Hi,

Can someone please tell the documents that are required for H1B visa stamping in Nepal?

How long can one stay in Nepal in H1B?

Does anyone have any experience for visa stamping in Mexico or Canada? If yes please share with everyone.

Thanks.

P.S.

Information you provide shall be useful for 100's of H1B Nepalese.

You probably  have been hearing stories in sajha about how long they take to process H1B right ?

They might take 6-12 months sometimes. It depends on your Luck..

Canada/Mexio------> Very Risky, They'll send you back to Nepal if Consular is in bad mood.
and when u go to Nepal, you'll likely get Rejected again.
That's what happened to one of my friend.

It all depends on your Luck . .. I'd suggest you to go to Nepal but sometimes they take longer than you expect.

Good Luck.

purana kagaz,

no offense, but I don't see any factual answer in your (edited) response... seems you answered just by reading the title of the thread and what appears to be the 'worst-case-ready-made-answer' (or 'an story', as you said) that we have been hearing..

i have not heard a single case rejected in nepal (provided the applicant has a genuine job in USA)..

purana kakaj....ur answer is like ur name purana...........

currently, you cannot apply for visa stamping from Mexcio or Canada, if your country of origin is Nepal. USCIS have changed that rule.

Secondly, I have not heard anything from 6-12 months. there were very very very few cases among Nepales who had to wait more than a month or so, and never know anyone who got rejected personally. One case of around 4-5 months, becoz his indian consultancy company has black-listed, he switched the company and got his visa.

I personally did mine on feb 2010. 5 days of total time. tuesday form submitted, got visa inetview on wednesday, got passport with visa on friday.

one thing - it will be on average of 2 weeks during busy season, as their are many students and family aaplying for visa.....

so far documents.....there are multiple links here in sajha as weel as in internet..so i would recoomdn you to do somework on your own........

rest....PEACE

Hi Happy Sharma,
Even if you have all required documents, the visa stamping may  go through a lengthy visa processing. This could be worse if you are working for an Indian consultancy in the United States. I presented all the required documents including the client letter, yet I am stuck here in Kathmandu for last four weeks. So, better be prepared for that too regarding your travel arrangements and other plans. Good luck!

First of all thank you everyone for suggestions.

@ Nabina, did you give all the documents? I have an urgent to come to Nepal. It seems scary, but no choice.

I heard if someone work is related to Technology Alert List (TAL)? the process may be even longer.

ANS and STUPIDA

Please refer to nabina's comment before you post your wise comment in Sajha. we're not refering to what you experienced, we are rather interested in what average people experienced ?

Nabina has been stuck for more than 4 weeks and still no answer....and you're saying it doesn't take longer than 5 days ??

Like i said, it depends on your luck rather than your documents.

Good Luck Mr. Happysharma.

Purana Kagaz.

I even had my client's letter with me but still the interviewer said that my case would need to go through admin processing. The note that I got after the interview says that my case has been refused under 221 (g) and it would need further admin processing. It is also written on the paper that they should be contacted if I do not hear anything in 3 months. This is not an outright rejection of visa though. The most annoying part is they are unable to say how long it would take to issue the visa. When I emailed the Consular, he/she wrote that the process takes an average of 3 months but some cases may even take longer than that even a year or more and some cases may be resolved prior to 3 months. So, it depends on your luck. At this point, I can do nothing besides waiting for this uncertainty to end. If you can't avoid coming back to Nepal now, it's better to buy an open ticket so that you won't lose money. But I wish you all the best and I hope you'll get through this without any hassles.

Common....PK......nabina doesn't represent the whole Nepalese too.

When I went out there in feb there were 5 ppl on the same day, all of them got by friday. I know few frds who went recently and got everything in a week even got for dependends...........All i know is if you are not doing any sort of wrong than there is no need to worry.

I am not saying that my case represent the same for everyone. But little knowlede is dangerous. I have clearly told that i have not heard anyone more than a month except one. Well it all depends on your work, ur degree ur company, ur documents, ur family visit and ur way of giving interview....here is what 221(g) means

Section 221(g)
Refusal under Section 221(g) means that essential information is missing from an application or that an application has been placed on administrative hold.

In order for an application to be reconsidered it may be necessary to:

  1. Submit additional documentation as requested, and/or
  2. Wait for administrative processing results.

Applicants, during their interview, will be informed whether further information is required and be instructed on how to submit that information. As part of this process, the applicant is given a "yellow letter" and will have 12 months from the date of application to submit the requested documents without having to pay a new application fee. After one year, an application refused under Section 221(g) is terminated per Section 203 (e).

If your case is subject to administrative processing and you have been advised to wait until the Embassy contacts you, please be patient. We will contact you (at the number or e-mail we verified with you during your interview) as soon as this processing has been completed. Also, when we notify you that the processing was finished and a clearance was granted, you will have 90 days from the date of clearance to drop off your passport and any other requested items at the VFS Application Center. Should you fail to meet the 90-day deadline and you still want to travel to the United States, you may need to be re-interviewed.
