Hi Everyone,
I have a question concerning my GC process (currently on H1B). I'm currently single and my employer has agreed to initiate my GC process within the next month or two. However, here's the tricky part - me and my girlfriend have been together for the past 8 years and we have plans to get married in Nepal around May-June of this year. Since she is currently in H1B and in a different state, we both thought it would be wise to initiate my GC process with her included. Therefore, I plan to have a court marriage here in Boston within the next few weeks and then file my GC as married. I would be grateful if you guys could share similar experience if any. As far as the court marriage process goes, is it pretty much the same as for a US citizen or is there anything specific for non-resident (and yes Alien!)? Your experience around this issue would be much appreciated. Thanks!

Jai Nepal...

It is same for all.

My sister did court marriage here in US. They both are non-residents.

Congratulations in advance.

just call them and set up an appointment. buy at least one ring ( I attended the court marriage and couple didn't even have ring), and a garland (mala). paster will perform what he need to do and you can kiss if you like but its optional...

at least have one friend with you.

yes, you can file it together either with g/f or through yourself...

Good luck ..

Whats your major concern:
  1. How to validate that you guys are couple? : as you mentioned go for a court marriage. Its same for all. I'd suggest that you guys should get married in Nevada. Its so easy, quick and no more hassle. Enjoy your honeymooon in Vegas in the same package.

  2. Procedure to file GC including your spouse ?
    - I suppose you can include your spouse in your GC process while filing I-486 itself.
    - I have even heard that it's not that much of a big deal like before. Even a guy/girl who is marrying a GC holder can get GC too. NOTE:  This is what I heard and dont bet on me. I'd strongly suggest you to get more details from lawyer/online forums ( like sajha)

say you started the GC processing  from April.
-----Prevailing wage----recruitment process-----PERM result takes around 6 months of time.
Only in around september- october, you will be applying for i140/i1485 where you need to mention your wife  in your application.
Since you are planning to go to Nepal in May/June to get married, you have ample time to get married in nepal and return back with marriage certificate.
Why are you getting court marriage here since you will be including your wife in i140/i485 application only and not before that.
The best time is after PERM is applied, go to Nepal, get married and come back.
