DUH= (sarcastic) YES!!

I don't know whether they'll decline or accept!!

In my opinion its better you tell them..
1. In your SSN (it should mention, "VALID FOR WORK ONLY WITH DHS AUTHORIZATION")--> all the employer are bound to check the SSN!!(otherwise its ILLEGAL for them)
2.After work, if you look for POSITIVE recommendation its better to tell them NOW!! (in future if you need to show your work experience and stuff)

I hope and WISH they'll say YES !! but if they feel you tried to DECEIVE them then its NO FOR SURE!!

Always be clear in specifying your status. Dude you are out of country and it is not like Nepal where you can say I didn't know that's why. And it is major concern that that your employer is not e-verified. Be open to your employer and say this is your status but you are really interested to work in that company. honesty counts a lot.

Legally?? Are you guys in LEGALLY BINDING Contract?? (have you signed any contract like that??)

IF NO They might simply say:" the position you applied for is no longer available" !! SORRY and GOOD LUCK!!

Its Hire and Fire Society!!

The employer will have authority to say they will not sponsor H1 and hence are not looking for persons with temporary work permits.

And since you previously did not mention that u r in OPT and require H1 sponsorship later on, it's easy for them to fire you based on providing false information or hiding information if they don't want to sponsor.
