 Help!! How to change F-2 to F-1 visa?

Hi all sajha users,


I am in big trouble right now and want suggestions from you. Actually I am in F-2 visa status being dependent of my husband. But due to conflict between him and me we have now decided to divorce. But I don't know if I just get divorce from him what will be the status of my visa? I was planning to join college and change my status to F-1. But as I don't have TOEFL with me, I can't apply. Another thing I found that it will take several months to change status from F-2 to F-1 and if I just get divorce then I am worried that I may not keep my status. And also those colleges are asking to show big amount in bank account which I can't. Is there any way I can get tourist visa or keep my status?

 u will be out of status if primary applicant wants to get the divorce,files for it,gets the approval and notifies his dso"..

Get an independent status..Try to see if u can file for b1/b2 visa..the best thing to do is to talk to immigrtion lawyer ASAP!!

Sorry to hear that! If you are decided to divorce and want to change your status to F1, you should proceed immediately. First, you have to get I20 from the college. They ask for TOEFL and financial documents but making financial document is not big deal. If you have some friends in Kathmandu, they can send you the letter pad and stamps of some virtual finance company. Most of the stationary in Baz Bazar do it. There may be some college which may not ask TOEFL. I know one, Stefen Henegar College. It is in Utah. After getting I20 in your hand, then you apply to USCIS to change the status and it normally takes 3 to 4month.

Good thing is to go back to Nepal. Appear on TOEFL and re-apply from nepal.

Chari,


I don’t know the true reason behind the conflict between you and your husband. But as a married man, I want to say a few things. Please ignore them if they don’t apply to your situation.


 


They say grass always looks greener on the other side. That’s because we always take what we have for granted. Nobody is perfect; therefore conflicts are unavoidable between spouses. But most of these conflicts can be resolved with some determination from both sides. Divorce should be the last resort, not the first.


 


If both of you are forgiving people, reconciliation will be possible. One of you just needs to take an initiation. Think about the first day you two met. Think about all the wonderful things you guys did together in the past. Those happy moments were real. They had truly happened. Try to figure out what has changed now, and see if you can fix it. Think positively and approach your spouse (or let him approach you). Reaching out to him, forgiving him, and accepting your mistakes (if any) aren’t signs of your weakness; they are the signs of your strength.

After reading chari_bichari's situation and tuppi's advice, I have strengthened my love and emotion towards my spouse.


To forgive somebody and to ask for forgiveness are the two strengths of life.


Asking for forgiveness can not be worse than what you got now. So, I wish you the best chari_bichari.

Hi Tuppi-ji,

How about theory of Letting it go. If you love someone and he/she wants to do something, let them go. Don't you want to see happiness on someone you love. 

Or sometimes husband's eyes is always on 19 years old girl's a*s, how you gonna live a life with that person. At that moment, wife needs to move on.

I can't speak for Chari's personal life. But divorce life is not a sweet life.

Chari-Bichari,
Do you really want to divorce? You said you are looking for changing F2 to F1 or to B1/B2. Your plan to change status to F1 sounds reasonable, but what are you going to do with your B1/B2 status? It is better to prepare for TOEFL as soon as possible and apply to a community college where you can pursue degrees at the cheapest tuition. I cannot suggest you to go back and apply for college after your TOEFL is done. That might be risky. If you have someone in mind, other than your husband, get him as soon as possible.


I am sorry to hear about your decision to get divorced, but after-divorce life is not sweet at all.

SIS, what a logic: divorce your spouse because you love him/her too much and you want to see him/her happy.
