that’s what my employer informed me a year ago. Today I find out that my labor is still at the very initial stage. I have already lost a year of time waiting for it to be filed.”

– “My employer said they would take care of the GC process costs. But now I find out that the labor has not even been filed. I have been with them on an H1B for 4 years now and I am running out of time to file my Green Card.”

– “I have no access to the lawyers so I don’t know if the payment for the GC is going to the right place or if it is actually taking place at all.”


Filing a Green Card is a tricky process, requiring professional legal assistance. Any company you are considering joining should be able to explain to you how they handle this for you, which lawyers they use

And whether you will have access to the lawyers directly (this is critical!)
