 Need some suggestion on OPT

I have recently completed my graduate and filed for OPT and waiting my EAD. I got a job offer from a company. My I20 says that OPT starts from july 16 2010. So am I eligible to work. Please suggest me .

My understanding-


You must have to have a EAD card to start the job. The USCIS makes the decision for the OPT,


they will mail the EAD card to you. When you get the EAD card you can start working. Untill you get EAD card, it is illegal.

But, if the company still wants  you to start the work immidiately, may be there are some loopholes you can enjoy. It is just my guess though.

Thank you for suggestion. What should I do in such situation. My company needs people right now. If I wait , they gonna hire somebody else. Is there any way I can work without EAD card.

One example I heard:


If company agrees, you go and start working (without keeping any record that you work there), they can not pay you since you do not have EAD. But, when you get EAD, they can pay more that compensate the time you put previously.


But, I do not know exactly, how this system works. I just heard it. I am sorry if it is wrong.

EAD= Employement Authorization Document, so the words tell you all. Without it you are not authorized to work!!

 Wait until you receive the EAD card.
If you can't, then
talk to your DSO before deciding yourself. If possible, let your employer know about your situation, and request for few weeks

So teso bhaye kaam garna mildaina...KAsto mehanat le finally kaam payeko..i dont want to it go..Isnt there any way to start?kehi upaye chaina...aba EAD kurun jel aarko kaam ni paula ki napaula...?Any suggestion will be appreciated...

Legally, you are not supposed to start working before the start date listed on your EAD (you should have your EAD with you before you start work). If the HR department of company asks you to submit proof of your employment eligibility on your first day and you don't have the EAD card then you will be in a embarrassing situation. However, my personal experience is that unless the HR people are used to dealing with a lot of international students, they don't know that they are supposed to check the EAD. They just look at the I-20 (at least that's what happened to me).

Working before getting your EAD is like working off-campus without authorisation. We all know how unlikely it is that anyone would ever get in trouble over that. So, if you don't mind taking the risk, you could just start working for the company but not report the work to your college until your EAD start date. When you report your employment info to your college just put the EAD start date as your employment start date. Again, legally, you are not supposed to start working before you get your EAD card, though.
